JUDICIAL AFFIDAVIT OF JORDAN SANTOS Y REYES

I, Jordan Santos Y Reyes, 17 years old, single, and living at Block 10 Lot 17 Phase 1
Southville 3, Poblacion, Muntinlupa City, plaintiff in this case, states under oath that:

PRELIMINARY STATEMENT

The person examining me is Atty. Justine Wilma S. Dagdagan with address at Block 55 Lot 21
Phase 2, Barangay Pinagsama, Taguig City. The examination is being held at the same
address. I am answering her questions voluntarily, to the best of my knowledge and fully
conscious that I do so under oath and may face criminal liability for false testimony and perjury.

PURPOSE

This affidavit/testimony of plaintiff Jordan Santos Y Reyes is being offered to prove that
respondent Luis Basco y Agpay did there and then unlawfully took his cellular phone with the
use of intimidation and force upon his person.

1. Q: Please state your name, age, and other personal information for the record.
A: I am Jordan Santos Y Reyes, 17 years old, born on November 8, 1995, a third year high
school student, and currently living at Block 10 Lot 17 Phase 1 Southville 3, Poblacion,
Muntinlupa City.

2. Q: How should I call you?

A: You can call me Jordan.

3. Q: Jordan, do you know the accused?

A: I do not really know his name but I can remember his face.

4. Q: How sure are you that he is the one who did the hold-up to you?
A: I can remember his face since it was already bright at that time. He even placed his arm
over my shoulder before he pointed a sharp object at my side.

5. Q: Do you still remember at around what time it happened?

A: It was around 7:50 in the morning on March 16, 2013

6. Q: Where did this incident happen?

A: It was near Muntinlupa National High School Annex Building located at Phase 2
Southville, Poblacion, Muntinlupa City.
7. Q: Where were you exactly when the accused did the hold-up?
A: I was at a bench beside Muntinlupa City National High School Annex Building with my
friends.

8. Q: What were you doing at that time?

A: I was just sitting and waiting with my friends for the person who will train us for Track and
Field.

9. Q: What happened after that, if any?

A: A man, who I do not know, sat beside me and put his arms around me. He told me that he
will whisper something to me.

10. Q: What did he tell you?

A: He told me Hold-up ito. Akin na ang cellphone mo. Wag kang mag-iingay.

11. Q: Did you give your cellular phone to him?

A: Yes.

12. Q: Why did you give it to him?

A: I was scared at that time. He pointed a sharp object at my right side so I just kept quiet.

13. Q: You said that you were with your friends, did they see the incident?
A: Yes, they also saw what happened. But they also got scared.

14. Q: Did he also take something from your friends?

A: None. But he threatened them to keep quiet or else they will be stabbed. So all of us did
not say anything until we were sure that he was far enough from us.

15. Q: What did you do when he left?

A: We went immediately to the Barangay to inform them of what happened. But when we
went there, they told us to report the incident to the police station in Southville 3.

16. Q: What happened when you reached the police station?

A: The police men immediately helped us to look for the suspect. Unfortunately, we were not
able to find him but they promised to inform us if there are any updates and that they will
not stop looking for the suspect.

17. Q: What happened after that, if any?

A: In the evening, one of my friends who I was with that morning told me that they saw the
suspect again in Phase 3 Southville 3. We immediately went to the Barangay and we all
went to Phase 3. When I was able to confirm that he was the one who did the hold-up, the
police arrested him.

Joint Judicial Affidavit of Arresting Officers

We, B/P Arturo Cruz and B/P Teodoro Sison, of legal age, Filipino, and residents of at
Barangay Poblacion, Muntinlupa City, both Barangay Police, states under oath that:

PRELIMINARY STATEMENT

The person examining me is Atty. Justine Wilma S. Dagdagan with address at Block 55 Lot 21
Phase 2, Barangay Pinagsama, Taguig City. The examination is being held at the Barangay
Poblacion Police Station. We am answering her questions voluntarily, to the best of our
knowledge and fully conscious that we do so under oath and may face criminal liability for false
testimony and perjury.

PURPOSE

This affidavit/testimony of police officers Teodoro Sison and Arturo Cruz is being offered to
prove that respondent Luis Basco y Agpay was positively identified by the plaintiff and was
lawfully arrested on March 16, 2013.

1. Q: In what police station were you assigned?

A: We are assigned as Barangay Police in Barangay Poblacion, Muntinlupa City.

2. Q: At what time are you on duty in said Station?

A: We are both on duty every day starting 6:00 in the evening until 6:00 in the morning the
next day.

3. Q: Did you report on work last March 16, 2013?

A: Yes, we both reported for work that day. At around 6:00 in the evening, we were already
exchanging duties with our counterparts who instructed us to take note of the hold-up
incident that morning, and informed us that there is a follow-up operation on going in
solving the said case.

4. Q: Where were you and what were you doing at around 7:00 in the evening that day?
A: We were both in the station at that time. It was when Jordan and his mother went to our
station and reported to us that someone told them that the accused for the hold-up incident
that morning was seen to be in Phase 3, Poblacion, Muntinlupa City.

5. Q: What happened after, if any?

A: Together with the plaintiff and the mother, we immediately went to the place where the
accused was seen. Thereafter, Jordan positively identified that he was the one who did the
hold-up to him that morning.

6. Q: What did you do after that?

A: We immediately approached the accused and invited him to our station. After that, we
recorded the incident that night in our log book then brought him to the Women and
Children Protection Desk Muntinlupa Police Station for the proper filing of charges.
