ORDINANCE NO.

AN ORDINANCE REQUIRING THE REGISTRATION OF DOGS AND CATS, PROVIDING FOR THE
IMPOUNDING DISPOSITION OF STRAY DOGS AND CATS, AND TO ASSUME COST OF MEDICAL AND/OR
BURIAL EXPENSES INCURRED BY VICTIMS OF DOG AND CAT BITES, AND IMPOSING PENALTIES
THEREOF, AND ESTABLISHING A BARANGAY POUND AND PROVIDING FUNDS THEREOF

WHEREAS, stray dogs and cats serve as carriers and transmitters of rabies and other bacterial
diseases;

WHEREAS, the continuing implementation of mass vaccination against rabies by the City
Veterinarys Office does not ensure full eradication of the disease;

WHEREAS, eradication of rabies can be achieved through the adoption of a more systematic
approach which should involve not only the personnel from the City Veterinarys Office, City Health
Office and the Office of the City Agriculturist but also the Barangay Officials, Peoples Organizations and
Non-Government Organizations.

NOW THEREFORE,

BE IT ORDAINED, by the Sangguniang Pambarangay of Bitano in session assembled, that:

SECTION 1. REGISTRATION OF DOGS AND CATS AND RESPONSIBLE PET OWNERSHIP


ORDINANCE. Owners of dogs and cats, at least three (3) months old, are hereby required to register
them in the Barangay office or in their respective Barangay Health Worker where they reside.

SECTION 2. IMPOUNDING FEES AND OTHER FEES

a. Impounding fees A charge of 100.00 pesos plus additional 15.00 pesos daily shall be
impose to owners of impounded dogs and cats.
b. Vaccination fees All impounded dogs and cats from three (3) months old shall be
vaccinated against rabies prior to the registration of the animals.
SECTION 3. DEFINITION OF TERMS

a. Owner refer to the person keeping, harboring, having charge or control of, or permitting
any dog or cat to habitually be or remain or lodged or fed within such persons house, yard
or premises.
b. Stray animals refer to dogs and cats that are loose, unrestrained, unconfined or not under
complete control of their owners. Stray dogs and cats shall include those outside of the
fenced compound or house of the owner, of the unfenced compound, outside of dog house
and found unleashed and uncaged within the territorial limits of the barangay including
those dogs and cats owned by the residents of other barangays.
c. Animal catcher the person designated or appointed by the barangay chairman to perform
or do the actual catching of animals or other functions relatedto.
d. Barangay animal pound refer to the facility where stray animals are temporary confined or
restrained.

SECTION 4. PROCEDURE FOR CATCHING AND IMPOUNDING

a. A team headed by the Kagawad on Health shall be responsible for monitoring and catching
stray dogs and cats in coordination with the Barangay Tanods and/or Barangay Health
Workers and Zone Presidents.
b. Stray dogs and cats caught shall be brought to the Barangay animal pound.
c. The Kagawad on Health together with the City Veterinarian shall be in-charge of assessing
the health of the dogs and cats, including documentation and registration.
d. The Barangay Officials and selected Personnel on duty shall be in-charge of the feeding,
maintenance of cleanliness of the pound, vaccination, rehabilitation and treatment of
animals. The Barangay Secretary take charge of the public auction and donation of animals.
He/ She shall upon receipt of the animals into the Pound will post the list and description of
the dogs and cats that are caught and isolated in the Barangay Pound. Posting shall be
within twenty four (24) hours after receipt of the animals has been acknowledged. Record
include the following:
1. Color, breed and other description of the impounded dog or cat.
2. The time of catching
3. The place or location where the animals were caught
4. Dog tag number

SECTION 5. DUTY OF OWNERS/POSSESSOR OF DOGS AND CATS

Owners of dogs and cats are required to control their pets within the premises of their
residence. Immediately after the effectivity of this ordinance, owners are ordered to leash or
provide appropriate confinement to their dogs and cats in order to curtail the transmission of
the disease by direct contact.
Owners of dogs and cats are also required to provide warning signs by posting these signs at the
gate, fence, front door or a place that is visible in order to inform people or would be visitors
of the presence of these animals in the premises that they are about to enter.

SECTION 6. MEDICAL AND/ BURIAL ASSISTANCE TO VICTIMS Should a dog or cat,


vaccinated against rabies bite, a person or group of persons, from within or from without the
confines of the property of the said owner/ possessor, the latter shall be responsible for the
medical expenses including but not limited to hospitalization bill or the cost of the human anti-
rabies vaccine, plus the burial cost of the victim in an unlikely event of death caused by a dog or
cat bite as certified by a government physician.

SECTION 7. STRAY ANIMAL CONTROL

a. Stray dogs and cats, as defined in section 3 of this Ordinance shall be prohibited within the
Barangay Bitano.
b. Stray dogs and cats shall be impounded for at least seventy two (72) hours to give enough
time for the owners to reclaim their animals.
c. Stray animals with curable diseases can be released to the owners only if the owners subject
their animals to extensive treatment. A memorandum of agreement shall be signed with the
owner to the safety and health precautions and standards that will be determined by the
City Veterinarys Office.
d. An extensive information dissemination campaign shall be conducted by the Barangay
Officials emphasizing responsible dog and cat ownership and the risk of rabies infection.

SECTION 8. FUNDING - The Barangay Council shall appropriate annually based on a budget
presented by the Kagawad on Health the necessary funding requirement which is deemed
necessary for the continued implementation of the provisions of this Ordinance.

SECTION 9. PENALTY Any person violating this Ordinance shall in addition to the
provisions of section 4, be punished by a fine of not less than 1,000.00 ( one thousand pesos)
nor more than 1,000.00 ( one thousand pesos ) or by imprisonment of not less than 15 days nor
more than 30 days at the discretion of the court.

SECTION 10. SEPARABILITY CLAUSE If for any reason, any section or provision of this
Ordinance is declared to be unconstitutional or invalid, the other provisions hereof not so
affected shall continue in full force and effect.

SECTION 11. REPEALING CLAUSE All Ordinances and Resolutions or issuances in the
Barangay in conflict herewith are deemed repealed and modified accordingly.

SECTION 12. EFFECTIVITY This Ordinance shall take effect upon approval of the Barangay
Council.
