Re: DEP WASTE CLEANUP FACILITY SITE ID COM_288039 (HOME-A-RAMA)

Dear City of Fort Myers

We represent Noemy Rodriguez and Aurelio Rodriguez, 3313 Jeffcott St, Fort Myers Florida 33916 with regard to waste
and sludge dumped and disposed on real properties located between, in and around Jeffcott St, Henderson Ave, South St,
and Midway Avenue DEP waste cleanup facility site ID COM_288039 (HOME-A-RAMA).

We respectfully request the ability to provide these comments on the site assessment work plan before it is approved and
the ability to attend the site assessment and split samples of soils and groundwater sampling and the right to take
additional sampling and analysis as follows:

1. Representatives (legal counsel/environmental consultants) for neighboring property owners should be allowed to
be delivered notice in advance, at least seventy-two (72) hours prior to assessment field activities of detail of work
to be performed
2. The professional geologist and environmental consultants for owners of neighboring properties, including Isidro
Duque P.G., AirQuest Environmental (cc below) should be allowed to attend, observe, and monitor performance
of work and owners environmental consultants should be allowed to split soil and groundwater samples to be
provided by consultant performing the assessment
3. Regarding the assessment, at least some of the off-site wells should be located down gradient and based on
groundwater elevation data of existing wells (site-specific) and not necessarily from existing available
information
4. Groundwater samples should also be collected from existing irrigation and/or private wells in the neighborhood
even if these are no longer used by residents, and not only from wells that may be used for potable purposes as
stated in the revised plan.
5. A private survey for these wells (1/2 mile radius) should be done by consultant prior to assessment of field
activities and this survey data should be considered for further groundwater assessment.
6. If the Lee County Department of Health will be collecting samples from any private wells that could be
potentially used for drinking water or irrigation, this data should be made available to the interested parties and
stakeholders, and that Laboratory Analysis should include all parameters and chemicals of concern in potable
drinking water, not just arsenic.

Respectfully submitted,
Ralf Brookes Attorney
