I. Introduction

The National Telecommunication Commission is a dynamic and transparent


regulatory agency commits to provide the public with quality and excellent
service at all times.
The National Telecommunications Commission (NTC), is an attached agency of the
Department of Information and Communications Technology1 and was created under
Executive Order No. 546 promulgated on July 23, 1979.
President Corazon Aquino enacted Executive Order No. 546 creating a ministry of
public works and a ministry of Transportation and Communications to address the
accelerated pace of national development which requires the effective, purposeful and
unified implementation of public works projects and the effective control and supervision
of transportation and communications facilities and services.

The development, rehabilitation, improvement, construction, maintenance and repairs of


ports, flood control and drainage systems, buildings, water supply systems; and other
public works facilities involve the utilization of technologies and manpower different from
those required for the control and supervision of transportation and communications
facilities and services. A rational distribution of the functions of government pertaining to
public works on one hand and control and supervision of facilities and services related
to transportation and communications on the other would enhance the efficiency of
government.

In keeping with the policy of government to effect continuing reforms in the


organizational structure to enhance efficiency and effectiveness, it is necessary to
entrust in one ministry all functions pertaining to the construction, repair and
maintenance of public works facilities and restructure the organization for the control
and supervision of transportation and communications facilities and services in the
country.
Primarily, the NTC is the sole body that exercises jurisdiction over the supervision,
adjudication and control over all telecommunications services throughout the country.

2016: Benigno S. Aquino III signed Republic Act No. 10844 creating the D
epartment of Information and Communications
Technology (DICT) and making the NTC an attached agency of the newly created executive department.

1927 Act No. 3396 known as the Ship Radio Station Law was enacted. The Radio
Construction and Maintenance Section, the first radio regulatory office was charged to
enforce the said law.

1931 Act No. 3846 known as the Radio Control Law was enacted. The Radio Control
Division in the Bureau of Post was created under the jurisdiction of the then Secretary of
Commerce and Communications.

1939 The Radio Control Division was transferred to the Department of National Defense
which was organized pursuant to Executive Order No. 230.

1947 The Radio Control Division was again transferred to the Department of Commerce
and Industry which was created pursuant to Executive Order No. 230.

1951 Republic Act 1476 was enacted abolishing the Radio Control Board.

1962 Department Order 51 was issued changing the name of the Radio Control Division
to the Radio Control Office.

1972 The Board of Communications (BOC) was created under the Integrated
Reorganization Law. It was the first quasi-judicial body with adjudicatory powers on
matters involving telecommunications services.

1974 The Radio Control Office was renamed the Telecommunications Control Bureau.

1979 By virtue of Executive Order 546, the TCB and the BOC were integrated into a
single entity now known as the National Telecommunications Commission. The Ministry
of Transportation and Communications, which was created under the same Order has
administrative jurisdiction over the NTC.

IIII. Purpose

It is created to be the sole body that exercises jurisdiction over the supervision,
adjudication and control over all telecommunications services throughout the country.
For the effective enforcement of this responsibility, it adopts and promulgates such
guidelines, rules, and regulations relative to the establishment operation and
maintenance of various telecommunications facilities and services nationwide.

IV. Mandate

To regulate the installation, operation and maintenance of radio stations both for private
and public use. (Radio Control Law, Act No. 3846, as amended). To regulate and
supervise the provision of public telecommunications services (Radio Control Law, Act
No. 3846, as amended and Public Telecommunications Policy Act of 1995, RA No.
7925). To manage the radio spectrum (Radio Control Law, Act No. 3846, as amended
and Public Telecommunications Policy Act of 1995, RA No. 7925). And to regulate and
supervise radio and television broadcast stations, cable television (CATV) and pay
television (EO No. 546 and EO No. 205)

V. Activities

It is responsible to regulate to bring Filipinos reliable structure, accessible technologies,


affordable communications.

VI. Powers2

The core functions3 of NTC is in accordance with its enabling legislations mandating it to
be primarily responsible for the regulation, supervision and control over all
communications, telecommunications and broadcast, including cable television (CATV)
facilities and services in the country equipped with both regulatory and quasi-judicial
powers :

1) Rule-Making
2) Quasi-Judicial
3) Radio spectrum (frequency) management
4) Consumer welfare and protection
5) Commitments to regional and international bodies/organization to which
the Philippines is a party.

1. Rule-Making power to establish and prescribe rules and regulations, standards,


specifications in all cases related to the issuance of Certificate of Public Convenience
and administer and enforce the same; and promulgate such rules and regulations, as
public safety and interest may require, to encourage a larger and more effective use of
communications, radio and television broadcasting facilities, and to maintain effective

competition among private entities in these activities whenever the Commission finds it
reasonably feasible.

2. Quasi-Judicial the quasi-judicial or adjudicatory function of the NTC pertains to its


power to investigate facts or ascertain the existence of facts, hold hearings, weigh
evidence, and draw conclusions from them as bases for their official functions; allows
NTC to conduct formal hearings and technical and financial evaluations on applications
for Certificate of Public Convenience and Necessity for the operation of public
telecommunications and broadcast services and facilities and on petitions for authority
to charge rates, increase capitalizations, investments and other related matters.

3. Radio spectrum (frequency) management consists of the following processes and


procedures:

a) Radio spectrum planning pertains to the development of radio spectrum


allocation policies, plans, and regulations relating to the use of the radio
spectrum.

b) Radio frequency/channel assignment pertains to the frequency assignment


process for radio communications systems in accordance with the national
frequency allocation plan.

c) Licensing pertains to the process of conferring the legal authority to operate


a radio station under specific conditions:
issuance of Certificate of Public Convenience (CPC) for the operation of
communication utilities and services, radio communication systems, wire
or wireless telephone or telegraph systems, radio and television
broadcasting systems and other similar public utilities.4
grant permits for the use of radio frequencies for wireless telephone or
telegraph systems, radio and television broadcasting systems.5
undertake the examination and licensing of radio operators.6

d) Radio and Communications Equipment Standards and Certification

e) Radio Enforcement (monitoring, inspection and investigation)

management process. Authorized use of spectrum does not ensure that it
is being used as intended.
inspection and investigation functions are primarily being performed by the
ROs through inspection and field investigation, scanning of the entire radio
frequency spectrum with the use of sophisticated radio monitoring and
electronic equipment and analyzes and evaluates the various signals
monitored, measures frequencies of radio stations to determine whether
or not they are within the tolerance prescribed under domestic and
international laws and regulations.

f) International Cooperation The Philippines is a signatory to various treaties


and international conventions, and a party to various international organizations,
such as International Telecommunications Union (ITU), International Maritime
Organization (IMO), World Radio Conference (WRC), ASEAN Telecom
Regulators Council (ATRC), and Asia Pacific Telecommunity (APT). The NTC
safeguards national interests in multilateral and bilateral negotiations where radio
spectrum is discussed.

g) National Cooperation NTC coordinates with, and consults the radio users
composed of the businesses, communications industries, government users and
the general public

4. Consumer Welfare and Protection NTC promotes consumer welfare by


facilitating access to services geared toward the needs of individual and business users,
and protect them against abusive market behavior of dominant players through
investigation of complaints and exacting compliance with service standards.
