PROCEEDINGS OF THE COUNTY BOARD OF JACKSON COUNTY, MINNESOTA

April 18, 2017

The County Board of Jackson County, Minnesota met in regular session, in the Jackson County
Courthouse Board Room, 405 Fourth Street, City of Jackson, Minnesota, on April 18, 2017. The
following members of the Jackson County Board of Commissioners were present: James
Eigenberg, Don Wachal, Kim Hummel, Cathy Hohenstein and Scott McClure. County
Coordinator Steven Duncan and Trish Schulz, Human Resources Technician, were also in
attendance.

CALL TO ORDER

Chair Hummel called the meeting to order at approximately 9:00 a.m. and led the Pledge of
Allegiance.

Motion was made by Commissioner Wachal and seconded by Commissioner McClure to


adopt the agenda. Motion carried unanimously.

CONSENT AGENDA

Motion was made by Commissioner Hohenstein and seconded by Commissioner Wachal to


approve the Consent Agenda. Motion carried unanimously.

Board Action 17-090: Approve the April 4, 2017 Board of Commissioner meeting minutes.

Board Action 17-091: Approve all Commissioner disbursements in accordance with Minnesota
Statutes 130.01, subd. 4(b), recorded on warrants numbered 81358 through 81478 in the amount
of $183,056.43 - for Revenue Fund, $94,630.35; Road and Bridge, $47,463.36; Septic,
$6,695.00; Ditch Funds, $29,850.72; Agency, $3,357.00; Tax/Penalty, $980.00; and Forfeit Land,
$80.00. A detailed list of claims paid is available at the Auditor/Treasurers Office upon request.

Board Action 17-092: Approve declaration as surplus property of an ES & S 650 Ballot Tabulator
to be disposed of during electronic recycling.

Board Action 17-093: Approve the Applications for Exempt Permits for the Windom Area Youth
Hockey Association, with no waiting period, for raffles to be held on May 12, 2017; May 26,
2017; June 1, 2017; June 2, 2017; and June 3, 2017, all at the Jackson Motorplex, Wisconsin
Township, Jackson County.

Board Action 17-094: Approve 6 month, 3.2% Malt Liquor On - Off Sale License, for Eastside
Acres Campground, effective April 18, 2017 to September 30, 2017.

RECOGNITION OF RETIRING LAYPERSON

The Board recognized retiring lay member Paul Graupmann, Jackson County Library Board, for
his hard work, dedication and the part he played in local government.

UNITED COMMUNITY ACTION PARTNERSHIP (UCAP)

Motion was made by Commissioner Eigenberg and seconded by Commissioner Wachal to


adopt Board Resolution 17-017: Approving Support for United Community Action Partnership
in its application & implementation of the proposed Family Homelessness Prevention &
Assistance Program. Motion carried unanimously.

Resolution No. 17-017

Family Homeless Prevention and Assistance Program

Resolved by the Board of Commissioners, County of Jackson, and State of


Minnesota:

WHEREAS, the Minnesota Housing Finance Agency has made available Family
Homeless Prevention and Assistance Program grant monies to encourage and support innovation
at the local level to help prevent homelessness, reduce the length of homeless episodes, and
reduce repeated episodes of homelessness, and

WHEREAS, Area service providers who administer programs that address families crisis
needs have identified gaps within the service delivery system, and

WHEREAS, Area service providers who administer programs that address families crisis
needs have identified strategies to address the identified service gaps,

WHEREAS, Area service providers wish to continue to work together to coordinate their
services and improve the service delivery system,

WHEREAS, United Community Action Partnership desires to make an application on


behalf of the area service providers for funds to address these identified problems,

NOW THEREFORE BE IT RESOLVED that the County of Jackson, Minnesota agrees
to support United Community Action Partnership in its application and implementation of the
proposed Family Homeless Prevention and Assistance Program.

PUBLIC WORKS

Motion was made by Commissioner McClure and seconded by Commissioner Wachal to


adopt Board Action 17-096: Approve authorizing Public Works to create a Heavy Equipment
Operator Seasonal Parks position with the approval of the applicable job description. Motion
carried unanimously.

Motion was made by Commissioner Hohenstein and seconded by Commissioner Eigenberg


to adopt Board Action 17-097: Approve the request to post and hire a Heavy Equipment Operator
Seasonal Parks position. Motion carried unanimously.

Motion was made by Commissioner Wachal and seconded by Commissioner Hohenstein to


remove item 4.3 from the agenda: Personnel Request to create and fill 2017 Public Works
Summer position, as needed related to Parks/Campground cleaning. Motion carried
unanimously.

Motion was made by Commissioner Eigenberg and seconded by Commissioner Hohenstein


to adopt Board Action 17-098: Approving the award of SP 032-624-035 (bridge replacement on
CSAH 24) to M & K Bridge Construction in the amount of $649,284.75. Motion carried
unanimously.

