6. RECOGNITION OF INVOLVED CITIZENS BY CITY COUNCIL - Provides an
opportunity for the public to address the Council on items which are not on the agenda.
Comments should not be more than five minutes in length. The Mayor may adjust that

Approve Resolution No. 7849, a resolution setting the public hearing date to consider the
vacation of public roadway easement located north of CR 72, west of Marschall Road and
south of Eaglewood Drive.
Recommendation:
Staff recommends that the Council adopt the attached resolution setting a public hearing date
for the vacation of public roadway easement located north of CR 72, west of Marschall Road
and south of Eaglewood Drive.
Discussion:
The SMSC own property located north of CR 72, west of Marschall Road and south of
Eaglewood Drive. An easement was granted to the City in 1977 pursuant to Document No.
157910 for a road, which was never constructed. There are no plans for this road to be
constructed, nor support from the County to provide access to Marschall Road/CR 17 in that
location; therefore, they have asked that this easement be vacated. City staff support this
vacation, with conditions that a new roadway easement from Eaglewood Drive to 160th
Street/CR 72 be dedicated. The attached Resolution No. 7849 sets a public hearing date to
consider the vacation of the easement.

The attached resolution sets a public hearing for Tuesday, April 18, 2017. On that date,
comments from staff members and utilities, as well as a recommendation from the Planning
Commission, will be presented to the City Council for consideration. The Planning
Commission will consider the request at its April 6, 2017 meeting.

A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE


VACATION OF A PUBLIC ROAD EASEMENT

WHEREAS, it has been made to appear to the Shakopee City Council that a public
road easement for property located north of CR 72, west of Marschall Road and south of
Eaglewood Drive is no longer of public use or interest; and

WHEREAS, a public hearing must be held before an action to vacate can be taken
and two weeks published and posted notice thereof must be given.

WHEREAS, two weeks published notice will be given in the SHAKOPEE


VALLEY NEWS and posted notice will be given by posting such notice on the bulletin
board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post
Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the
Shakopee City Hall.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF


THE CITY OF SHAKOPEE, MINNESOTA, that a hearing be held in the Council
Chambers on the 18th day of April, 2017, at 7:00 P.M. or thereafter, on the matter of
vacating a public road easement for property located north of CR 72, west of Marschall

The Council is asked to offer Resolution No. 7852, a resolution of appreciation to Denny
Pauly.
Recommendation:
Staff recommends that the Council adopt the the resolution.
Discussion:
The Shakopee Fire Relief Association hosts a banquet each year to recognize those
firefighters who have retired in the past year with 20 or more years of service. This year
Denny Pauly will be recognized.

A RESOLUTION OF APPRECIATION TO DENNY PAULY

WHEREAS, the residents of the City of Shakopee have had the fortune of having the
services of capable and dedicated firefighters available for the past 134 years; and

WHEREAS, those individuals who are members of the Citys Fire Department devote
many hours of their time for training, practice, and responding to fires within the City and
surrounding areas; and

WHEREAS, Denny Pauly was a member of the Shakopee Fire Department for 23 years;
and

WHEREAS, Denny diligently and unselfishly served the residents of the City of
Shakopee while a member of the Shakopee Fire Department; and

WHEREAS, Denny served as a Captain, ensuring that all firefighters had the necessary
equipment along with being properly trained; and

WHEREAS, Denny faithfully responded to numerous fire and emergency calls regardless
of the untimeliness of said calls and personal and family disruptions; and

WHEREAS, on many occasions Denny put the health, safety and welfare of Shakopee
residents ahead of his own personal safety.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Shakopee
hereby extends its token of thanks and appreciation to Mr. Denny Pauly for his 23 years of
service to the Shakopee Fire Department and the community at large.

Recycling Grant for Spring Clean Up Day

Approve sub-grant program participation and funding.
Recommendation:
Staff recommends approval as in past sub-grant program participation and funding.
Discussion:
Scott County offers an annual sub-grant for recycling through the Minnesota Pollution
Control Agency (MPCA) Environmental Assistance Local Recycling Development Grant
(LRDG).

Cities and townships who provide a clean up event for their residents are eligible to
participate. The amount of funding is based on demonstrated need and population. Shakopee
has participated in this program for at least 23 years.

Upon approving the sub-grant participation and funding, two copies of a "Recycling Program
Agreement" will follow, each requiring execution. Last year's agreement is attached for
reference.
Budget Impact:
Funding in the amount of $10,701.12 is available to the City of Shakopee to assist with its
April 29, 2017 Clean Up Day event expenses. This amount includes $699.62 for Louisville
and Jackson Township residents participation in the event, as well as $500.00 for document
shredding service which is new for this year.

COUNTY OF SCOTT
RECYCLING PROGRAM AGREEMENT
THIS AGREEMENT, by and between the County of Scott, a body politic and corporate under
the laws of the State of Minnesota, hereinafter referred to as the "County," and the City of
Shakopee, Minnesota, a municipal corporation, hereinafter referred to as the "City', by and
through its City Council.

