Enrollment Policies

1. All lessons are 30 minutes in length, schedule indicates start times.


2. Families will not be charged for their first swim lesson until the start date is confirmed.
3. Family fees will be charged per lesson per month on the first day of each month.
4. Families will not be charge for lessons that fall on Scheduled Bear Paddle Closures defined as pre-planned dates
Bear Paddle is closed.
5. If there is an Unexpected Bear Paddle Closure, your student will receive a Make-Up Lesson.
6. If a transfer of lesson results in a missed lesson, a Make-Up Lesson will be given and will need to be made up within
one week of the schedule change.
7. If a transfer of lesson results in an extra lesson, a fee will be charged for the additional lesson.
8. Your enrollment will be cancelled after your fourth consecutive absence if no contact has been made regarding the
absences.
9. Refunds will not be issued for missed lessons.
10. Prices are subject to change.
11. Registration is accepted on a space available basis.
12. Bear Paddle will be closed on the following holidays: New Years Eve at 4:00 pm, New Years Day, Easter, Memorial
Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Eve and Christmas Day. Students will not be
charged on days Bear Paddle is closed for Holidays.
13. Abuse of multi-child family discount i,e. registration of children under multi-child rate that are not siblings may
result in, back charges for fees, administrative fee up to $250, cancellation of enrollment, prosecution for theft, or any
combination of the aforementioned results.
14. Classes are month to month, meaning classes continue until a withdrawal form is submitted with 30-day notice.
15. 30-day written notice is required to withdraw any child, regardless of whether or not additional children continue
swimming.
16. By signing this waiver you authorize Bear Paddle to charge your credit/debit card on the first day of every month
for swim lessons.
17. Newly registered participants will be pro-rated based on the day of registration.
18. Cash or check payments must be submitted to the front desk prior to the first of the month.
19. Cash or check payment are required to pay 30-day deposit, this may be used as final monthly payment with 30-day
notice.
20. All payments must be made by the 15th day of the month or your swimming spot may be forfeited.

Make-Up Lesson Policies


1. Bear Paddle does not offer refunds for missed lessons.
2. If a student swims one time per week and misses multiple lessons in one month, they will be eligible to Make-Up
one lesson unless a doctor's note is provided.
3. If a student swims two times per week and misses multiple lessons in one month, they will be eligible to Make-Up
two lessons unless a doctor's note is provided.
4. Please notify us if your student is unable to attend their swim lesson via email or phone.
5. Make-Up Lessons can be scheduled up to one week in advance after the missed lesson.
6. Make-Up Lessons must be used while the student is active and are not retained upon re-enrolling.
7. Notice must be given if you are unable to attend your scheduled Make-Up Lesson. Failure to do so will result in loss
of the Make-Up Lesson.
8. Availability to schedule a Make-Up Lesson is not guaranteed.

Swim Lesson Policies


1. Reusable swim pants are required for students under the age of three.
2. We reserve the right to cancel swim lessons at any time for any reason.
3. We reserve the right to combine classes regardless of age group or level.
4. For safety reasons, children with special needs who are enrolled into group lessons may be removed from class
and assessed for private, or semi-private lessons. Children with special needs may also be re-admitted to group
lessons.
5. Do not feed your child at least 30 minutes before lessons.
6. Make sure your child uses the restroom before each swim lesson to ensure a safe swimming environment for
everyone.
7. If fecal matter or vomit is found in the pool, Bear Paddle Management will take all steps necessary to follow state
guidelines and ensure student safety. Depending on the nature of the substance, swim lessons may or may not be
cancelled.
8. We do our best to provide a consistent teacher in every class. While we will do our best to contact families when a
teacher change is occurring, we reserve the right to change teachers as needed.
9. Students must not enter pool until teacher is present. Students may not sit on the edge of the pool before or after
their swim lesson.
10. Students must wait with their parents or guardians on the pool deck until their swim lesson begins.
11. We keep our pool temperature at 90 degrees. In the event that we have pool heater issues, we will still have swim
lessons if the pool temperature is 86 degrees and higher.