Motion was made by Commissioner Eigenberg and seconded by Commissioner Wachal to


adopt Board Resolution 17-018: Approving Agreement between Minnesota Department of
Transportation and Jackson County. Motion carried unanimously.

RESOLUTION 17-018
AGENCY AGREEMENT

BE IT RESOLVED, that pursuant to Minnesota Stat. Sec. 161.36, The Commissioner of


Transportation by appointed as Agent of Jackson County to accept as its agent, federal aid funds
which may be made available for eligible transportation related projects.

BE IT FURTHER RESOLVED, the Jackson County Board of Commissioners Chair


and Jackson County Coordinator are hereby authorized and directed for and on behalf of the
County to execute and enter into an agreement with the Commissioner of Transportation
prescribing the terms and conditions of said federal aid participation as set forth and contained in
Minnesota Department of Transportation Agency Agreement No. 1027920, a copy of which
said agreement was before the County Board and which is made part hereof by reference.

COUNTY COORDINATOR

Motion was made by Commissioner Hohenstein and seconded by Commissioner McClure


to adopt Board Resolution 17-019: Accepting an intended donation from the Jackson
Community Foundation to be used for a County Fairgrounds Beautification Project. Motion
carried unanimously.

WHEREAS, there is an intended donation of funds to be made by the Jackson
Community Foundation to Jackson County and to be used for a Jackson County Fairgrounds
Beautification Project being planned by the Jackson County Fair Association, and;

WHEREAS, Minnesota State Statutes Chapter 465, Section 465.03, Gifts to


Municipalities informs that a county governing body shall accept such gifts by resolution and
by at least a two-thirds majority;

IT IS HEREBY RESOLVED, that the Jackson County Board of Commissioners does


hereby approve, by resolution, accepting the five hundred dollar ($500.00) donation from the
Jackson Community Foundation to be allocated to the Jackson County Fair Association and used
for a Jackson County Fairgrounds Beautification Project.

Passed and adopted by the Board of Commissioners of the County of Jackson, Minnesota

Motion was made by Commissioner Wachal and seconded by Commissioner Hummel to


adopt Board Resolution 17-020: Approve grant agreement and accept donation of grant funds on
behalf of the Jackson County Library. Motion carried unanimously.

Resolved by the Board of Commissioners, County of Jackson, and State of


Minnesota:

WHEREAS, a grant agreement and donation of funds proposal has been made by the
Southwest Initiative Foundation to Jackson County with this grant of funds to be used by the
Jackson County Library, and;

WHEREAS, Minnesota State Statutes Chapter 465, Section 465.03, Gifts to
Municipalities informs that a county governing body shall accept such gifts by resolution and
by at least a two-thirds majority;

IT IS HEREBY RESOLVED, that the Jackson County Board of Commissioners does


hereby approve, by resolution, accepting the grant agreement and the two thousand two hundred
twenty-five dollar ($2,225.00) donation from the Southwest Initiative Foundation and to be
allocated to the Jackson County Library and used for the purchase of an interactive whiteboard &
other library materials & programs.

CLOSED MEETING

Motion was made by Commissioner Hohenstein and seconded by Commissioner McClure


to close the meeting as permitted by Minnesota Statutes Section 13D.05, under attorney-client
privilege, regarding potential litigation. Motion carried unanimously.

Motion was made by Commissioner Eigenberg and seconded by Commissioner Wachal to


re-open the meeting. Motion carried unanimously.

Board Chair Hummel authorized the County Attorney to proceed as directed.

BOARD REPORTS

Commissioner McClure reported on meetings/events involving the Annual Township meeting,


Trails, Southwest Mental Health Center Governing Board, Des Moines Valley Health & Human
Services Joint Powers Board (DVHHS) and Defensive Driving training.

Commissioner Wachal reported on meetings/events involving a discussion about selling County-


owned property in the Lakefield area, Joint Facilities Committee related to transit facility, United

Community Action Partnership (UCAP) - Transportation, Annual Township meeting, Defensive
Driving training and Fair Board.

Commissioner Eigenberg reported on meetings/events involving the Annual Township meeting,


Heron Lake City Council, Defensive Driving training and Okabena City Council.

Commissioner Hummel reported on meetings/events involving the Joint Facilities Committee


related to transit facility, Law Library, Annual Township meeting, Southwest Mental Health
Center Governing Board, DVHHS and Defensive Driving training.

Commissioner Hohenstein reported on meetings/events involving a discussion about selling


County-owned property in the Lakefield area, Annual Township meeting, Heron Lake Township,
and DVHHS.

ADJOURN

Motion was made by Commissioner Hohenstein and seconded by Commissioner Eigenberg


to adjourn the meeting at 10:37 a.m. The motion carried unanimously.
