AFFIDAVIT OF ARRESTING OFFICER

I, PO3 CRESENTE PAULATE, of legal age, single,

Filipino, a bonafide member of the Philippine National Police
(PNP) presently assigned and designated as member of
Station Anti-illegal Drug Unit (SAIDU) in Digos City Police
Station, Digos City, Philippines, after having been sworn to
in accordance with law do hereby voluntarily depose and
say:

1.) That on or about 6:00 p.m. of September 05, 2016, a

regular confidential informant (CI) arrived in our station and
informed us that a certain alias STONEY is actively
engaged in selling/peddling of methamphetamine
hydrochloride otherwise known as SHABU in Purok Tugas,
Bonifacio 8th, Bgy. Zone 3, Digos City. The confidential
informant (CI) further averred that he had known and has
long acquaintance with the above suspect and had
transacted many times with him. The confidential Informant
(CI) also told us that he will meet the suspect STONEY
anytime in the evening of the same date for a sale of
SHABU and to introduce a buyer to him at Purok Tugas,
Bonifacio 8th , Brgy Zone 3, Digos City as place of
transaction;

2.) That upon assessment of our Team Leader PI GIAN

CARLO ESPINA and considering that the information is
actionable, he immediately informed to the Officer in Charge
PSUPT ELVIN PALAO and coordinated with PDEA RO XI
and was given AUTHORITY TO OPERATE CONTROL NO.
51115-4321-10987 at around 6:45 p.m. in the evening of
the same date, afterwards, our Team Leader called for a
briefing for a possible buy bust operation. Attached is a copy
of the Authority to Operate marked as Annex A which
forms an integral part hereof;

3.) That during the briefing, I was designated as Arresting

Officer (AO) while SPO1 JAIME NOLASCO was designated
as Poseur Buyer (PB) and the agreed pre-arranged signal
will be the act of removing of used ball cap of the Poseur
Buyer (PB) to indicate the consummation of the transaction;

4.) That the Poseur Buyer (PB) was given by our Team
Leader, Six (6) pieces of Five Hundred Peso bill to be used as
buy-bust marked money with Serial Numbers CQ864034,
CS054819, CS080603, GJ968969, GV963698 and GU654615
with initials AV on all of them marked as Annex B which
forms an integral part hereof;

5.) That I, together with Confidential Informant (CI) and the

operatives from our units led by PI GIAN CARLO ESPINA,
together with PO1 Melvin Malabute, PO2 Markus Micabalo
and PO3 Pete Bayani Camporedondo, left the office at about
8:00 p.m. of the same date boarded to our respective
vehicle and proceeded to the agreed place of transaction
wearing a civilian attire;

6.) That upon arrival at the place of transaction, the PB and

the CI stop at basketball court located at Purok Tugas
Bonifacio 8th Zone 3 Digos City their agreed place of
transaction then alighted from their service motorcycle and
stayed thereat; while me and the rest of the operatives
positioned ourselves strategically and undetected in the
vicinity wherein we can see their transaction between the PB
and the suspect;

7.) That after a few minutes of waiting, a male person

wearing white shirt, short pants and a slipper near the target
area, later approached to the location of (PB and CI)
thereafter, the CI and the PB having conversation with the
said male person, that during their conversation the said
male person pulled out something from his pocket and
handed it over to the PB, then the PB gave something to the
said male person later known to be Roland dela Rosa;

8.) That afterwards, the PB gave the agreed pre-arranged

signal by removing his used ball cap indicating that the
transaction has been consummated, I, with the other
operatives immediately rushed towards the location of the
PB and said male person, we then introduced ourselves as
Police Officers from Digos City Police Office and held the
suspect and thereby, I (PO3 Paulate) subsequently informed
his constitutional rights in a dialect (visayan) known to them
as afforded by law and the nature of his offense committed,
thereafter I conducted a body search;
9.) That during the search conducted, I (PO3 Paulate) was
able to recover from the possession and control of the
suspect alias Stoney, Six (6) Five Hundred Peso bill which
was buy-bust marked money with Serial Numbers
CQ864034, CS054819, CS080603, GJ968969, GV963698
and GU654615, one (1) white cellular phone (MyPhone) with
SIMPACK, one (1) black wallet and one (1) Identification
card (drivers license);

10.) That after the conduct of search, subsequently, we

decided to conduct our inventory on the area and in front of
the suspect alias Stoney and Brgy. Kagawad ERWIN
VERANO , I and PO1 Melvin Malabute placed the necessary
markings on the seized drugs and non-drug evidence and
place the same in a transparent plastic evidence pouches
separating the drug and non-drug items sealed it with
masking tape and placed our marking in the same manner;

11.) That thereafter we proceeded back to our Office at

Digos City Police Station together with the seized items and
the arrested suspect, which was properly marked and sealed
and presented them to Duty Desk Officer JANICE YBANEZ
for recording and proper disposition;

12.) That we were able to identify the arrested persons as

ROLAND DELA ROSA, 33 years old, married, jobless and a
resident of Purok Talisay, Bonifacio Corregidor, Brgy Zone 3,
Digos City ;

13.) That we conducted physical Inventory of the seized

items on that day September 6, 2016 on or about 9:20 p.m
at our office at San Agustin, Digos City in the presence of
the herein arrested persons and witnessed by BRIX
TRAZONA from Digos Times as media representative, LEE
IVY ACEVEDO from the DOJ and Kgd. ERWIN VERANO an
elected public official of Brgy. Zone 3, Digos City. Attached is
a copy inventory of evidence marked as Annex C which
forms an integral part hereof;

14.) That the seized drug evidence was submitted to the PNP
Crime Laboratory Office XI, Magsaysay St, Digos City, Davao
del Sur for quantitative and qualitative examination and the
arrested person believed to be indulged in the use of illegal
drugs based on his physical appearance (pale, profuse
sweating, dried lips, uneasy and reddish eyes) were
subjected to urine test to determine the presence of illegal
drugs;

15.) That the recovered non-drug evidence remained in the

custody of Property Custodian NISA OPALLA while cases
for violation of Sec. 5 and Section 11 of Republic Act 9165
are being prepared against the arrested person; and

16.) That I am executing this affidavit in order to apprise the

concerned authorities of the truthfulness of the above-
mentioned facts and to ask the filing in violation of Sec 5
and 11 of Article II of R.A. 9165 against ROLAND DELA
ROSA.