WHEREAS, the purpose of this Agreement is to establish a mechanism for distribution of


funds obtained from the Minnesota Pollution Control Agency for a "clean-up day''to be
held by the City in accordance with funding requirements for implementation and/or
enhancement of recycling programs in cities and townships within Scott County,
consistent with the County Solid Waste Master Plan; and

WHEREAS, Minn. Stat. Sect. 473.844'l , establishes the Local Recycling Development
Program, providing grants to counties to be distributed by the Minnesota Pollution Control
Agency; and

WHEREAS, Minn. Stat. Sect. 1 15A.557, establishes the County Waste Reduction and
Recycling Funding program and the framework for funds to be distributed by the
Minnesota Pollution Control Agency; and

WHEREAS, Scott County has received funding from the Minnesota Pollution Control
Agency, identified as Local Recycling Development Grant; and

WHEREAS, these funds are to be used for the activities specified in the Minnesota
Pollution Control Agency Grant Agreement and approved by the Scott County Board on
April '19, 2016; and

WHEREAS, the City intends to administer a city-wide recycling day which would qualify
for receiving funds.

NOW THEREFORE, in consideration of the mutual undertakings and agreement


contained within this Agreement, the County and the City hereby agrees as follows:

1. Compensation and Terms of Pavment

A. The County shall pay to the City a percentage of the grant money available through
the County for its one-day city wide clean up on April 30, 2016. The amount of funds
available for each Scott County municipality and township is based upon population
and a formulation used by the County to determine shares due to municipalities
under the program. This funding is to be used for the development and/or
enhancement of recycling programs.

The maximum amount of grant payment available to the City under this Agreement
is ten thousand forty four and 5't /'l 00 Dollars ($1 0,044.51 ).
B. Terms of Payment
'l . The County shall pay the City in one lump sum when the City has met the
requirements as specified in section 3 of this Agreement.

2. ln the event that another jurisdiction participates with the City event, the County
shall transfer that participating jurisdiction's allocated share in the program
funding to the City's share after receipt of a resolution from the participating
jurisdiction indicating involvement. lf any portion of the funding is to go to the
participating jurisdiction, it shall be the City's responsibility to ensure such
payment is made.

2. Condition of Pavment

All services provided by the City pursuant to this Agreement shall be performed to the
satisfaction of the County, and in accordance with all applicable federal, state and local
laws, ordinances, rules and regulations. Payment shall be withheld for work that is
found by the County to be unsatisfactory, or performed in violation of federal, state and
local laws, ordinances, rules or regulations.

3. Scope of Services

A. The City shall organize and facilitate a one-day clean up wherein it shall collect
materials from residents.

B. The City is further is obligated and agrees to the following:

1. AII recyclables shall be delivered to a licensed recycling facility.

2. Organic materials (yard and tree waste) shall be delivered to a


licensed/permitted yard waste compost facility or a permifted land application
s ite.

3. A written report shall be submitted to the County within ninety (90) days of the
event, identifying the quantities of materials recycled, the facility to which they
were delivered and processed, including actual expenditures and revenues.

4. Only expenditures used for the collection of recyclable material, which results in
waste reduction, are eligible for reimbursement from the County's Local
Recycling Development Grant. Any solid waste land filled is not included as
reimbu rsable expenditures.

5. The City shall advertise any neighboring jurisdiction's participation and allow its
residents to participate in the collection. ln the event that a neighboring
jurisdiction participates with the City's event, the City shall provide the
Authorized Agent of Scott County a copy of any and all such advertisements.
4. Effective Date of Aoreement

This Agreement shall be effective upon execution by all parties to the Agreement.

Term of Aqreement

This Agreement shall remain in effect until December 3'l ,2016 or until all obligations set
forth in this Agreement have been satisfactorily fulfilled or unless earlier terminated as
provided in section 13 of this Agreement.

7. Countv and State Audit

Pursuant to Minn. Stat. Section 16C.05, Subd. 5, the books, records, documents, and
accounting procedures and practices of the City relative to this Agreement shall be
subject to examination by the County and the State Auditor. Complete and accurate
records of the work performed pursuant to this Agreement shall be kept by the City for a
minimum of six (6) years following termination of this Agreement for such auditing
purposes. The retention period shall be automatically extended during the course of
any administrative or judicial action involving the County of Scott regarding matters to
which the records are relevant. The retention period shall be automatically extended
until the administrative or judicial action is finally completed or until the authorized agent
of the County notifies the City in writing that the records need no longer be kept.

d. lndemnitv

All parties to this Agreement recognize each other as a political subdivision of the State
of Minnesota. Each party mutually agrees to indemnify, defend and hold harmless the
other from any claims, losses, costs, expenses or damages resulting from the acts or
omissions of the respective officers, agents, or employees relating to activities
conducted by either party under this Agreement. Each party's obligation to indemnify
the other for all claims arising from a single occurrence under this clause shall be limited
in accordance with the statutory tort liability limitation as set forth in Minn. Stat. Sec.
466.04.

a Insurance

Each Party shall maintain public liability coverage protecting itself, its Board, officers,
agents, employees and duly authorized volunteers against any usual and customary
public liability claims in amounts which shall, at a minimum, complywith Minn. Stat. Sec.
466.04 and Workers' Compensation and shall be in accordance with the Minnesota
statutory requirements. Said policies shall be kept in effect during the entire term of this
Agreement.

10. Subcontracts

The City shall not subcontract any portion of the work to be performed under this
Agreement nor assign this Agreement without the prior written approval of the
authorized agent of the County. The City shall ensure and require that any
subcontractor agrees to and complies with all of the terms of this Agreement. Any
subcontractor of the City used to perform any portion of this Agreement shall report to
and bill the City directly. The City shall be solely responsible for the breach,
performance or nonperformance of any subcontractor.

