Dear Dr. Philip:

Attached you will find DOH Complaint Reference Numbers for Neil J. Gillespie that shows five
(5) complaints I made, and the responses I got from the DOH1. The DOH plays a reference
number game intended to mislead complainants, harm the public, and to protect bad doctors
like Cesar Raul Gamero, ME95007, and to protect unlicensed providers like Natasha Aguilar.

DOH Complaint Reference Numbers for Neil J. Gillespie shows:

4. Complaint April 21, 2017, Dr. Gamero for Patient Abandonment/Neglect - Incompetence
- Violated a medical standard of care; Reference Number: 2017-06821, Respondent:
Cesar Raul Gamero, M.D. [ME95007]

5. Complaint May 2, 2017 against Dr. Gamero for failure to release patient records.
Included in this complaint was a request to examine the records prior to getting the
records. F.S. 395.3025(1). The DOH has not provided a complaint reference number,
that I am aware. On May 11, 2017 I demanded to examine my original patient records.
On June 3, 2017 I demanded to examine my original patient records.

I wrote Ms. Morris in part, First, what review did you contact me about? I made several
complaints against Respondent Cesar Raul Gamero. There is nothing in the letter that indicates
which complaint you mean.

elimination it could pertain to either my complaint against Jeunesse Aesthetic Medicine, or
against Dr. Gamero for failure to release patient records/examine patient records, 395.3025(1).

Dr. Philip, what is the status of my complaint Reference Number 2017-06351, additional
information: Natasha forged name/signature Cesar Gamero on prescriptions?

Provide a Reference Number for my complaint April 19, 2017 against Jeunesse Aesthetic
Medicine, Unlicensed Health Care Clinic Establishment; Provide a Reference Number for my
complaint April 19, 2017 for Dra. Mara Rosario Castillo, Unlicensed Practice of Medicine.

The stated mission of the DOH is to protect, promote & improve the health of all people in
Florida through integrated state, county, & community efforts. The DOH has not protected me
from a bad doctor and his unlicensed medical assistant. I am a person with disabilities.

Florida Freight Terminals, Inc. v. Cabanas held, In connection with the requirement in wrongful
death actions of an underlying tort or breach of duty, proof of the defendants violation of a
statute or regulatory provision that either is designed to protect a particular class of persons from
their inability to protect themselves or establishes a duty to take precautions to guard a certain
class of persons from a specific type of injury, establishes negligence per se. 354 So. 2d 1222
(Fla. Dist. Ct. App., 3d Dist. 1978). I believe this standard applies to non-death cases as well.

Eggshell skull rule: Doctrine that makes a defendant liable for the plaintiff's unforeseeable and
uncommon reactions to the defendant's negligent or intentional tort. If the defendant commits a
tort against the plaintiff without a complete defense, the defendant becomes liable for any injury

I received your letter in the mail dated May 9, 2017, PDF/copy attached. You wrote in part:

Florida law requires that all information in this complaint remain confidential.

First, what review did you contact me about? I made several complaints against Respondent
Cesar Raul Gamero. There is nothing in the letter that indicates which complaint you mean.

Second, you failed to cite any Florida law that requires that all information in this complaint
remain confidential. Even so, any such law is likely unconstitutional.

The FIRST AMENDMENT to the Constitution of the United States says,

Congress shall make no law respecting an establishment of religion, or prohibiting the


free exercise thereof; or abridging the freedom of speech, or of the press; or the right of
the people peaceably to assemble, and to petition the Government for a redress of

The DOH has not provided a complaint reference number, that I am aware.
Complaint May 2, 2017 against Dr. Gamero for failure to release patient records. Included in this
complaint was a request to inspect the records prior to getting the records. F.S. 395.3025(1).

On May 11, 2017 I sent by U.S. Certified Mail, Article No. 7016 0600 0000 9402 8250,
Notice of Termination to Cesar Raul Gamero ME95007 and a demand to examine my original
patient records, see attached. Dr. Gamero has not responded.

On June 3, 2017 I sent by U.S. Certified Mail, Article No. 7016 0600 0000 9402 9509, a demand
to Cesar Raul Gamero ME95007 examine my original patient records, see attached.

An invoice from Dr. Gamero dated May 10, 2017 demands $57.25 for copies of my records.
However that does not negate my right under Fla. Stat. 395.3025(1) to examine my original
patient records. Thats what I want, to examine my original patient records. Then I may pay for
copies of the records. But first I want to examine my original patient records. It is part of my
investigative process, and my right under Fla. Stat. 395.3025(1).

certainly able to release your lab results, he is not obligated to under Florida law as the medical records
owner is considered being whoever generated the record. In this case, the legal responsibility would fall
on Labcorp. I have already contacted the Agency for Health Care Administration, the governing agency
who regulates health care facilities such as clinical laboratories. You may file a complaint with them by
calling their complaint hotline at 1-888-419-3456.

