Re: Second Appeal

Dear Sirs,
I’m writing to you in response to your letter dated July 14th, having been
advised by passenger focus to request a second appeal. This is due to your
letter not taking into account any of the fact that I had included on my
initial appeal application.

Your letter states: "I understand a notice was issued as production of


supporting documentation necessary to validate the ticket was not possible
on the date concerned"
This failed to address the fact that the railcard was produced and accepted
on the date in questions, it was later on the same journey that the UFN was
issued only after the conductor had destroyed the railcard.

It goes on to state: "As you know a discount ticket is only acceptable if


presented along with a valid railcard. What happens if you have lost or
forgotten your railcard? Cross Country policy is clear. The passenger will
be requested to upgrade the ticket to the full price and pay the
difference"
This failed to take account of the fact that my railcard was not lost or
forgotten, as it was presented to and then damaged by the conductor.
Additionally if Cross Country's policy is to upgrade the ticket to the full
price and pay the difference the policy was not followed in this case as I
was requested to pay £45, not £22.45 which would have been the difference.

Your letter concluded "On this occasion I am happy to cancel the


outstanding unpaid fare notice if a copy of the railcard, which must have
been valid on the date of the journey, can be provided"
I am unable to supply the railcard that I was using on this journey due to
the fact, as I stated on the original appeal application, the conductor on
the train destroyed and retained the railcard.

As suggested by passenger focus I’m including with this letter; a copy of


my original appeal application, a copy of a letter I sent to Cross Country
explaining the situation in detail (which is currently being looked into by
Cross Country – Their ref: XC-0100709-BFJ)and a copy of my new railcard. I
hope that you will be able to take another look at this case as I would
like to see this issue resolved promptly.