Facility Policies
1. Injuries from children running and slipping around the pool are the most common and preventable injuries
associated with this type of facility. Parents are required to help enforce the no running policy.
2. State law prohibits food or glass from entering the pool area.
3. The Kid Car Wash will serve as the main shower area for participants. Please use this shower area to rinse before
and after lessons.
4. Please keep showers and changing rooms as open as possible for families with toddlers not ready for the Kid Car
Wash.
5. Please use only one changing room per family and be aware of the locker rooms with changing stations for little
ones.
6. The Clubhouse is used as a viewing area, party room, and classroom. At times the Clubhouse may be closed for
classes or events.
7. There will be no drop offs. Parents or guardians must remain at the facility for the duration of the lesson. Failure to
abide by this policy may result in (a) fee up to $250.00, (b) cancellation of enrollment, (c) contacting local child
services.

Swim Camp Policies


1. There are no makeup lessons offered for Camps.
2. Total Camp fee is due at time of registration.
3. Camp fee is non-refundable.
4. We reserve the right to change, cancel or combine classes.
5. Camp registration requires the full scheduled commitment.

Text Message Opt In


Checking this box will allow you to receive text messages about emergency closures, promotions and happenings at
Bear Paddle Swim School. Texting has very strict regulations on use which require you to obtain authorization from
the individual prior to texting.

Photo Release
I am aware that individual and group publicity photos and videos are taken by the School from time to time and in
consideration for my or my child(ren)'s participation, I hereby grant the School, its legal representatives and assigns
(including any agency, client or publication) permission for my child(ren)'s likeness to be used in Bear Paddle Swim
School publicity or advertising, without payment or consideration. I understand that these materials will become the
property of the School. I hereby irrevocably authorize the School to edit, alter, copy, exhibit, publish or distribute this
photo for the purposes of publicizing the School's programs and services. In addition, I waive the right to inspect or
approve the finished product, including written or electronic copy, wherein my or my child(ren)'s likeness appears.
Additionally, I waive my right to royalties or other compensation arising or related to the use of the photograph. I
hereby hold harmless and release and forever discharge the School from all claims, demands, and causes of action
which I, my heirs, representatives, executors, administrators, or any other persons acting on my or my child(ren)'s
behalf or on behalf of my estate have or may have by reason of this authorization.

Medical Authorization
I have noted any medical/health problems of which the staff should be aware in the attached registration form. In the
event of an accident or emergency, I hereby authorize myself or my child(ren) to be transported to a hospital for
medical treatment and I hold the School and its representatives harmless in the execution of such. Additionally, I
hereby agree to individually provide for all medical expenses which may be incurred by myself or my child(ren) as a
result of any injury sustained while participating at or for the School.

Parent/Guardian Waiver
In consideration for allowing the Participant(s) to enroll in swimming classes offered by the Bear Paddle Swim School,
which shall include its directors, officers, owners, employees, agents, guides and volunteers, and to participate in the
activities provided or arranged by the School, the Undersigned, individually and on behalf of the Participant(s), and
our personal representatives, heirs, next-of- kin, spouse, and assigns, hereby:
1. Acknowledges that swimming lessons and all associated activities, and use of the School's facilities, equipment
and gear (collectively, "Activities"), may be dangerous and may involve risks that may cause serious injury and in
some cases death, because of the hazards, including without limitation:
1.1. Accidents involving drowning, head or spine injuries, or other bodily injuries;
1.2. Slipping and falling because of footing conditions, wet surfaces, or other conditions; and
1.3. Contact with other participants, swimmers, School personnel, or individuals.
2. Voluntarily assumes the risk and danger of injury or death inherent in the participation in the Activities.
3. RELEASES, DISCHARGES AND PROMISES NOT TO SUE the School for any loss, liability, damage, or cost
whatsoever arising out of or related to any loss, damage or injury (including death) to the Undersigned, the
Participant(s) or their personal property.
4. RELEASES the School from any claim of negligence in connection with the Participant's(s') participation in the
Activities, including but not limited to training, maintenance, care, equipment or gear, condition of facilities, or
supervision of the Participant(s) or the other participants.
5. INDEMNIFIES, SAVES AND HOLDS HARMLESS the School from and against any loss, liability, damage or cost
arising out of or in any way connected with Participant's(s') participation in the Activities, use of the School's facilities,
equipment and gear, or any acts or omissions of the Participant(s), the other participants, School personnel, or any
other person or entity.
6. Agrees to abide by and follow any instructions given or rules established by the School regarding the Activities or
Participant's(s') use of the School's facilities, equipment or gear.
7. Cameras and videos are not permitted in the changing rooms or bathrooms. Cameras and videos are permitted by
use of only the parent or guardian.
8. Expressly agrees this Release is governed, and is intended to be as broad and inclusive as permitted, by State law.
If any portion of this Release is declared invalid, illegal, or unenforceable, the validity, legality and enforceability of the
balance of the Release shall not be affected or impaired in any way and shall continue in full legal force and effect.
9. Understands and agrees this Release is a contract. If a lawsuit or proceeding is filed against the School for any
injury or damage in breach of this contract, the Undersigned will pay all reasonable attorney's fees, costs and
expenses incurred by the School in defending the lawsuit or proceeding, including attorney's fees, costs and
expenses incurred in collecting upon any judgment, order or award.