Thank you for your telephone call April 18, 2017. For your convenience a .wav file record of the phone
call is attached. All phone calls on my home office business telephone extension (352) 854-7807 are
recorded for quality assurance purposes pursuant to the business use exemption of Florida Statutes
chapter 934, section 934.02(4)(a)(1) and the holding of Royal Health Care Servs., Inc. v. Jefferson-Pilot
Life Ins. Co., 924 F.2d 215 (11th Cir. 1991). I am disabled. Recording phone calls is also a disability
accommodation for me.

I generally do not use an answering machine for several reasons. First, I was getting way to many
messages and could not keep up with the volume. Second, I could not efficiently get my messages.
Some people talk too fast. Some people mumble. Sometimes the connection is bad. Lastly, I prefer email
to have a written record. The attached .wav file is a record too, but it is too costly and time consuming to
make a transcript for every phone call.

Dr. Gamero is originally from Lima, Peru, and speaks English as a second language. He did not
communicate effectively with me. I do not speak Spanish, the official language of Peru. Language
barriers are a problem with some doctors in this area. Does Florida Health have a standard for physician
language proficiency? If so, please advise - by email. Thank you.

Thank you for emailing me, that is the best way to contact me. I was out on errands earlier, but I keep
my phone turned off otherwise, and use it for emergencies only. However I am happy to speak with you
today by telephone about Natasha Aguilar, DOH reference #2017-06351.

Yesterday I got a letter from Dr. Gamero stating in part, "As far as your comment that if we had a real
nurse, no we do not. We have a medical assistant, and to be certified in Florida it is basically voluntary
since 2011." Is that statement true?

Also, Dr. Gamero has a "shadow" practice called "Jeunesse Aesthetic Medicine" at the same address
as "CESAR R. GAMERO, M.D., LLC Health Care Clinic Establishment Permit 10/20/2009". Here is a
link to Jeunesse Aesthetic Medicine

Jeunesse Aesthetic Medicine is a Spanish language only website, and features "Dra. Mara Rosario
Castillo" an unlicensed doctor, possibly located in Peru, and "Natasha Lengua", Enfermera (nurse) who I
believe is the same person as Natasha Aguilar, DOH reference #2017-06351.

"Natasha Lengua" is not licensed either, that I could find.

Dear Ms. Moon,

This is a follow-up to your phone call April 18, 2017 about the nurse services provided by
Natasha Aguilar, who is not a licensed nurse. None of the following medical procedures were
done under the direct supervision of Dr. Gamero. He may have been in the office seeing other
patients, or not in the office at all.

Natasha Aguilar performed drug screening on me because I was prescribed pain medication, see
the report February 27, 2017, bearing her electronic signature AGULAR NATASHA, MA. Is
drug screening by urinalysis considered a nurse function? Also, Natasha Aguilar signed her
name followed by MA indicating she has a masters degree, which I assumed was a masters in
nursing degree. However the MA may actually refer to m.a. medical assistant. Is that right?

Natasha Aguilar gave me injections, my annual flu shot, and perhaps other injections. Is giving
injections of a flu shot considered a nurse function?

Natasha Aguilar frequently forged the name of Dr. Gamero on my prescriptions for drugs. I
know because I stood in front of her and watched her write the name Cesar Gamero on
prescriptions while in the office. Is forging the name of a doctor on prescriptions considered a
nurse function? Or is that just illegal? I scanned many of the prescriptions for years, and have
PDF copies, but not for scripts only sent electronically.

I scan documents and keep detailed records to compensate for disability, so I can recall with the
aid of records memory function damaged by traumatic brain injury and/or other disabilities.

I believe the forgoing shows Dr. Gamero and Natasha violated Fla. Stat. 458.331 Grounds for

Fla. Stat. 458.339 Physicians consent; handwriting samples; mental or physical examinations.

The foregoing is another reason why phone calls are bad. When you called April 18, 2017, I did
not know a nurse/medical assistant could lawfully practice unlicensed; and I was not prepared
to know and apply the Florida nursing standards to an unlicensed nurse/medical assistant.

I was a patient of Dr. Gamero since 2008. I believe Natasha Aguilar may have started working
for Dr. Gamero in January 2013.

For a number of years Dr. Gamero complained to me about the Florida courts, for himself, and
for his cousin Adolpho Cairo in the Miami area. Dr. Gamero complained that a judge talked
down to him during a hearing in his divorce case. (he speaks English poorly, but Florida judges
are notoriously rude to everybody, even English-only speakers like me). So I provided him a
copy of my DOJ complaint alleging rigged judicial elections in Florida. Then I provided him and
his staff (they all use the same email) my petition for president, Case SC16-2031. I also provided
him my letter in 2015 to the Chief Medical Examiner in Hillsborough County about the death of
a litigant in court on a home foreclosure case.

