Marcos vs Montejo

Facts:

Imeda Marcos ran for congress representing Tacloban, Leyte. The opposing party,
Montejo sought to disqualify Marcos on the grounds that the latter is not a resident
of Tacloban for one (1) year, thus not meeting the requirement to run for elections
stated under Article 6, Section 6 of the Philippine Constitution. COMELEC cited
places where she served certain positions and contended that Imeldas residence is
ought to be anywhere except Tacloban.

Issue:

Is Tacloban, Leyte the legal residence of Imelda Marcos?

SC/Rulings:

Yes. It is settled that when the constitution speaks of residence, it actually means
domicile. Tacloban, Leyte was a domicile of origin of Imelda Marcos following her
parents. COMELEC cited places where Imelda resided but not her actual domicile.
One does not lose her domicile even he has resided in other places. Imelda Marcos
kept close ties with her domicile of origin by establishing residence in Tacloban.
The honest mistake in the certificate of candidacy does not negate the facts of
residene.