11. Force Maieure

The County and the City agree that the Cig shall not be liable for any delay or inability
to perform this Agreement, directly or indirectly caused by or resulting from strikes, labor
troubles, accidents, fire, flood, breakdowns, war, riot, civil commotion, lack of material,
delays of transportation, acts of God or other cause beyond reasonable control of the
City and the County.

12. Data Practices

The City, its agents, employees and any subcontractors, in providing all services
hereunder, agree to abide by the provisions of the Minnesota Government Data
Practices Act, Minn. Stat. Ch. 13, as amended, and Minn. Rules promulgated pursuant
to Ch. 13. The City agrees to indemnify and hold the County, its officers, department
heads and employees harmless from any claims resulting from the City's unlawful
disclosure, failure to disclose, or use of data protected under state and federal laws.

'13. Termination

This Agreement may be terminated under the following circumstances:

A. By mutual written agreement of the parties;


B. By either party, with or without cause, giving not less than thirty (30) days written
notice, delivered by mail or in person to the other party, specifying the date of
termination.

14. Access to Premises

The City shall arrange access, as necessary, to work sites for the County for the
purpose of verification of any requirements as described in this Agreement.

't5. lndependent Contractor

It is agreed that nothing contained in this Agreement is intended or should be construed


as creating the relationship of a partnership, a joint venture, or an association with the
County and the City. The City is an independent contractor and neither the City, the
City's employees, agents, subcontractors nor representatives shall be considered
employees, agents or representatives of the County. Except as otheMise provided
herein, the City shall maintain, in all respects, its present control over the means and
personnel by which this Agreement is performed.

16. Notices

Any notices to be given under this Agreement shall be given by enclosing the same in a
sealed envelope, postage prepaid, and depositing the same in the United States Postal
Service, addressed to the City at its address stated herein, and to the authorized agent
of the County at the address stated herein.

17. Controllinq Law

The laws of the State of Minnesota shall govern all questions and interpretations
concerning the validity and construction of this Agreement and the legal relations
between the herein parties and performance under it. The appropriate venue and
jurisdiction for any litigation hereunder will be those courts located with the County of
Scott, State of Minnesota. Litigation, however, in the federal courts involving the herein
parties will be in the appropriate federal court within the State of Minnesota. lf any
provision of this Agreement is held invalid, illegal or unenforceable, the remaining
provisions will not be affected.

18. Successors and Assiqns

The County and the City, respectively, bind themselves, their partners, successors,
assigns, and legal representatives to the other party to this Agreement and to the
partners, successors, assigns, and legal representatives of such other party with
respect to all covenants of this Agreement. Neither the County nor the City shall assign,
sublet, or transfer any interest in this Agreement without the prior written consent of the
other.
19. Equal Emplovment and Americans with Disabilities

ln connection with the work under this Agreement, the City agrees to comply with the
applicable provisions of state and federal equal employment opportunity and
nondiscrimination statutes and regulations. ln addition, upon entering into this
Agreement, the City certifies that it has been made fully aware of Scott County's Equal
Employment Opportunity and Americans with Disabilities Act Policy, attached hereto
and incorporated herein as Exhibit A through both oral and written communications,
that it supports this policy and that it will conduct its own employment practices in
accordance therewith. Failure on the part of the Ci$ to conduct its own employment
practices in accordance with County Policy may result in the withholding of all or part of
regular payments by the County due under this Agreement unless or until the City
complies with the County policy, and/or suspension or termination of this Agreement.

20. Chanqes

The parties agree that no change or modification to this Agreement, or any aftachments
hereto, shall have any force or effect unless the change is reduced to writing, dated,
and made part of this Agreement. The execution ofthe change shall be authorized and
signed in the same manner as for this Agreement.

21 . Severabilitv

ln the event any provision of this Agreement shall be held invalid and unenforceable,
the remaining provisions shall be valid and binding upon the parties unless such
invalidity or non-enforceability would cause the Agreement to fail its purpose. One or
more waivers by either party of any provision, term, condition or covenant shall not be
construed by the other party as a waiver of a subsequent breach of the same by the
other party.

22. Entire Agreement

It is understood and agreed that the entire agreement of the parties is contained herein
and that this Agreement supersedes all oral agreements and negotiations between the
parties relating to the subject matter hereof as well as any previous Agreements
presently in effect between the County and the City relating to the subject matter hereof.

intending to be bound thereby.

POLICY STATEMENT

It is the policy of Scott County Government to provide Equal Opportunity to all employees and

As you may already know, Scott County offers sub-grants through the Local Recycling Development
Grant (LRDG) from the Minnesota Pollution Control Agency (MPCA). Whether or not you have indicated
in the past that your city or township is interested in being part of this subgrant, we feel it is important to
at least inform you of this opportunity each year.

lf your city or township is interested in providing a clean-up event within your jurisdiction, please respond
in writinq or e-mail at ssteuber@co.scott.mn.us no later than January 13,2017. Only those cities and
townships that respond by January 13, 2017 will be considered for this yeads Spring Clean-up
Day/s subgrant funding program. The amount of funding available to each city or township will be
based on the percent of population totals for only those cities and townships that respond by the
deadline.