I provided Dr. Gamero at least 5 documents or sets of documents:

In March 2013 I provided legal research, books and CDs to Natasha about a child custody issue
with her 4 year-old niece, her brothers daughter with an estranged woman who is not his wife, a
drug addict living in Orlando motels, who voluntarily gave child to Natasha. Natasha wanted to
legalize the agreement, and raise her niece and start her in school next year, and legally terminate
the parental rights of woman, and her brother. (Natasha said the woman was a prostitute).

I now recall a snide remark by Natasha about my presidential petition. They likely supported
Hillary Clinton in the 2016 election. They may wrongly blame me for a role in her defeat.
Whatever happened, Dr. Gamero falsified my medical record dated February 27, 2017, with a
likely intent to end my disability status and end my Social Security payments. So I believe that
may have happened. Or Gameros conduct is part of a general effort to get people off disability. I
believe that is why he stubbornly refused to provide my lab report showing my poor health.

Regarding Dr. Gameros inability to speak proficient English, Natasha acted as an interpreter
more than once. But Natasha was not in the room during exams and office visits, so there was no
one present to interpret during those critical times in the so-called doctor-patient relationship.

The website for Dr. Gameros Jeunesse Aesthetic Medicine is Spanish language only. He
apparently has no desire to improve his English-speaking skills, communication vital to the so-
called doctor-patient relationship.

The article in the West Marion Messenger June 26, 2013 shows Cesar Gamero wanted to be a
singer, not a doctor, but his parents pushed him into medicine, and he capitulated. Now well into
middle age, I believe he regrets not pursing a singing career. Cesar Gamero does not like sick
people, which may be one reason he started Jeunesse Aesthetic Medicine, with a website
depicting young, healthy, thin, attractive women.

I received in the mail the above cited letter for my non-complaint attributed to Dr. Qamar. A
PDF version of the letter is attached, along with my letter May 12, 2017 to W. Stephen Muldrow
USAFLM that you somehow wrongly construed as a complaint to the Department of Health.

Dr. Philip, disabuse yourself that I made a complaint to the Florida Department of Health for the
notorious Dr. Qamar. Among other things, I did not submit an executed DOH complaint form.

Henceforth I do not expect to make another complaint to Florida Department of Health. It is a


waste of time because the DOH lacks qualified personnel to review the complaints. Only an
attorney licensed in Florida is qualified to apply the law to the facts of a complaint. The attached
letter of Sherra Mears, Government Analyst I, is evidence of UPL, unlicensed practice of law.

However I will continue to copy you and your cronies on correspondence and/or pleadings.
These are not complaints. For example, my correspondence to Jane Norberg, Chief, SEC Office
of the Whistleblower critical of Dr. Gamero is NOT a complaint to the Department of Health.

Since I did not make a complaint to the Consumer Services Unit, you are using your official
position as Surgeon General and Secretary of the Florida Department of Health to silence my
criticism of Dr. Qamar, and to obstruct my complaint of Dr. Qamar to USAFLM Muldrow, for
the benefit Dr. Qamar in violation of Chapter 838 Bribery, Misuse of Public Office.

Official Misconduct, Fla. Stat. 838.022(1):

(1) It is unlawful for a public servant or public contractor, to knowingly and intentionally
obtain a benefit for any person or to cause unlawful harm to another, by:
(a) Falsifying, or causing another person to falsify, any official record or official
document;

My letter to USAFLM Muldrow cites Administrative Complaint No. 2014-151189 showing


Dr. Qamar violated Fla. Stat. 456.072(1)(bb), signed September 9, 2016 by Celeste Philip,
MD, MPH, Surgeon General and Secretary, Florida Department of Health. So this matter is a
public record under Fla. Stat. 838.022(1), and under Chapter 456.

Perjury, Fla. Stat. 837.06 False official statements, applies to the letter of Sherra Mears:

837.06 False official statements.Whoever knowingly makes a false statement in


writing with the intent to mislead a public servant in the performance of his or her official
duty shall be guilty of a misdemeanor of the second degree, punishable as provided in s.
775.082 or s. 775.083.

Ms. Mears knowingly made a false statement in writing with the intent to mislead public
servants at the Department of Health in the performance of his or her official duties, in
combination with your violation of Official Misconduct, Fla. Stat. 838.022(1).

Separately and in addition to, the foregoing shows your abridgment of my freedom of speech, or
of the press, to comment or publish on Dr. Qamar, in violation of the FIRST AMENEDMENT to
the Constitution of the United States. The amendment as adopted in 1791 reads as follows:

Congress shall make no law respecting an establishment of religion, or prohibiting the


free exercise thereof; or abridging the freedom of speech, or of the press; or the right of
the people peaceably to assemble, and to petition the Government for a redress of

In addition to UPL, DOH employees routinely violate Floridas public records law by
telephoning complainants under the guise that phone calls are not public records. Phone calls
may be public records; especially when DOH employees leave voice messages on the telephone
answering machines of complainants. Those are public records.
