WHEREAS i~ is expedient to establish and incorporare a Univesi~ya1


Midnapre in the Stare or West Bengal after h e name or Pandit Iswar
Chandra Vidynsagar for encouraging and providing for inslrucrion,
teaching, training and research in various branches of learning and
courses of sludy, promoting advancement and disseminalion of knowIedge
and Icming, and cxrending higher ducalion, and for rneeling h e growing
needs of society;
I1 is hcrcby enacred in [he Thirly-second Ycar of lIle Republic or
India, by h e Legislalure of West Bengal. as ral1ows:-

jecls, namely, Law, Mcdicinc, Engineering, Teachers'
Training, Technology. Agriculture, lournalism, Management
Sludies or such o~hcrsubjccr as may be prescribed by
Regulalions;
(18) "S~illules"."Ordinances", "Regulalions" and "Rulcs" mcan,
respcclivcly, the Stalules, Ordinances, Regula~ionsand Rules
o r [he Universily madc under his Act;
(19) "Sludcnls' Union", i t ) relalion to the Universily or an
affilinred college, means Sludents' unibn consliw~cdin [he
manncr prcscribcd;
(20) "Teacher" means a Professor, Associare Professor, Assislanl
Professor, Rcadcr, Principal, Lccturcr, Demonsrralor,
lnstruclor or atiy other person holding ;I ~cauhing posl

The University and'ifsofKccrs

Thc 3. (1) The firs1 ChancelIor and the firs1 Vice-Chancellor of the
U"iYCfiiLym Universjty and h e ljrsr members orthe Court and Ihe Executive Council,
and all persons who may h e r e a h hecnme the Chancellor or the Vice-
Chancellor of the Univcrsily or the members of the Court or the
Executive Council so long as they continue to Iwld such ofiice or
membership shalI consriiule a body corporalc by the name of Lhe
Vidyasagar University.
(2) The University shall have perpelual succession and a
common seal and shall sue and bc sucd in [he name of [he Vidyasitgar
University .

Powen of 4. The University shall have the following powers, namely:-

undertake research in tribal prublems, rural developrnenl
and marine biology;
(3) to organise specialised dipIorna, degree or post-graduate
courses, as the casc may be, in sirch subjects as Tribal
languages, habitat and customs,rural adrninisualion, couwl
salinity. foreslry, floricul rure, pesticides, wild life
management, pisciculture, rnarine fishery and also in subjeers
like rural and urban planning, manpower planning, regional
resources planning and developrnenl, ecology and
environmenlal sludies, agricullunl and rural indusries and
marine resource devel opmeni;
(4) to organise shor! courses at rhe posr-Master of Arrs or post-
Masterof Science singe for those who are olherwijt: suilabIe
[or teaching the non-traditional courses mentioned in
clause (3);
( 5 ) to make such academic slidies as may contribu~em the
improvemenl or economic conditions and welfarc of the
peopIe in general and [he lrihal people in particulnr;
(6) to eslabljsh, mainlain or manage colleges. libraries, labora-
tories, muscums and such urher insuturions as imay consider

recognilion in respect of any such college or inslilutton;
(8) to dcvelop colleges impaning Honours courses under the
direct supervision of the Universi~ywith the ul~imateobjcc~
of developing such colleges as exclusive Honours colleges,
i-e.,collcgcs admiuing Honours sluden ts only and providing
only pass reaching for the subsidiary subjecls of Honaurs
sludenls:
Provided [ha1 rhe provisions of this clause shall no1
debar other collcgcs from introducing both Honaurs and
Pass courses;
(9) to affiliate to ilself any college, inslilution or cenire and to
withdraw nffiljauon of such college, institution or centre;
( I 0) to insli rule degrees, lirles, diplomas, cerlificales and orher
academic djs~inclions;
( 1 1) to hold examinalions and to conrcr dcgrecs, biles. diplomas,
certifica~cs and olhcr academic disljnciions on persons

(a) shall, unless exempled therefrom in such manner as
may be prescribed by S~atutes,havc pursued in an
affiliated or constiruenl college or in the Universily or
it1 an instirution ar centre recognizcd by [he University

(2) The Chancellor shall exercisc such powcrs as may be conferred

(3) Where power is conferred upon the Chancellor lo make
nominations to any aulhority or body o f the University, h e Chancellor
shall, to Ihc extent necessary, nominate pcrsons to represenr inleresls not
oIherwisc adequa~elyrepresented.
(4) Every proposal to confer any honorary degree shall be subjccr
lo confirmalion by the Chancellor.

9. '(1) The Vice-Chancellor shall be appo~ntedby [he Chancellor T h e Vice-

in consullation with the Minister from a panel of rhree persons
recommended by a commirlee consisting of three members nominated
by Ihe Court.
(2) (a) The Vice-Chancellor shall hold officc Tor a lerm of four
years or till he auains the age of 65 years, whichever is earlier, and shall,
subjecr to the provisions of this section, be eligible for re-appointment
Tor anolher term of four years or till hc attains he age of 65 years,
whichever is earlier.
(b) The Chancellor may,norwithstanding the expiration of the term
of[he office or the Vice-Chancellor or his altaining the agc of 65 years,
allow him to continue in office bll a successor assumes office, provided
that he shall not continue as such for any period exceeding six monrhs.
(3) The Vice-Chancellor shall be a whole-time officer or t h e
University and shaIl be paid from the University Fund such salary and
allowances as the ChanceIlor may decide in consultation with the Slate
Government.
(4) The Vice-Chancellor may resign his office by writing under his
hand addressed to Ihe Chancellor.

[hen, during the period of such temporary inabili~yor pending the
appointment of a Vice-Chancellor, as the case may be, the Chancellor
may, in consultation with hc Minislcr, appoint any person to exercise
[he powers and perform he duties of thc Vice-Chancellor.

this purpose.
(4) The Vice-Chancellor shall have Lhe power l o exercise gcneral
conlrol and superv~sionover a11 otllcr officers uf ~ h Universily

all Teachers and en~pIoyeesof the Universily and generally over a l rhe
affairs of the UtliversiLy.
( 5 ) The Vice-Chancellor shall exercise such other powers and
discharge such #\her duties as may be hltgared \ohim by any autJtority

the heads or departments of leaching, Profcssors, Readcrs, Lecrurers, and
Teachers of [he Universi~y,if any, immedinlely before [he date of
appointment of the first Vicc-Chilncellor.
(10) The provisions of this seclion shalt have effect norwith-
slanding anything to rhc conrmry conlnined elsewhere in this Act or in

(11) Any vacancy in the Council occurring by reason of death,
resignation or otherwise shall be hlled up by the Chancellor in consulta-
lion with the Minister and the Vice-Chancellor, in so far as such filling
up is noi inconsislent wilh he provisions of rhis section.
(12) If, by reason of the olher provisions or this Act, any difrjculiy

ordcr or do such thing, not inconsisrent with the provisions of this
section, as appears lo i t to be necessary or expedient for removing the

59. IF on account of any lacuna or omission in h e provisions of this Removal o f


Act, or for any other reasan whatsoever, any djfiicully arises as lo Ihe di"cu1tiC5-

firs( constitution of any authori~yof h e University under chis Act, or


otherwise in giving effecl lo [he provisions of h i s Act, Ihe State
Govcmment, as occasion may require, may by order do anything
which appears to it to be necessary for [he purpose of removing the
dilliculty notwithstanding anything to the con1rx-y conlained elsewhere
in lhis Act or in any other law.