Go or Veteran Shredding, for example, to offer on-site document shredding service to your residents with the

that choose to work cooperatively with cities shall notify the city and this Department. Following notification,
the townships' funds will be transferred to the city for the event. The city is required to acknowledge the
townshipis in all advertisements and accept the township's residents to participate in the event.

Once our Department has been notified which cities and townships are interested in this sub-grant program,
letters will be sent out that will include the exact amount your city or township can receive. Also you will be
sent an agreement to sign and forms that are to be completed after the event.

This letter is in response to your decision to participate in Scott County's sub-grant program for your
City's Recyclable Material Collection Day(s). The amount of funding available to each City or
Township is based on demonstrated need and population.

The amount of funding available to the City of Shakopee this year is $9,501.50. Due to Louisville and
Jackson Township's desire to join your City's event, their total funding amount of $699.62 will also be
transfened to you.

And because the City of Shakopee opted to offer a shredding document service on your one day
clean-up event, additional funding, not to exceed $500.00, will be added to your grant.

Consequently, the total potential funding amount for your City's Recyclable Material Collection Day(s)
will be $10,701.12.

You will be receiving two (2) Recycling Program Agreements that require signatures and one
agreement will be returned later for your records.

The City is responsible to acknowledge the participating Township(s) in all advertisements and invite
the Township residents to participate in the event. Please carefully read through the "Recycling
Program Agreement," paying particular attention to Section Two (2), Scope of Services. Any
municipal solid waste (MSW) and/or demolition/construction waste collected at your collection day
event that requires landfilling will not be funded with this county sub-grant program.

Before vour check can be issued, please submit the required follow-up information within g0 days of
your city's collection day event. This information will be provided by filling out and submitting the

Discussion:
Public Works has contracted park restroom cleaning services since 2003. We've been
satisfied with the cleaning and customer service provided by Treasure Enterprises and would
like to renew the contract for another year, April 1, 2017 to March 31, 2018.
Budget Impact:
Routine cleaning for the contract year is $31,526.44. Window and extra/deep/event
cleanings are additional, upon request.

ThiscontractisenteredintoasofApril1,2016andendsMarch31,2017byandbetweenthe
CityofShakopee(City)andTreasureEnterprises,Incorporated(ContractororTreasure
Enterprises,Inc.).

Now, therefore, in consideration of the promises and mutual obligation contained in this
agreement,thepartiescovenantandagreeasfollows:

I. DEFINITIONS

Words,phrases,orotherexpressionsusedinthesecontractdocumentsshallhavemeaningsas
follows:

1.1 Administrator shall mean the City Administrator of the City of Shakopee, Minnesota or
his/herdulyauthorizedrepresentative.

1.2 CityshallmeantheCityofShakopee,Minnesotaamunicipalcorporation,actingthrough
itsdulyappointedofficers,employees,agentsandrepresentatives.

1.3 CityCouncilshallmeantheCityCounciloftheCityofShakopee,Minnesota.

1.4 CodeofOrdinancesshallmeantheCityofShakopeeCodeofOrdinances.

1.5 Contractor means Treasure Enterprises, Incorporated and its duly authorized
representatives.

1.6 DateofContract,orequivalentwords,shallmeanthedatewritteninthefirstparagraph
oftheContractAgreement.

1.7 Day or days, unless herein otherwise expressly defined, shall mean a calendar day or
daysoftwentyfourhourseach.

1.8 FinanceDirectorshallmeantheDirectorofFinanceoftheCityofShakopee,Minnesota.

1.9 Subcontractorshallmeanandreferonlytoacorporation,partnership,firmorindividual
havingadirectcontractwiththeContractorforperformingworkinconnectionwiththis
contract.

II. GENERALCONDITIONS

2.1 CONTRACTORSOBLIGATIONS:

A. InstrictaccordancewiththetermsofthisContract(includingtheGeneralandSpecial
Conditions and Specifications below) and at its sole cost and expense, the Contractor
shall provide all of the labor, materials, necessary tools, expendable equipment,
supplies, vehicles, transportation services, required to perform and complete the
janitorialdutiesofthecontract.

B. AttachmentsA,B,C,Dwillhavetheworkingdetailsofthecleaningobligations.

2.2 TERMOFCONTRACT:

A. Thiscontractshallbecomeeffectiveonthe1stdayofApril,2017andshallremaininfull
forceandeffectthroughMarch31,2018.

B. Attheexpirationoftheinitialcontractterm,theCity,atitssolediscretion,mayextend
the contract for up to one (1) year each at the proposal price for the option years by
delivering written notice of its intent to extend delivery to Contractor at least two (2)
monthspriortotheexpirationdateofthiscontract.Theproposalpricefortheoption
years shall be, at minimum, the proposal price for 2017 adjusted by the percentage
increaseintheconsumerpriceindexforallurbanareas(CPIU)fromDecember2016to
December2017.

2.3 PAYMENT:

A. Afterserviceiscomplete,theContractorwillbilltheCitymonthlyfortheservices
includedinthiscontractinaccordancewiththechargessetforthinAttachmentCtothis
agreement.

2.4 CONTRACTORSACCIDENTPREVENTION:

A. TheContractorshallcomplywiththesafetyprovisionsofallapplicablelaws,regulations
andbuildingcodes,including,withoutlimitation,theinstallationandmaintenanceof
safeguardsonmachineryandequipment,theeliminationofhazards,andworkersafety
training.

