AFFIDAVIT OF DESISTANCE

We, Spouses Ramon Lee and Lydia Lee, Filipino, of legal age, with address at
24-C.P. Guevarra Street, San Juan City, after having duly sworn in accordance
with law, hereby depose and states as follow:

1. I am the private complainant in the above-captioned criminal case for

Reckless Imprudence Resulting to Homicide against the defendant FABIO
S. TOLENTINO and HARMONY TRAN CORP (HTC) represented by its
CEO GEORGE L. MIRANDA;

2. The civil aspect of this case had already been fully settled, As such, I am
no longer interested in pursuing the criminal aspect of this case.

3. I am therefore voluntarily desisting from further prosecuting the criminal

aspect of the instant case against the defendants after having receiving the
full amount of the immediate compensation demanded.

4. I cause to execute this Affidavit of Desistance to attest to the truth of the

foregoing statement, of my own freewill and volition, solely for the purpose
of seeking the dismissal of the instant case. I therefore signify my intention
not to further prosecute the same against the defendant FABIO S.
TOLENTINO and HARMONY TRAN CORP (HTC) represented by its
CEO GEORGE L. MIRANDA, and by virtue of this voluntary desistance, I
hereby waive in perpetuity all my rights and claims appertaining thereto.
