AFFIDAVIT OF WITNESS

I, MANUELITO E. MARIANO, legal age, Filipino citizen and a

resident of Miluao, Patalon, Zamboanga City, Philippines, after having
been duly sworn to in accordance with law hereby depose and say
that:

1. I personally know RYAN ENRIQUEZ SIASON (RYAN for

brevity) who is the Respondent in NPS Docket No. IX-06-INQ-
17E-00556 for alleged Violation of Section 5 of Article II of
Republic Act No. 9165 otherwise known as the Comprehensive
Dangerous Drugs Act of 2002 pending before the Office of the
City Prosecutor of Zamboanga City considering that he is my
neighbor.

2. On 13 May 2017, on or about 10:00 oclock in the evening,

while I decided to leave Barangay Ayala, I saw RYAN who was
on board on his motorcycle. Thereafter, I approached him
purposely to ask him if he could bring me towards Barangay
Patalon. RYAN immediately told me to board on his motorcycle
as he also decided to return home.

3. On or about 10:30 oclock in the evening of the same date,

while on our way to Patalon, this city, on board on his
motorcycle and when we reached therein along Sampaloc
Drive, an unidentified person in civilian attire suddenly crossed
the road and signaled us to stop. Thereafter, on the assumption
that said person is a prospective passenger, RYAN stopped but
we stayed on board the motorcycle. Thereafter, said
unidentified person approached RYAN followed by three (3)
unidentified persons in civilian attire and asked us to alight from
the motorcycle. Thereafter, they introduced themselves as
Police Officers and they immediately proceeded to frisk RYAN
and asked me to alight and stay at the side of the road.
However, after they had frisked RYAN, they found nothing
under his possession. Thereafter, to my surprise the
unidentified persons who later known to be Police Officers,
immediately placed RYAN under restraint and proceeded to
place him handcuffs. Thereafter, the Police Officers brought
RYAN to Labuan Police Station and they also seized his
motorcycle. Thereafter, I immediately reported the incident to
RYANs relatives and thereafter, I went home.

4. I execute this Affidavit to attest to the truth of the foregoing facts

based on personal knowledge and authentic records in support
of the Counter Affidavit of Respondent RYAN ENRIQUEZ
SIASON. It is thus requested that the instant case docketed as
NPS Docket No. IX-06-INQ-17E-00556 be dismissed for utter
lack of merit.