B. TheContractorshallexerciseprecautionatalltimestoprotectthesafetyofpersonsand
property.

C. TheContractorshallimmediatelynotifytheCityofanyaccidentofanykind,which
involvesthegeneralpublicorprivateorpublicproperty,whichoccursduringthe
performanceofthisAgreement.

D. UponCitysrequest,theContractorshallprovidetheCitywithawrittenreportwithin
fortyeight(48)hoursincludingthedetailsofanysuchaccident.

2.5 DAMAGETOPROPERTY:

A. TheContractorshalltakeallnecessaryprecautionstoprotectpublicandprivate
propertyduringtheperformanceofthisAgreement.

B. Suchpropertydamageshallbeaddressedforrepairorreplacement,atnochargetothe
propertyowner,withinfortyeight(48)hourswithpropertyofthesameorequivalent
valueatthetimeofthedamage.

C. IftheContractorfailstoaddresstherepairorreplacementdamagedpropertyinwithin
fortyeight(48),theCitymay,butshallnotbeobligatedto,repairorreplacesuch
damagedproperty,andtheContractorshallfullyreimbursetheCitysforanyofits
reasonablyincurredexpenses.

D. TheContractorshallreimburseand/orprovideevidenceofaninsuranceclaim,theCity
foranysuchexpenseswithinten(10)daysofreceiptoftheCitysinvoice.

2.6 INSPECTION:

A. TheCitymayappointsuchInspectorsasitdeemspropertoinspecttheworkperformed
andContractorsfacilitiesforcompliancewiththecontractdocuments.TheContractor
shallfurnishallreasonableassistancerequiredbytheInspectorsfortheproper
inspectionofthework.

B. InspectorsandotherauthorizedrepresentativesoftheCityshallbefreeatalltimesto
performtheirduties.AnyattemptedintimidationofoneofthembytheContractoror
his/heremployeesshallbesufficientreason,iftheCitysodecides,toterminatethe
contract.

C. SuchinspectionshallnotrelievetheContractorfromanyobligationtoperformthework
strictlyinaccordancewiththecontract.

2.7 COMPLIANCEWITHLAWS,ORDINANCESANDREGULATIONS:

A. TheContractorshallbefamiliarwith,observeandcomplywithallordinances,laws,and
regulationswhichinanymanneraffectthoseengagedoremployedinthework,orthe
materials,facilitiesorequipmentusedintheproposedwork,orwhichinanywayaffect

theconductofthework,andshallprotectandindemnifytheCityanditsofficersand
agentsagainstanyclaimorliabilityarisingfromorbasedonanyviolationofsame.

B. IftheContractorshalldiscoveranyprovisioninthespecificationsorthecontract,which
iscontrarytoorinconsistentwithanylaw,ordinanceorregulation,he/sheshall
forthwithreportittotheAdministratorinwriting.

C. Amendmentstoexistingregulatorylawsandordinancesandenactmentofnewlaws
andordinancesshallnotserveasjustificationfortheContractortoterminatehis/her
obligationshereunder,unlesssaidamendmentsmakethecompletionofthiscontract
impossible.

2.8 TAXES,LICENSESANDPERMITS:

A. The Contractor shall pay all sales, use, property, income, and other taxes that are
lawfully assessed against the City or Contractor in connection with the Contractors
facilitiesandtheworkincludedinthiscontractandshallobtain,maintainandpayforall
licenses,permits,certificatesofauthority,andinspectionsrequiredfortheworkduring
thetermoftheContract.

2.9 INDEPENDENTCONTRACTOR:

A. TheContractorshallberesponsibleforthecompletesupervisionandcontrolofhis/her
Subcontractors. Notice to the Contractor shall be considered notice to the
Subcontractors.

B. TheContractoris,andshallremainforallpurposes,anindependentcontractor,andits
officers,employees,agents,orconsultantsshallnotbedeemedemployeesoftheCity,
nor shall they beentitled to any separate payment of salary, wages, or any employee
benefitsavailabletoemployeesoftheCity.

C. TheContractorshallbesolelyresponsibleforanysalaries,wages,benefits,feesorother
compensation,whichitmayobligateitselftopaytoanyofitsemployeesorconsultants.

D. Contractor agrees that during the term of this contract, or any extension of it,
Contractorshallnotassign,sell,orotherwisetransfermorethan10%of:(a)itsstockor
other beneficial ownership interest; (b) voting rights; or (c) assets, to any person or
party other than a member of the immediate family of an existing shareholder. A
breachofthiscontractandtheCitymayimmediatelyterminatethecontract.

2.10 ASSIGNMENTANDSUBCONTRACTING:

A. The Contractor shall not assign or subcontract the work, or any part thereof, without
thepreviousconsentoftheAdministrator,norshallhe/sheassign,bypowerofattorney
or otherwise, any of the money payable under this contract unless written consent of
theCityhasbeenobtained.Norightunderthiscontract,norclaimforanymoneydue
ortobecomeduehereundershallbeassertedagainsttheCity,orpersonsactingforthe
City,byreasonofanysocalledassignmentofthiscontractoranypartthereof,unless
suchassignmenthasbeenauthorizedbytheconsentoftheCityCouncil.

B. IncasetheContractorispermittedtoassignmoneysdueortobecomedueunderthis
contract,theinstrumentofassignmentshallcontainaclausesubordinatingtheclaimof
the assignee to all prior liens for services rendered and materials supplied for the
performance of the work and to any claims of the City arising out of or under this
contract.

