MEMORANDUM OF UNDERSTANDING (MOU)

Between

I. PURPOSE & SCOPE


The purpose of this MOU is to clearly identify the roles and responsibilities of each party as they
relate to the issue of the maritime boundary of Country A and State B. At the beginning of
representative negotiations put forward a boundary line for ZEE and then Continental shelf on the
border area. The boundary line raises 3 disputed areas / cases ie the area around Shi Island, Pulau
Nah, and Deh Island.

In particular, this MOU is intended to:

- Define boundaries such as territorial, Exclusive Economic Zone, and continental shelf
between the two countries.

- Agree on a predetermined line between the two countries.

- Determine policies related to management and management of the area around the boundary
line.

- Create agreement pact.

II. BACKGROUND
Philippines is an archipelagic state, while China is not an archipelagic country so in determining
the base line the method used is also different. The distance between filiphina and china in the
disputed area is not up to 200 nautical miles, resulting in overlapping of ZEE and continental shelf.
With the existence of areas that need to be done bertampalan bargaining how the determination of
its limits, let alone the area has been found abundant oil potential that will support the economy of
each country. With all the circumstances mentioned above, then between the philiphina and the
Chinese side needs to be negotiated maritime boundary determination.

III. [China] RESPONSIBILITIES UNDER THIS MOU

[China] shall undertake the following activities:

A. Joint Zone: China State may conduct fishing (den island).

By:

1. Traditional.

2. Unlimited amount.

3. At any time with the terms of registration (identity and reporting of fixed results) so that no
smuggling such as the catching of fish is done other than the two countries.

B. The State of China is entitled to the continental shelf to the ZEE boundary of the flipina

C. China's state approves ZEE from the flipin on the island

IV. [Philippines] RESPONSIBILITIES UNDER THIS MOU

[Philippines] shall undertake the following activities:

A. The State of the Philippines has no right to create additional zones on the island, because the
geological morphology of the flipinas is not appropriate.

B. The Philippine nation approves ZEE from China in the island


V. IT IS MUTUALLY UNDERSTOOD AND AGREED BY AND

BETWEEN CHINA AND PHILIPPINES THAT:

Oil

A. Oil Zone is divided into 2 equally

B. Equally agree to replace the ZEE to (diameter) of the previous 2 ZEE.

C. The two countries did not create a continental basis for the area

D. Oil exploitation is done under the terms of exploitation

1. Capital divided by two.

2. HR divided into two.

3. Results are divided into two.

E. If there is found a source of oil, held a discussion again

VI. EFFECTIVE DATE AND SIGNATURE

This MOU shall be in effect upon the signature of Party As and Party Bs authorized officials. It
shall be in force from _____ to _____.

Parties A and B indicate agreement with this MOU by their signatures.