Release, Indemnification and Covenant Not to Sue
In consideration for the minor(s) identified in this registration form being permitted by the School to participate in the
Activities, and to use the
School's facilities, equipment and gear, I agree to the following waiver, release and indemnification: The undersigned
parent, guardian, or custodian of the above minor, individually and on behalf of the minor(s), hereby joins in the
foregoing Release and agrees to save and hold harmless, indemnify, and forever defend the School from and against
any claims, actions, demands, expenses, liabilities (including reasonable attorneys' fees, costs and expenses), and
negligence made or brought by the minor(s) or by anyone
on behalf of the minor(s), as a result of the minor's(s') participation in the Activities, and use of the School's facilities,
equipment and gear. I, individually and on behalf of the minor(s), further agree not to sue the School as a result of any
injury, loss, or death the minor(s) suffers in while participating in the Activities or using the School's facilities,
equipment and gear. In the event of a medical emergency (real or apparent), the undersigned Parent(s)/Guardians(s) of
the above named Participant(s), hereby grants authorization to Bear Paddle Swim School, and its employees and
representatives, to engage at its sole discretion and judgment, any licensed physician or health care facility on behalf
of the Participant(s), and to direct and/or order such emergency medical treatment for the Participant(s) as may seem
reasonably necessary under the circumstances. Each of the undersigned further agrees and promises to indemnify
and hold harmless Bear Paddle Swim School and its directors, officers, employees, and representatives, for exercising
the foregoing authority. I/we further authorize any representative or employee of Bear Paddle Swim School to have the
Participant(s) treated in any medical emergency center while participating in the Activities described above.

I HAVE READ THE ABOVE POLICY, RELEASE AND WAIVER, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT. I
UNDERSTAND IT IS THE SCHOOL'S INTENT, IN WHICH I CONCUR, TO AVOID ANY AND ALL LIABILITY, LOSS,
CLAIMS, DEMANDS OR DAMAGES, WHETHER KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN BY OR
THROUGH ME, THE PARTICIPANT(S) OR ANY THIRD PARTY, ARISING OUT OF OR RELATING TO THE
PARTICIPANT'S(S') PARTICIPATION IN THE ACTIVITIES OR USE OF THE SCHOOL'S FACILITIES, EQUIPMENT OR
GEAR, OR MY ENTERING THE SCHOOL'S PREMISES, OR USING ITS FACILITIES, EQUIPMENT OR GEAR. I FULLY
REALIZE PARTICIPANT(S) MAY SUSTAIN DAMAGES, INJURIES, LOSSES OR LIABILITY RESULTING DIRECTLY OR
INDIRECTLY FROM PARTICIPATION IN THE ACTIVITIES, OR USING THE SCHOOL'S FACILITIES, EQUIPMENT OR
GEAR. BY EXECUTING THIS DOCUMENT, I FULLY INTEND, INDIVIDUALLY AND ON BEHALF OF
THE PARTICIPANT(S), TO RELEASE THE SCHOOL FROM ANY AND ALL SUCH DAMAGES, INJURIES, LOSSES, OR
LIABILITIES, WHETHER ARISING FROM NEGLIGENCE OR OTHERWISE.