C. Shouldanysubcontractorfailtoperforminasatisfactorymannertheworkundertaken
by him/her, his/her subcontract should be immediately terminated by the Contractor
upon written notice from the City. The Contractor shall be as fully responsible and
accountable to the City for the acts and omissions of his/her subcontractors, and of
personseitherdirectlyorindirectlyemployedbyhim/her,ashe/sheisfortheactsand
omissionsofpersonsdirectlyemployedbyhim.

D. Nothing contained in this contract shall create any contractual relation between any
subcontractor and the City. The Contractor and his/her Surety alone shall be held
responsibleforthefullandfaithfulperformanceofthiscontract.

2.11 GENERALINDEMNIFICATION:

A. The Contractor shall indemnify, keep and save harmless the City and its respective
officers,agentsandemployeesagainstallsuitsorclaimsthatmaybebaseduponany
injuryordamagetopersonsorpropertythatmayoccur,orthatmaybeallegedtohave
occurred, in the courseof the performance of this contract by theContractor, or as a
resultoftheperformanceofthiscontractbytheContractor,whetherornotitshallbe
claimedthattheinjurywascausedthroughanegligentactoromissionoftheContractor
or his/her employees, or his/her subcontractors or his/her or their agents or in
connection with any claim based on lawful demands of subcontractor, work person,
suppliers; and whether or not the persons injured or whose property was damaged
were third parties, employees or the Contractor or employees of an authorized
subcontractor; and the Contractor shall at his/her own expense defend the City in all
litigation, pay all attorneys fees and all costs and other expenses arising out of the
litigation or claim or incurred in connection therewith; and shall, at his/her own

expense,satisfyandcausetobedischargedsuchjudgmentsasmaybeobtainedagainst
theCity,oranyofitsofficers,agentsoremployees.

B. WhenrequestedbytheCity,theContractorshallsubmit satisfactoryevidencethatall
persons, firms or corporations who have done work or furnished supplies under this
contract, for which the City may become liable under the laws of the State of
Minnesota,havebeenfullypaidorsatisfactorilysecured.Incasesuchevidenceisnot
furnished or is not satisfactory, an amount may be retained from money due the
Contractorwhichwillbesufficient,intheopinionoftheCity,tomeetallclaimsofthe
persons, firms, and corporations as aforesaid. Such sum shall be retained until the
liabilitiesasaforesaidarefullydischargedorsatisfactorilysecured.

2.12 INSURANCE:

A. TheContractor(orCityApprovedsubcontractor)shallfurnishpriortocommencement
ofanyworkunderthisContractcertificate(s)ofinsuranceprovidinginsurancecoverage
asfollows:

(1) WorkersCompensationInsuranceCoveringallpersonsengagedinworkunder
thisContracttothefullstatutorylimitsstipulatedintheMinnesotaWorkmens
CompensationLaw.

(2) CommercialLiabilityInsuranceIncludingpremisesandoperationsandincluding
products/completedoperationswiththefollowingminimumlimits:
BodilyInjury&PropertyDamage$1,500,000/eachoccurrence

(3)CommercialVehicleLiabilityInsuranceIncludingowned,nonownedandhired
motorvehicles.
BodilyInjury&PropertyDamage$1,500,000/eachoccurrence

TheaboverequirementsshouldnotbeinterpretedtolimittheliabilityoftheContractor
underthisContract.

B. All insurers shall be either licensed or authorized to do business in the State of


Minnesota.

C. This coverage shall protect the Contractor, its employees, agents, representatives and
subcontractorsagainstclaimsarisingoutoftheworkperformed.TheCityofShakopee,
its agents and employees shall be included as additionally insured with respect to all
liabilitypoliciesherein.

D. A thirty (30) day cancellation clause with notice to the City of Shakopee shall be
included;wordsmodifyingthecancellationclausesuchasendeavortoprovidenotice
willbeunacceptableandmustbestricken.

E. It shall be the Contractors responsibility to provide similar insurance for each


subcontractorortoprovideevidencethateachsubcontractorcarriessuchinsurancein
like amount prior to the time such subcontractor proceeds to perform under the
Contract.

2.13 DEFAULTANDTERMINATION:

A. If the work to be done under this contract is abandoned by the Contractor; or if this
contractisassignedbyhim/herwithoutthewrittenconsentoftheCityCouncil;orifthe
Contractor voluntarily files for bankruptcy or is adjudged bankrupt; or if a general
assignmentofhis/herassetsismadeforthebenefitofhiscreditors;orifareceiveris
appointed for the Contractor or any of his/her property; or if at any time the City
determinesthattheperformanceoftheworkunderthiscontractisbeingunnecessarily
delayedorthattheContractorisviolatinganyoftheconditionsofthiscontract,orthat
he/sheisexecutingthesameinbadfaithorotherwisenotinaccordancewiththeterms
ofsaidcontract,thentheCitymayservewrittennoticeupontheContractorandhis/her
SuretyoftheCitysintentiontoterminatethiscontract.

B. Unless within ten (10) days after the serving of such notice by certified mail, a
satisfactoryarrangementismadeforcontinuance,thiscontractshallterminateandthe
Citymaytakeoverandprosecutetheworktocompletion,bycontractorotherwise.

