REGULATION ORDINANCE NO. 2004-227

AN ORDINANCE AMENDING SECTION 63, ARTICLE XI OF
REGULATION ORDINANCE NO. 2001-072 KNOWN AS THE
ZONING ORDINANCE OF THE CITY OF ILOILO

WHEREAS, Section 63, Article XI of the Zoning Ordinance of the City oflloilo
provides, "Any person who violates any provision of this Ordinance shall, upon
conviction, be punished by a.fine of not exceeding Twenty Thousand Pesos (P20,000.00)
or an imprisonment ofnot exceeding one (1) year, or both, at the discretion of the Court.
In case of violation by corporation, partnership or association, the penalty shall be
imposed upon the erring officers thereof";

WHEREAS, the fine of not exceeding Twenty Thousand pesos (P20,000.00) is

ultra vires considering that Section 458 (iii) of the Local Government code of 1991
provides that, "Sangguniang Panlungsod has the power to impose fine of not exceeding
Five Thousand pesos (P5, 000.00) or imprisonment of one (1) year or both''.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City

of Iloilo, that:

Section 1. - Section 63, Article XI of the Zoning Ordinance of the City of Iloilo
known as Regulation Ordinance No. 2001-072 is hereby amended to read as follows:

Section 2. - This ordinance shall take effect upon approval.
