REGULATION ORDINANCE NO. 2011-726


AN ORDINANCE PROHIBITING ANY FORM OF CONVEYANCING OF
THE AWARDED LOT ON THE RELOCATION SITES OF THE ILOILO
CITY GOVERNMENT AND PROVIDING PENALTIES FOR
VIOLATION THEREOF

WHEREAS, the City Government of Iloilo recognizes the rights of its constituents to a
good and quality public services in order to raise their quality of life especially the
underprivileged and the homeless citizens by making them accessible to land and housing as
mandated by R.A. 7279, otherwise known as "An Act to Provide for a Comprehensive and
Continuing Urban Development and Housing Program, Establish the Mechanism for its
Implementation and for Other Purposes", particularly Section 2 par. b(S) which states that:

"Section 2. - It shall be the policy of the State to undertake, in cooperation


with the private sector, a comprehensive and continuing urban development and
htmsing program which shall:

(5) Access to land aml housing by the underprivileged and


homeless citizens; "

WHEREAS, the lloilo City Government, through the lloilo City Urban Poor Affairs
Officer (ICUPAO) provides relocation sites for the qualified beneficiaries who are residents of
Iloilo City;

WHEREAS, in order to avoid or prevent the awardees from conveying their awarded lot,
and settle again in other places within the City as informal settlers, there is a need to pass this
ordinance and providing penalties for violation thereof.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of


lloilo, that:

Section 1. - Definition of Terms. -

a) Conveyance is defined as the act of transferring property including rights.


b) Awarded Relocation lot is defined as a lot awarded to the qualified
beneficiary located at the relocation site of the Iloilo City Government.
c) Underprivileged and homeless citizens refers to the beneficiaries ofR.A.
7279 and to individuals or families residing in urban and urbanizable ares
whose income or combined household income falls within the poverty
threshold as defined by the National Economic and Development
Authority and who do not own housing facilities. This shall include those
who lived in makeshift dwelling units and do not enjoy security of tenure.

Section 2. -It shall be unlawful for a relocation lot awardees to convey or sell is or her
awarded lot and for the buyer or transferee to buy or lease the same after knowing that the
subject lot is an awarded relocation lot.

Section 3. - Relocation site awardees caught violating this ordinance, after conviction,
shall suffer the penalty of six (6) months to one (1) year imprisonment at the discretion of the
Court, and perpetual disqualification from availing the relocation and housing program of the
Iloilo City Government. The subject lot of the conveyance shall be forfeited by the City
Government and the buyer or transferee of the subject lot shall likewise suffer the imprisonment,
after conviction, of three (3) to six (6) months at the discretion of the Court and a fine of
PS,000.00 with subsidiary imprisonment in case of non-payment.

Anybody, including but not limited to Government Officials and employees, who
facilitated the conveyance shall be, likewise, prosecuted, and in case of conviction, shall suffer
the imprisonment of three (3) to six (6) months.

Section 4. - The City Legal Office shall be responsible in rendering legal assistance to
the Iloilo City Urban Poor Affairs Office (ICUP AO) in filing the complaint and in prosecuting
the case.

Section 5 - The provisions of any ordinance or parts thereof inconsistent herewith are
hereby repealed and/or amended accordingly

Section 6. - This ordinance shall take effect ten (10) days after publication in a

newspaper of general circulation in the City of Iloilo.