C. IntheeventofdefaultornonperformanceonthepartoftheContractor,theContractor
anditsSuretyshallbeliabletotheCityforallexcesscostsustainedbytheCitybyreason
oftheCity.IntheeventtheCitycompletethecontractatalessercostthanwouldhave
beenpayabletotheContractorunderthecontract,ifthesamehadbeenfulfilledbysaid
Contractor,thentheCityshallretainsuchdifference.ShouldsuchcoststotheCitybe
greater, the Contractor and its Surety shall be liable for any pay the amount of such
excesstotheCity.

D. IntheeventofContractorsdefaultunderthetermsofthiscontract,allpaymentsdue
to the Contractor shall be retained by the City and applied to the completion of the
contractandtodamagessufferedandexpenseincurredbytheCitybyreasonofsuch
default,unlesstheSuretyontheperformancebondshallassumethecontract,inwhich
eventallpaymentsremainingduetheContractoratthetimeofdefault,lessamounts
due the City from the Contractor and less all sums due the City for damages suffered
andexpenseincurredbyreasonofsuchdefaultshallbedueandpayabletosuchSurety.

Thereafter,suchSuretyshallreceivemonthlypaymentsequaltothosethatwouldhave
beenpaidtheContractorhadsuchContractorcontinuedtoperformthecontract.

E. IftheCityterminatesthecontract,theCitymayprocuresuppliesorservicessimilarto
thosesoterminated,andthecontractor/vendorshallbeliabletotheCityforanyexcess
costsforsimilarsuppliesandservices,unlessthecontractor/vendorprovidesacceptable
evidencethatfailuretoperformthecontractwasduetocausesbeyondthecontroland
withoutthefaultornegligenceoftheContractor.

F. TheCitymayreleaseanybuildingorfacilitylistedonAttachmentCfromthecontractby
providing the Contractor with a minimum of 14 daysadvance written notice. Upon
release of any such building or facility, the City will no longer be obligated to make
paymenttotheContractorforthatbuildingorfacility.

2.14 FORCEMAJEURE:

A. WheneveraperiodoftimeisprovidedforinthisAgreementforeithertheCityorthe
Contractoraretodo orperformanyactorobligation,neitherpartyshallbeliablefor
anydelaysorinabilitytoperformduetocausesbeyondthecontrolofsaidpartysuchas
war, riot, unavoidable casualty or damage to personnel, materials or equipment, fire,
flood,storm,earthquake,tornadooranyactofGod,butnotstrikeorlockout.

B. Thetimeperiodfortheperformanceinquestionshallbeextendedforonlytheactual
amountoftimesaidpartyissodelayed.

2.15 PENALTIES:

A. TheAdministratorandhis/herdesigneeshallnotifytheContractorforeachviolationof
theContract,reportedtoordiscoveredbyhim/herortheCity.Itshallbethedutyof
the Contractor to take whatever steps may be necessary to remedy the cause of the
complaintandnotifyinwritingtheCityofitsdispositionwithintwentyfour(24)hours
afterreceiptofcomplaint.

B. Thefirstfailuretoproperlyperformanyitemofworkwillresultinwrittennotificationto
thecontractorbytheCityAdministratorand/orhis/herdesignee.Thesecondfailureto
properlyperformanyitemofworkwillresultinapenaltytothecontractor.TheCity
will reduce the amount of the penalty from the amount owed as payment to the
contractor.

2.17 SEVERABILITY:

A. If any of the provisions of this Contract are determined by a court of competent


jurisdiction to be invalid, such provisions shall be deemed to be stricken, and such
adjudicationshallnotaffectthevalidityoftheremainderofthetermsofthisContract
asawholeorofanysection,subsection,sentenceorclausenotadjudgedtobeinvalid
solongasthematerialpurposesofthisContractcanbedeterminedandeffectuated.

2.18 GOVERNINGLAWANDVENUE:

A. ThisContractshallbegovernedbythelawsoftheStateofMinnesota.

B. Venue for any action taken by either the City or the Contractor, whether in law or in

District,ScottCounty,Minnesota,andtheContractorherebywaiveswhateverrightsit

2.19 RIGHTTOREQUIREPERFORMANCE:

A. The Citys failure at any time to require performance by the Contractor of any of the
specifications in this Contract shall in no way affect the right of the City thereafter to
enforceit.

B. NowaiverbytheCityofanybreachofspecificationsinthisContractshallbetakenor
heldtobeawaiverofanysucceedingbreachofsuchspecificationsinthisContract,nor
shallsuchawaiverofasinglebreachbetakenorheldtobeawaiverofanyspecification
itself.

2.20 OPTIONTOCHANGESERVICE;AMENDMENTS:

A. The City shall have the option to change the service provided during the term of this
Contract, including, without limitation, changing the types of cleaning materials and
equipment used, times and/or days of service, and number and/or location of city
facilities.

B. The City shall exercise such option by serving written notice to the Contractor at its
designatedplaceofbusinessatleastten(10)daysbeforethedatesuchservicechange
iscontemplatedtobegin.

C. Immediately after written notice is served, the parties shall enter into good faith
negotiations concerning the terms, frequency, and the details of pricing the services
thatareprovided.

D. Any modification or amendments to this Agreement shall be in writing and shall be


signedbytheparties.

