AFFIDAVIT OF WAIVER AND QUITCLAIM

KNOW ALL MEN BY THESE PRESENTS:

That I, ____Fernando E. Magnakaw______, Filipino, of

legal age, a resident of _12 Balimbing St., Brgy. Benta, Pasig
City__, after having been sworn in accordance with law,
hereby depose and state that:
1. I am formerly employed as a __Truck driver____ with
__Coca Cola Philippines Inc.__, with office address at
143 Coca Cola Compound, Ortigas Ave., Pasig City.

2. After due notice and hearing on March 16, 2017 and

March 20, 2017, respectively, I was dismissed on just
cause by the Company on March 10, 2017 after having
been found guilty of stealing coke bottles and selling
them to sari-sari stores in San Pedro, Laguna, in
violation of the Company rules and regulations.

3. I acknowledge receipt of the sum of _29,650_, Philippine

Currency, from __Coca Cola Philippines Inc._ in full
payment and final settlement of the (financial
assistance or separation pay, overtime pay, salary or
salaries, wage or wages, commutable sick and vacation
leaves, gratuities or any kind of compensation or
emoluments) due to me or which may be due to me
from __Coca Cola Philippines Inc._ under the law or
under any existing agreement with respect thereto, as
well as any and all claims of whatever kind and nature
which I have or may have against ___Coca Cola
Philippines Inc._, arising from my employment with (and
the termination of my employment with __Coca Cola
Philippines Inc.___.

4. In consideration of said payment, I do hereby

voluntarily quitclaim, release, discharge and waive any
and all actions of whatever nature, expected, real or
apparent, which I may have against __Coca Cola
 Philippines Inc__, its directors, officers, employees,
agents and clients by reason of or arising from my
employment with the company.

5. I will institute no action, whether civil, criminal, labor or

administrative against __Coca Cola Philippines Inc.__, its
directors, officers, employees, agents and clients.

6. Any and all actions which I may have commenced

either solely in my name or jointly with others before
any office, board, bureau, court, or tribunal against
__Coca Cola Philippines Inc.__, its directors, officers,
employees, agents and clients are hereby deemed and
considered voluntary withdrawn by me and I will no
longer testify or continue to prosecute said action(s).

7. I declare that I have fully understood the contents of

this document, and that the document has been
explained to me in a dialect / language I understand.

8. I further declare that I voluntarily and willingly executed

and signed this Release, Waiver and Quitclaim with full
knowledge of my rights under the law.
