In the Lawyer Files #s 1-3 I allege serious charges against you and others who have refused to
commence or cause to commence proceeding against my former tenant Don Wilson who filed
false and misleading information with the Ontario Rental Housing Tribunal which is an offense
under s.206 (2) of the Tenant Protection Act, 1997.

The Ontario Rental Housing Tribunal, now the Landlord Tenant Board declined to deal with this
offense that was committed at their building on D’Arcy Street, Newmarket, On.
Dave Grech, Coordinator of the Investigations and Enforcement Unit who operates under your
authority to investigate non compliance with the Tenant Protection Act, 1997 was faxed Lawyer
Files # 1-2 on the same day March 22 2007 but has declined to commence or cause to commence
proceedings against Don Wilson for the above mentioned offence and others.

Ultimately it is your responsibility to deal with these matters but you have declined to do so.

Duties of Minister

200. The Minister shall,


(a) monitor compliance with this Act;
(b) investigate cases of alleged failure to comply with this Act; and
(c) where the circumstances warrant, commence or cause to be commenced proceedings with respect to
alleged failures to comply with this Act. 1997, c. 24, s. 200.

The ORHT acted rather peculiar to the situation as detailed in Lawyer File # 1and Dave Grech of your
Ministry was rather reluctant to respond to my request to have him commence or cause to commence
proceedings against Don Wilson as stated in Lawyer File # 2 and mentioned above.

His reasoning was incoherent to the facts and I made great effort to make this known to him but he remained
steadfast to his original decision not to proceed against Don Wilson.

That eventually caused me to bring these matters to your attention on or about September 1 2006 in a file
addressed to the Premier Dalton McGuinty called the BLACK BOOK.

I bring this particular date to your attention because it is relative to matters under the Tenant Protection Act,
1997.

Under s.206 (8) it states no proceeding shall be commenced respecting an offense under paragraph 1 of
subsection (2) more than two years after the date on which the facts giving rise to the offence came to the
attention of the Minister. 1997, c. 24, s 206 (8).

That gives you plenty of time to deal with the offense committed by Don Wilson at the Tribunal building in
front of the judicator who administers justice under the Tenant Protection Act, 1997 who you are ultimately
responsible to deal with her failure and the ORHT to comply with matters under the Tenant Protection Act,
1997 namely commence or cause to commence proceedings under s.206 (2)1against Don Wilson.

Your reason for not dealing with this matter was that you had mandated the Investigations and Enforcement
Unit to deal with matters of non compliance with the Tenant Protection Act, 1997 and you trust him so you
see no reason to revisit the conclusions of Dave Grech.

I provided you the evidence which gives very good reason to revisit his conclusions but you remained
steadfast in trust.
I indicated there is much more going on than meets the eye but at this time I have singular purpose in mind
focused on the offence committed by Don Wilson regarding s. 206 (2)

s.206 9 states: No proceeding shall be commenced respecting any other offense under this section more than
two years after the date on which the offense was, or is alleged to have been committed, 1997, c. 24, s. 206
(9)

The offence was committed June 30 2005 quickly closing in on two years I felt it my duty to inform you so
as to not cause any undue complications to the issues.

I have forwarded these matters for you to deal with as is your responsibility under the Tenant Protection Act,
1997 which I intend to hold you responsible for all such matters under your mandate.

So I understand under s.206 (9) you have until June 30 2007, 10 days from today to commence or cause to
commence proceedings against the ORHT and Dave Grech for the offense s.206 (1) 6.i under the Tenant
Protection Act, 1997.

Offence

206 (1) Any person who knowingly does any of the following
6. Harass, hinder, obstruct or interfere with a landlord in the exercise of,
i. securing a right or seeking relief under this Act or in the court, or

I reiterate that I hold you responsible to do so as is your mandate.

For your information the ORHT, now the Landlord Tenant Board may be at arms length or purportedly
independent of influence by the government but they were obliged to operate within the auspices of the
Tenant Protection Act, 1997 and of course the Constitution Act, 1982 as are we all but at this time I draw
your attention to the rapidly closing limitation of two years as per s.206 (9) and your mandate as Minister
regarding compliance with the Tenant Protection Act, 1997.

I feel it prudent to mention at this time that Don Wilson is guilty of other offences under s. 206 (2) which ups
the ante.

He is the Owner, Director, C.E.O. Treasurer, whatever of a company called BioSafe Natural Technologies
Inc. and he stated at the hearing that the rental agreement was not with him personally but with BioSafe.

That makes Don Wilson guilty of:

s.206 (5) Every director or officer of a corporation who knowingly concurs in an offense is guilty of an
offence. 1997, c.24, s.206 (5).

s.206 (7) A corporation that is guilty of an offence is liable on conviction to a fine of not more than
$50,000.1997, c. 24, s. 206(7)

That seems like quite a serious offense you have been covering up for some yet to be determined reason.
I should note that these offences are subject to the limitations of 2 years as per s.206 (9) which gives you
only 10 days to commence or cause to commence proceedings against Don Wilson.

As of June 31 2007 you will be definitely guilty of an offense under s.206 (1) 6.i of the Tenant Protection
Act, 1997.

In your best interest I will copy this letter to Michael Bryant, Attorney General who is your legal
representative according to his web site “Role of Attorney General”

This presents a little of a situation for the Attorney General since he is also guardian of the public’s interests
among all the other positions of responsibility such as perhaps advising you in the first place as to how to
deal with this situation.

It concerns me a whole lot too because what are my chances of being fairly represented in Ontario where he
has the Chief Justice Roy McMurchy under his wing and the Crown Attorneys and. so on as per his web site.

Quite a predicament I’m sure, but of course not for you or Michael because you have got all the bases
covered financed by the people to administer justice throughout Canada where it is an improbability unless it
suits the Attorney General’s best interest.

Anyway, John Gerretsen, I hold you responsible to deal with these pressing matters as they clearly are yours
according to the Tenant Protection Act, 1997.
