REGULATION ORDINANCE NO. 2006-050

AN ORDINANCE AMENDING FURTHER ORDINANCE 291,
SERIES OF 1982 "AN ORDINANCE REGULATING THE
DIGGING AND EXCAVATION OF ANY EXISTING
NATIONAL, CITY AND BARANGAY ROADS WITHIN THE
CITY OF ILOILO", AS AMENDED

Councilors Ely A. Estante, Jr. and Erlinda G. Liberiaga,

~~'Sub Par viii of Par 5 of Section 458 of Republic Act No. 7160,
otherwise knoWJ as the Local Government Code of the Philippines as amended, states the
power of the ~ sanggunian to regulate the drilling and excavation of the ground for
the laying of water, gas, sewer, and other pipes and the construction, repair and
maintenance of public drains, sewers, cesspools, tunnels and similar structures;

WHEREAS, this drilling and excavation of the roads in the City of Iloilo causes
obstruction and danger to the motorist and pedestrians alike;

WHEREAS, Ordinance 291, Series of 1982, otherwise known as "An Ordinance

Regulating the Digging and Excavation of any Existing National, City and Barangay
Roads within the City of Iloilo" was approved on September 30, 1982;

WHEREAS, Ordinance 208, Series of 1983 and Ordinance 230, Series of 1986
amended some of the provisions of the said Ordinance;

WHEREAS, the restoration fee for the damage caused by the excavation and
digging of roads is still the same for the past 20 years;

WHEREAS, those restoration fees 20 years ago is no longer applicable in todafs

prices of materials and labor cost;

WHEREAS, most of the excavated roads where left unrestored to its original
form due to the low restoration fee but higher reconstruction costs;

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City

of Iloilo that:

Section 1. - Schedule of Payment for Restoration of Ordinance 291, Series of

1982, "An Ordinance Regulating the Digging and Excavation of any existing national,
city and barangay roads within the City of Iloilo, as amended by Ordinance No. 208,
Series of 1983, and Ordinance No. 230, Series of 1986, is hereby amended to read as
follows:

Section 2. - This Ordinance shall take effect ten (10) days after approval and
publication in the newspaper of general circulation in the City of Iloilo.
