MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT is entered into this ________ day of

_______________________ 2016 at Iligan City, Philippines, by and between:

The MSU-ILIGAN INSTITUTE OF TECHNOLOGY (MSU-IIT), a state educational

institution created under R.A. 5363 as an autonomous external unit of the Mindanao State
University, duly organized and existing under the laws of the Philippines with principal office at
Bonifacio Avenue, Tibanga, Iligan City, Philippines, herein represented by its Chancellor, DR.
SUKARNO D. TANGGOL, duly authorized by Board of Regents, hereinafter referred as the
FIRST PARTY

And

DEPARTMENT OF LABOR AND EMPLOYMENT, a private agency existing under

the laws of the Republic of the Philippines, with office address at Cor. Dacudao Avenue and
Lakandula Street, Davao City, in this instance by ATTY. JOFREY SUYAO herein referred to
as SECOND PARTY.

WITNESSETH: That

WHEREAS, the FIRST PARTY is a premier public educational institution of Mindanao

and a primary governmental instrumentality in providing affordable yet excellent relevant
educational services to the community;

WHEREAS, the SECOND PARTY is a private agency tasked to promote and strengthen
Community and Industrial development.

WHEREAS, the FIRST PARTY through the Department of Psychology, represented by

its Chair, Prof. Priscila B. Cada, and the Over-all Chair of Extension Services in the Department
of Psychology launches the OJT at the facility of the SECOND PARTY or at the facility of the
Internship as part of the program which in turn shall also uplift the educational learning
experience of the students.

WHEREAS, the SECOND PARTY accepts linkages with the FIRST PARTY, a trusted
institution that can provide the necessary expertise to render optimum educational assistance to
the agency.

NOW, THEREFORE, for and in consideration of the foregoing premises, the Parties
have agreed to initiate the linkages between the FIRST PARTY and the SECOND PARTY in
order to meet a major requirement of the students and likewise, have agreed as follows:
 SECTION 1
RIGHTS AND OBLIGATION OF THE FIRST PARTY

1. The FIRST PARTY shall:

a. Allow the BS Psychology students enrolled in Psych 197 (Practicum), under the supervision
of the Department of Psychology to gain industrial experience within the areas specified by
the SECOND PARTY which shall be deemed part and credited as internship of the FIRST
PARTY to the academe through the DEPARTMENT OF PSYCHOLOGY;

b. Ensure that the ongoing work/internship experience in dealing with involved persons shall be
done with extreme care and confidentiality;

c. Provide pertinent records related to the learning experience and shall not be used for other
purposes or by other students/parties not involved in this project;

2. The FIRST PARTY has the right to cancel this AGREEMENT when justifiable grounds
exist.

SECTION II
RIGHTS AND OBLIGATION OF THE SECOND PARTY

1. The SECOND PARTY shall:

a. Allow the BS Psychology students enrolled in Psych 197 (Practicum) to interact and
receive service from DEPARTMENT OF LABOR AND EMPLOYMENT, until the
over-all objectives of this activity shall be fully accomplished;

b. Undertake the responsibility of maintaining confidentiality of all records related to this

project for safety of the BS Psychology students and Office of DEPARTMENT OF
LABOR AND EMPLOYMENT, through the Psychology Department Chairperson.

c. Shall comply with the minimum requirements in the industrial sector, namely the
following:
a) Workplace Facilitation;
b) Training Assistantships and the like;
c) Other tasks as required by the department in your company where they are
assigned.

2. The SECOND PARTY has the right to cancel the AGREEMENT when justifiable grounds
exist.

SECTION III
DURATION OF THE PROJECT AND TERMINATION

Under this Memorandum of Agreement the following terms and conditions are hereby clearly
understood and agreed upon:

1. This Agreement shall take effect upon signing by both parties and shall continue to be valid
and binding for ONE (1) SEMESTER without prejudice of being renewed, PROVIDED, that
an evaluation after a semester of its implementation shall be undertaken prior to its renewal
or cancellation depending on the results of the evaluation.
2. Either party may terminate this Agreement by giving a written notice THIRTY (30) DAYS
before the effective date of termination.
3. Failure of one party to comply with any of the provisions shall entitle the other party to
terminate this Agreement.
4. This Agreement represents the complete understanding of the parties and is intended to
supersede all previous agreements, written or verbal. This shall not be altered, amended or
modified except through a written agreement signed by both parties.
5. The terms and conditions of this agreement are fully understood and express the intentions of
both parties in good faith.
6. This MOA shall apply to the Internship students in the 2nd semester of SY 2015-2016.
