Urban planning

Urban planning is a technical and political


process concerned with the development
and use of land, planning permission,
protection and use of the environment, public
welfare, and the design of the urban
environment, including air, water, and
the infrastructure passing into and out of urban
areas, such as transportation, communications,
and distribution networks. Urban planning is
also referred to as urban and regional
planning, regional planning, town
planning, city planning, rural planning or
some combination in various areas worldwide.
It takes many forms and it can share perspectives and practices with urban design.

Urban planning guides orderly development in urban, suburban and rural areas. Although
predominantly concerned with the planning of settlements and communities, urban planning is
also responsible for the planning and development of water use and resources, rural and
agricultural land, parks and conserving areas of natural environmental significance. Practitioners
of urban planning are concerned with research and analysis, strategic thinking, architecture,
urban design, public consultation, policy recommendations, implementation and management.

Urban planners work with the cognate fields of architecture, landscape architecture, civil
engineering, and public administration to achieve strategic, policy and sustainability goals. Early
urban planners were often members of these cognate fields. Today urban planning is a separate,
independent professional discipline. The discipline is the broader category that includes different
sub-fields such as land-use planning, zoning, economic development, environmental planning,
and transportation planning.

Community Housing
Community housing is secure, affordable, long term rental housing managed by not-for-profit
organizations for people on low incomes or with special needs.

Types of community housing


Community housing provides different types of house depending on the needs and preferences of
the family or individual.

Housing associations
Housing associations own properties or manage some of our properties. Like public housing,
these organizations manage and maintain the property using their own staff.
Housing associations are eligible to receive government funding to build or acquire new
properties.
Rooming houses
Rooming houses are mainly accommodation for single people. Residents rent a room in the
house and share common facilities such as kitchens, bathrooms and laundries.
Most rooming houses are being renovated so that the rooms are self-contained with their own
kitchenette and bathroom.

Cooperatives
Rental housing co-operatives are governed by voluntary tenant members with support from
professional staff.
The principles of living in a cooperative include:
The tenant must be willing and able to participate in the running of the cooperative
Cooperative housing is run democratically: all members have equal voting rights
Members contribute fairly to the running of the housing
Cooperatives are independent entities controlled by their members
Cooperatives support their members' further education to help them meet their responsibilities
and commitment to the cooperative.

Specialist housing providers


Specialist providers focus on particular groups, like the aged, homeless youth or people with
disabilities.
These housing providers may have particular programs or specific equipment available for their
tenants.

LAWS AFFECTING SUBDIVISION PLANNING

REPUBLIC ACTS

Republic Act No. 9653: Rent Control Act (2009) an act establishing reforms in the
regulation of rent of certain residential units, providing the mechanisms therefore and for
other purposes.
Republic Act No. 9507: Socialized and Low-Cost Housing Loan Restructuring and
Condonation Act (2008) - an act to establish a socialized and low-cost housing loan
restructuring and condonation program, providing the mechanisms therefor, and for other
purposes.

Republic Act No. 9397: Disposition of Lands for Socialized Housing (2006) - an act
amending section 12 of republic act no. 7279, otherwise known as the urban development
and housing act of 1992, and for other purposes.
Republic Act No. 9341: The Rent Control Act (2005) - an act establishing reforms in the
regulation of rent of certain residential units, providing the mechanisms therefor and for
other purposes.
Republic Act No. 8501: Penalty Condonation (1998)- an act to rescue the national
shelter program of the government by condoning the penalties on all
outstanding/delinquent housing loan accounts with any of the government institutions and
agencies involved in the national shelter program and by amending presidential decree
no. 1752, as amended.
Republic Act No. 8368: Repeal of Presidential Decree No. 772 (1997)- an act repealing
presidential decree no. 772, entitled 'penalizing squatting and other similar acts.
Republic Act No. 8437: Rent Control Law (1997)- an act further extending the rent
control period for certain residential units amending thereby batas pambansa blg. 877
entitled: "an act providing for the stabilization and regulation of rentals of certain
residential units, and for other purposes, as amended".
Republic Act No. 7835: CISFA (1994)- an act providing for a comprehensive and
integrated shelter and urban development financing program by increasing and
regularizing the yearly appropriation of the major components of the national shelter
program, including the abot-kaya pabahay fund under republic act no. 6846, augmenting
the authorized capital stock and paid-up capital of the national home mortgage finance
corporation (nhmfc) and the home insurance and guaranty corporation (higc), identifying
other sources of funding and appropriating funds for the purposes.
Republic Act No. 7279: Urban Development and Housing Act (1992)- an act to provide
for a comprehensive and continuing urban development and housing program, establish
the mechanism for its implementation, and for other purposes.

Implementing Rules and Regulations of R.A. No. 7279 (Summary Eviction):

Acquisition, Valuation and Disposition of Lands

To enable the equitable utilization of residential lands in urbanizable areas with particular
attention to the needs of the underprivileged and homeless and not merely on the basis of market
forces, several provisions in RA 7279 address Acquisition Priorities in Land Acquisition
(Section 9), Modes of Land Acquisition (Section 10), Disposition (Section 12), and Valuation
(Section 13) of lands for Socialized Housing.

Valuation of Lands for Socialized Housing


Specific to the valuation of lands for socialized housing (Section 13) the Department of Finance
issued the following Local Finance Circulars:

Balanced Housing Development (20 Percent Requirement)

Section 18 (Balanced Housing Development) requires that developers of proposed


subdivision projects develop an area for socialized housing equivalent to at least twenty percent
(20%) of the total subdivision area or total subdivision project cost, at the option of the
developer, within the same city or municipality , whenever feasible, and in accordance with the
standards set by the Housing and Land Use Regulatory Board and other existing laws.

Beneficiary Registration
Section 17 (Registration of Socialized Housing Beneficiaries) mandates the local
government units to identify and register all beneficiaries within their respective localities.

Inventory of Lands

Section 7 (Inventory of Lands) directs all city and municipal governments to conduct an
inventory of all lands and improvements in their respective localities to identify residential lands,
government lands, unregistered or abandoned and idle lands, and other lands. This inventory
shall be updated every three years.

Incentives for the Private Sector

Section 20 (Incentives for the Private Sector) seeks to encourage greater private sector
participation through the reduction and simplification of requirements, and provision of
exemptions in the payment of specific taxes.

Proper and Humane Relocation Procedures

In Section 28 eviction and demolition, as a practice, shall be discouraged but will be


allowed under specific situations: when persons or entities occupy danger areas and other public
places; when government infrastructure projects are about to be implemented; or when there is a
court order for eviction and demolition. The conduct of eviction or demolition orders shall be
covered by specific procedures.

Socialized Housing Tax

Section 43 authorizes local government units to impose an additional one-half (0.5%) tax
on the assessed value of all lands in urban areas in excess of Fifty thousand pesos.

Summary Eviction

Summary Eviction is authorized for those who have constructed their structures after the
effectivity of RA 7279 (Section 44) and for any person or group identified as professional
squatter and squatting syndicated (Section 27) . Moreover Section 30 paragraph (2) provides,
"After the effectivity of this Act, the barangay, municipal or city government units shall prevent
the construction of any kind of illegal dwelling units or structures within their respective
localities."
