Judicial Affidavit

I, Rod Duterte, of legal age, married and a resident of Guingona St. Nowhere Subdivision, Butuan
City, complainant in this case, after having been duly sworn to in accordance with the law, fully conscious
that I am answering the questions under oath, and that I may face criminal liability for false testimony and
perjury. The judicial affidavit was conducted at the Law Office of Amaal Clooney, located at George St,
Butuan City, which taking was done in English which I clearly speak and understand, hereby deposed and
states as follows:

Questions and Answer

The affidavit of Rod Duterte is being offered to prove the allegation of the presence of treachery, evident
premeditation in the crime of murder.

Question 1. Please state your name and circumstances for record purposes.
Answer 1. I am Rod Duterte, of legal, married and a resident of Guingona St. Nowhere Subdivision, Butuan
City.

Question 2. Do you know He Jinping?

Answer 2. Yes ma'am, He is my friend and neighbor.
Question 3. What had transpired on July 30, 2017?
Answer 3. In the morning of July 30, 2017 I went to the house of He to make a request again from him not
to park his car anymore in front of my house as he is encroaching my property.

Question 4. What did you do?

Answer 4. Since he has done this so many times if he will still park his car in front of my house again I will
bring the matter to the barangay. He got mad after that and I heard him say I will regret it.

Question 5. What transpired next?

Answer 5. Around 10 o'clock in the evening I heard my son who is 17 years old shouted for help. Hereto
attached is his NSO birth certificate marked as Exhibit "A".

Question 6. After hearing your son shouted for help, what did you do?
Answer 6. I run outside and saw my son bathed with blood with a gunshot wounds on his back. I brought
him immediately to the hospital, but the doctor announced him dead on arrival.

Question 7. How did you know that it was He Jinping who shot your son?
Answer 7. My neighbor Kim Joong saw what had transpired and he also executed an affidavit, attached
hereto as Exhibit "B".

Question 8. I am attaching Exhibits "A" and "B" to your judicial affidavits part of it. Do you confirm my
action?
Answer 8. Yes, ma'am.

Question 9. Do you have anything else to add?

Answer 9. Yes, maam, I want justice to what happened to my son and I want He Jinping to pay for what
he did.
