Dear Sally:
Title and Duties Smith will have the title [Position] and shall be employed on a full-
time basis primarily responsible for those duties customarily performed by the [Position],
managing the artistic and administrative affairs of a non-profit theatre, including but not
limited to the planning for and direction of xxxxx's programming, administration,
operations, financial management, fundraising, staffing, marketing and consensus
organizing, education programs, public outreach and general supervisory
responsibilities. Smith, in conjunction with appropriate staff, will develop the annual
budget and oversee its implementation, and be actively involved in such other initiatives
as may be assigned from time to time by the Board of Trustees of xxxxx.
Guided by xxxxxs mission and values, Smith shall work in close collaboration with the
Board of Trustees to provide ongoing executive leadership for xxxxx.
Reporting - Smith shall be responsible to the Board of Trustees of xxxxx. She will
directly report to the President of the Board of Trustees and/or such members of the
board as the President may designate. The President in conjunction with the [Position]
and no less than two additional members of the boards Executive Committee shall
develop an annual set of performance objectives to which the parties shall agree. The
President and such additional members of the Boards Executive Committee as the
President may assign, shall conduct Smiths annual performance review based upon
these objectives and support Smiths ongoing efforts to further her professional
development as xxxxx's [Position].
Vacation Smith will earn vacation time from the day she begins work, but must
work at least 90 days before any vacation may be taken. Vacation days must be
earned before they are taken, unless other arrangements are made with the Board of
Directors. Smith will accrue 10 vacation days in the first year (between the date of
hire and the first anniversary). In each year after this, she will gain 2 vacation days
per year to a maximum of 15 days.
Paid Holidays Smith will be entitled to 10 paid holidays and two floating holidays
per year. The specific determination of such paid holidays is made by xxxxx prior to
the commencement of each fiscal year in which they occur.
Personal/Sick Leave Smith shall be entitled to ten personal/sick days per year.
Medical Leave Smith will earn paid medical days at a rate of one for every one
month worked, not to exceed 12 working days per year. Employees may accrue a
maximum of 24 days of medical leave at any one time, by carrying their accrued
allowance forward from year to year until the maximum is reached.
Family Leave - Smith may take up to six weeks paid leave within any consecutive
12-month period in the event of the birth or adoption of a child by the employee or
the employees spouse or domestic partner. This leave need not be taken in six
consecutive weeks. Sick leave or vacation time may be used to extend family leave.
Full-time employees working less than 40 hours per week will accrue family leave in
direct proportion to their work schedule.
Personal days - Smith may take 3 personal days of paid leave during the year. A
personal day may be used for personal business, weather conditions, household
matters, or extending a vacation. Personal days not used by the employees
anniversary date each year are forfeited. Full-time employees working less than 40
hours per week will accrue personal days in direct proportion to their work schedule.
Outside Business Activities Smith shall devote her full professional time, energy,
and ability exclusively to the operations and interests of xxxxx, and shall not, without the
xxxxx's Presidents prior written consent, (a) render to others services of any kind for
compensation, (b) engage in any other business activity that would materially interfere
with the performance of her duties as defined herein, or (c) promote, organize,
participate or engage in any activity or other organization competitive with xxxxx
operations, whether as partner, employee, creditor, shareholder, officer, director,
consultant, volunteer or otherwise. Smith represents to xxxxx that she presently has no
outstanding commitments inconsistent with the terms of this agreement or the services
to be rendered under it.
At Will Employment Smith shall be an at will employee of xxxxx, which means the
employment relationship can be terminated by either xxxxx or Smith for any reason, at
any time, with or without prior notice and with or without cause.
Live Scan Background Check Smith shall undergo a Live Scan background check
within fourteen (14) days of Smith's hire as a condition of employment.
If this letter accurately represents your understanding of our agreement as to the terms
and conditions of your employment as xxxxxs [Position], please sign the enclosed copy
in the space indicated below and return it to me at your earliest convenience.
