ANACTAMENDINGSECTION12OFREPUBLICACTNO.7279,OTHERWISEKNOWNASTHEURBAN
DEVELOPMENTANDHOUSINGACTOF1992,ANDFOROTHERPURPOSES

BeitenactedbytheSenateandHouseofRepresentativesofthePhilippinesinCongressassembled:

SECTION1.Section12ofRepublicActNo.7279,otherwiseknownasthe"UrbanDevelopmentandHousingAct
of1992,"isherebyamendedtoreadasfollows:

"SEC. 12. Disposition of Lands for Socialized Housing. The National Housing Authority, with respect to
landsbelongingtotheNationalGovernment,andthelocalgovernmentunitswithrespecttotheotherlands
within their respective localities, shall coordinate with each other to formulate and make available various
alternativeschemesforthedispositionoflandstothebeneficiariesoftheProgram.Theseschemesshall
notbelimitedtothoseinvolvingtransferofownershipinfeesimplebutshallincludelease,withoptionto
purchase, usufruct or such other variations as the local government units or National Housing Authority
maydeemmostexpedientincarryingoutthepurposesofthisAct."

"Consistentwiththisprovision,aschemeforpublicrentalhousingmaybeadopted.

"Dispositionoflands,includinganyimprovementsthereon,ownedbytheNationalGovernmentoranyofits
agencies or instrumentalities and/or the local government units through direct negotiated sale to the
occupantsthereofwithoutneedofpublicbiddingshallbeallowedsubjecttothefollowingconditions:

"a)Thelandsarewithinaresidentialzoneasclassifiedbythelocalgovernmentunitconcerned

"b) The lands are certified to be for socialized housing purpose by the Housing and Urban
DevelopmentCoordinatingCouncil

"c) The occupants are qualified beneficiaries in accordance with Section 16 and are registered as
suchinaccordancewithSection17ofthisAct

"d)Thecostofsaidlandsshallbemadeaffordabletothebeneficiaries,takingintoconsiderationtheir
incomeandlandvaluationrequiredinSection13ofthisAct

"e)AnysubsequentdispositionofthesaidlandshallbesubjecttothelimitationsprovidedinSection
14ofthisActand

"f)TheoccupantshaveresidedonthesaidlandssubjecttotheprohibitionsprovidedinSection30of
thisAct."

SEC.2.SeparabilityClause.IfanypartorprovisionofthisActshallbeheldunconstitutionalorinvalid,other
provisionhereofthatarenotaffectedtherebyshallcontinuetobeinfullforceandeffect.

SEC.3.RepealingClause.Alllaws,presidentialdecrees,executiveorders,rules,regulations,orpartsthereof
whicharenotconsistentwiththisAct,areherebyrepealed,amendedormodifiedaccordingly.

SEC.4.Effectivity.ThisActshalltakeeffectfifteen(15)daysafteritspublicationinatleasttwonewspapersof
generalcirculation.

SenateandtheHouseofRepresentativesonJanuary30,2007andJanuary29,2007,respectively.
