WHEREAS, there are several business firms in the City of Iloilo which install and place a
"Reserved Parking For Customers Only" signages even within public roads, public streets
thoroughfares and avenues;

WHEREAS, Regulation Ordinance Number 2009-216 provides for the duly established
parking spaces;

WHEREAS, public roads and thoroughfares are beyond the commerce of men and cannot be
appropriated exclusively for private use;

WHEREAS, the installation and putting up of "Reserved Parking for Customers Only"
signage within public roads and thoroughfares deprives the right of the public to freely enjoy and
make use of it;

NOW, THEREFORE, be it ordained, as it is hereby ordained by the Sangguniang


Panlungsod of the City of Iloilo, that:

Article I
DEFINITION OF TERMS

The word "public road" as used in this ordinance shall mean any road open and commonly used by
all, motorists and non-motorists, local and national and as provided by the City Government.

The word "open space" as used in this ordinance shall mean any road open and intended for public
use, which is beyond the right of easement of any private establishments.

The word "signage" as used in this ordinance shall mean a movable structure with painted signs
showing caution, attention or notice, which is placed or installed in a specific area designating
exclusivity of use showing a "Reserved Parking for Customers Only" and other markings or
structures, of whatever kind.

ARTICLE II
GENERAL PROVISIONS

Section 1. It shall be unlawful for any person, natural or juridical, to reserve a portion of
public streets, avenues, sidewalks, alleys and other public open spaces for his/her/its exclusive use as
parking space.

Section 2. In accordance with the preceding section, any individual, security guard, owner or
operator of establishments and business firms shall be prohibited from installing or putting up of
"Reserved Parking for Customers Only" signages and other markings or materials of any kind in
public streets, avenues, sidewalks, alleys and other public open spaces.

Section 3. Any peace officer, police officer, traffic auxiliary and the Task Force ASIS, are
authorized to remove the "Reserved Parking for Customers Only" signages and other markings or
materials of any kind placed in public streets, avenues, sidewalks, alleys and other public open
spaces, without prejudiced to the imposition of the penalties under Article III.

ARTICLE III
PENALTIES

Section 1. The penalty for violation of this ordinance shall be, as follows:

1st Offense - A fine of ONE THOUSAND (Php 1,000.00) PESOS;

2nd Offense -A fine of TWO THOUSAND (Php2,000.00) PESOS;

3rd Offense -A fine of FIVE THOUSAND (PhpS,000.00) PESOS


or imprisonment of not more than FIVE (5) DAYS
or both at the discretion of the appropriate court

ARTICLE IV
REPEALING CLAUSE

Section 1. All ordinances, executive orders, resolutions and regulations inconsistent herewith
are hereby considered repealed or modified accordingly.

ARTICLEV
SEPARABILITY CLAUSE

Section 1. In the event that any of the provisions of this ordinance and application thereof is
declared illegal, the validity of the other provisions shall not be affected by such declarations.

ARTICLE VI
EFFECTIVITY 0

Section 1. This ordinance shall take effect after ten ( 10) days from the date of its publication
in a local newspaper of general circulation in Western Visayas
