GAY ADOPTION IN SOUTH AFRICA


South Africa has been a country that has suffered for the discrimination
in its history, nowadays it fights for a non-racist, non-sexist and
democratic South Africa. It is the only African country to allow joint
adoption by same sex couples. South African law doesnt discriminate
against gay or lesbian couples adopting. The 2002 decision of the
Constitutional Court in the case of DuToit and the Ministry of Social
Welfare and Population Development amended the Child Care Act 1983
to allow both joint adoption and adoption of the spouse's child.

The Child Care Act has been superseded by the 2005 Children's Act,
which allows for joint adoption by either same or same-sex couples or
the spouse's child. Same-sex marriage has been legal since 2006, and is
equivalent to marriage between persons of opposite sex for all purposes,
including adoption. However, the adoption agencies have their own
criteria and will be up front about whether they accept same sex couples
as applicants for adoption, there are 1.8 million children in South Africa
with potential to be adopted; SA has on average less than 2400
adoptions per year.

South Africa is a country that works constantly for rights of children to


have a home regardless of family type, race or if the parents are the
same sex.

Actually this country acts for a better society without that scourge called
discrimination.
