Henceforth JJND
To achieve a society that respects, protects and promotes the rights of all children in need and at risk
JJND-UNICEF organized this capacity building workshop for NGOs/CBOs on child protection
and Juvenile Justice Act as a part of the national initiative towards a child centric jurisprudence in the
country. This would facilitate creation of an NGO base who can eventually take up child protection
issues as and when a child in need is brought to their notice.
JJND-UNICEF facilitated this process of bringing together the like-minded people working in the
sector and initiate a process of getting status report on implementation of Juvenile Justice Act 2006.
This would enable both UNICEF and JJND to fulfill their mandate on ensuring that the best
interests of children are served and gaps in the information are addressed by recommending services
and structures for children falling within the ambit of Juvenile Justice Act 2006 at district level across
the country. This would also lead to formation of Juvenile Justice Jharkhand Desk.
As suggested, this program relies upon a community based approach to juvenile justice and seeks to
build capacities of communities, government functionaries at all levels that matter and other
stakeholders in juvenile justice, at every possible level, in an organized and participatory manner and
is mandated by both UNICEF and JJND.
The Scope
The JJND-UNICEF seeks to establish Juvenile Justice Communities of Practice (JJ CoP*) across all
the 24 districts of Jharkhand so as to achieve following objectives:
Training by UNICEF for capacity building in local NGOs and to support JJND in
Jharkhand
To train the participants to prepare formats for questionnaires in a participatory manner to
obtain status reports on functioning of Juvenile Justice act across the state
To do a qualitative assessment of JJ institutions and functionaries, identify the gaps in
knowledge and practice. This would enable in investigating and recording existing structures
related to the JJ Act, the existing number of Juvenile Justice functionaries/office bearers in
their respective districts and interviewing the Juvenile Justice functionaries on the provisions
on JJ act and State Rules
Awareness and Advocacy on JJ issues at community, village, block, district, and state level
and knowledge sharing between government, NGOs/CBOs, institutions and stakeholders
involved in Juvenile Justice. Start building JJ CoPs in their respective districts by their
personal involvement, community participation and organizational networking
The underlying process of achieving these objectives rests on the process of formation of JJ CoPs
across the districts in Jharkhand and also on the process pathway, where the learning of each phase

gets reinforced into the next one and thereby a sustainable mechanism is developed. This awareness
on JJ functionaries and infrastructures brought by JJ CoP would bring in substantial process learning
which will have the bearing on future similar interventions and can be used as best practices.
The process focused at three levels, where substantial knowledge generation due to process
innovation takes place;

The most common methods were Focus Group Discussions & Case Work wherein the entire
group of participants was broken into smaller groups according to the topics/issues they had
volunteered to take. The sessions were designed as per techniques involved in Participatory
Learning and Action (PLA).
• Case work for 7 groups – the groups were given cases of child in need of care and protection
and child in conflict with law. The participants as group were asked to identify what went
wrong in the cases and how the cases should proceed as per the provisions of the JJ Act and
its rules. While some groups read out the cases, others performed a skit on the case. This
enabled the other groups to debate and discuss various issues related to child protection and
the JJ Act

• 5 groups presented the gaps in implementation of JJ Act in their districts and sought
clarifications from the larger group
The participants also shared various Stories during the sessions. Some of them were short anecdotes
like making a Police Chacha to ensure that the police men were child friendly due to this association
or like inviting police officers as chief guests for organizational events. Some stories were longer like
the story by Mr. Karme Alam who stated that after the JJB ordered the child to be sent to the OH,
the accompanying home guard from the OH tied the child with rope while taking him for age
verification medical report. This was highlighted in the media and the JJB, High court, and Human
Rights organizations took exception to this treatment. He also shared a story about how an effective
JJB can eliminate the need to hire lawyers. He also shared a case where the judicial magistrate denied
bail while the 2 social workers wanted to give bail, the High Court granted that the Child in conflict
with law could be released on bail in order to safeguard his best interests.
From time to time, the groups would share stories or songs of experience and intervention. The
facilitators also encouraged participatory involvement through insightful Games.

Another pedagogical technique was employing Class Room Learning methodology through slide
presentations with interactive session with the participants and Q/A session.

The facilitators encouraged Mapping exercises with reference to their expectations from the
workshop, the categories for child in need of care and protection.

A Movie called Ek tha Bachpaan (Lost Childhood) was screened to drive home the point on proper
functioning of the JJ Institutions/Functionaries
• Dr. Tah and Dr. Moitra said that the staff and the JJ functionaries at OH were often unkind
to children and they observed marked difference in quality of services given to children on
informed visits and on surprise visits.
• Prabha Jaiswal said that the OH shown in the movie was very much like the homes in
Jharkhand
• The group agreed that the children were dumped together irrespective of their age and
background resulting in some children bullying the other
• The JJB members and the group at large agreed that the magistrate in the JJB has to be
sensitive and child friendly or else, the system would never reform as the abuse of power
would then percolate down at each level of functioning
• Mr. Yasim said that the functionaries were often unaware of the Act and the gaps in
knowledge compounded the ills meted out on children
• Mr. Qadri suggested that the children who abused and assaulted other children had to be
treated in a non judgemental manner just as we treat our young relatives
• Rajeev said that there has to be a continuous mechanism of supervising the well being of
children, there should be indicators of access to services and whom to approach for solution
of wrongs

• Work on Children’s Home, sensitizing workshops, mass awareness on situation of children
who are institutionalised
• Showing these types of movies at village level would upset, demoralise and anger the
villagers, we need something else for this kind of audience.
And finally the participants prepared List and Matrices on their commitment to the JJ CoP and
helped JJND-UNICEF and themselves to come up with a format for getting the status report on JJ
institutions/functionaries in Jharkhand.
• Format formation – the whole group was divided in 5 smaller groups for working sessions
on CWC, JJB, IC/DAB, social reintegration and SJPU. These groups discussed the questions
they would ask from the functionaries and institutional staff and how would they frame
these questions. Then the whole group including all participants discussed the formats and
questions and finally the group decided to go for a status report on JJ in Jharkhand.
• They decided to identify the gaps in knowledge and practice. For these they would focus on
the processes, people and case disposals at district and state levels
Selection Process of Co-Ordinating Agency in Jharkhand – the group asked those agencies that
are strong in documentation and research, have good networking and internet facilities and were rich
in resources to come forward so that they could vote on one agency that would do the co-ordination
of preparing Status report in Jharkhand. The group voted Srijan as such agency.

INTROSPECTIVE NARRATIVE
The process of facilitating the workshop was well managed and it was not only participatory and
inclusive but also focused and sought to achieve tangible goals by the end of the sessions.
My overall response to the entire 4 day exercise is that of optimism and hope. I was glad to become
aware about the juvenile justice national desk and the people associated with it. JJND and its state
chapters would go a long way towards entrenching the JJ institutions at district levels and towards
creating a child centric jurisprudence. UNICEF as a funding organization and also as a resources
organization has been aiding the JJND initiatives which are laudable. I hope the JJ CoPs and the
JJND together can usher in a new era of child rights in India.