III. SPECIALCONDITIONS

3.1 CUSTOMERSERVICE

A. The Contractor shall establish and maintain a local phone number to which City
personnelmaycallorsendinquiriesandcomplaints,andfromwhichCitypersonnelmay
receiveinformationandinstructions.

B. The Contractor shall provide the Administrator with information concerning the
location, telephone number(s) and mailing addresses of the customer service office
established above, and any other facility that will be used in the provision of services
underthisContract.

C. The Contractor shall provide the Administrator with information concerning the

Contractorsdesignatedperson(s)forthepurposesofobtaininginstructions,answering
inquiries, and resolving complaints. Such persons shall be available to discuss, and if
necessarymeetwithCitypersonneltoresolveproblems.

D. The Contractor shall provide the City with at least one telephone number and email
address,whichmaybeusedbyCitypersonneltocommunicatewiththeContractorafter
regularbusinesshoursorduringanemergency.

E. The Contractor shall equip such office with a sufficient number of telephones and
personneltoaccommodateinquiries.

F. ExceptasotherwisedirectedbytheCity,contractorcustomerserviceshallbeavailable
atleastbetweenthehoursof8:00a.m.and4:30p.m.,MondaythroughFriday,except
duringholidays.

G. Inaddition,theContractorwillcommunicatebyemailwithCitystaffonaquarterlybasis
inordertodiscusstheperformanceofdutiescarriedoutbythecontractoraccordingto
thecleaningservicesspecifications.

3.2 EMPLOYEESANDCONDUCT:

A. TheContractorshallusecareanddiligenceintheperformanceofthisAgreementand
shall perform all janitorial services required by this Agreement in a neat, orderly, and
efficientmanner.

B. TheContractorshallprovideneat,orderly,andcourteouspersonnelforitsservicesand
shallprovidecourteousandknowledgeablepersonnelforitscustomerserviceoffice.

C. TheContractorshallprohibititsemployeesfromdrinkingalcoholicbeveragesorusing
anycontrolledsubstance,exceptpursuanttoadoctorsprescription,whileonduty,or
inthecourseofperformingtheirdutiesunderthisAgreement.

D. IftheCitydeterminesthatanyoftheContractorsemployeesisunfit orunsuitableto
perform the services under this Agreement as a result of intoxication, drug use, or by
virtue of abusive or obnoxious behavior, then, upon the Citys written request, the
ContractorshallremovesuchemployeefromworkwithintheCityandfurnishasuitable
andcompetentreplacementemployee.

E. All of the Contractors employees working within the City shall be required to wear a
shirtwiththeircompanynameandanAuthorizedCityContractoridentificationbadge
with a picture that clearly indicates that the Contractor employs the employee. The

Contractor will provide the shirt and the identification badge will be provided by the
City.

F. All of the Contractors vehicle operators working within the City shall carry valid state
driverslicensesfortheclassofvehicleoperated.Suchvehicleoperatorsshallobeyall
trafficregulations,includingweightandspeedlimits.

3.3 EQUIPMENT

A. AllequipmentusedintheperformanceofthisContract,shallbewhollyownedbythe
Contractor;provided,leasingorrentalagreementsorconditionalsalescontractsmaybe
allowedwhereapprovedbytheCity,inwriting,priortoexecutionofthisContract.The
equipmenttobeusedinperformanceofthisContractismadepartofthisContractby
reference.

B. No further encumbrance shall be placed upon any of such equipment without the
approval of the City, save that the Contractor may, without consent, mortgage or
otherwise encumber said equipment and facilities for the purpose of enabling the
Contractortoreplacethesameoraddthereof.

Discussion:
In 2005 City Council approved a formal policy for the inspection and maintenance of the
sanitary sewer system. Part of that policy requires the television inspection of sanitary sewer
mains every ten (10) years. Attached to this memo are the two quotes received for the 2017
televising project along with the project map.
Budget Impact:
Funding to be expended from the Sanitary Sewer Fund in which funds were budgeted in the
other professional services account.

Policy/Action Requested:
Authorize the appropriate city officials to enter into an extension agreement with WSB &
Associates, Inc. for the design of CSAH 16 and CSAH 15 improvements associated with
Windermere Development.
Recommendation:
In order to meet the timelines of development and to have county road design to State Aid
Standards and approval, the attached extension agreement needs to be executed.
Discussion:
Associated with the Windermere Development, the extension of CSAH 16 from CSAH 15
through the plat and CSAH 15 improvements for turn lanes at the intersection with CSAH 16,
needs final design to County and State Aid Standards. The developer is willing to pay for
WSB & Associates, Inc. to prepare final plans with the City and County contributing
appropriate cost shares. The timing is such for this development and improvements to be
done this year, design must start soon. Staff has met with county staff and developer and
have agreed to proceed with the citys consultant and with the developer agreeing to pay this
share. Attached is a letter from DR Horton agreeing to provide an escrow.
Budget Impact:
Staff has budgeted funds for the extension of CSAH 16 and for storm sewer along CSAH 15.

Staff recommends this purchase.
Discussion:
The 2017 Capital Equipment Budget identified a need to replace unit # 145 a 2007 F-550 for
the Park Maintenance Division. Staff will be utilizing State of Minnesota contract pricing #'s
- 109281, 116763 and 73056 for this purchase. Unit #145 will be retained for use by the
summer seasonal employee's.
Budget Impact:
Funding to come from the Capital Equipment Internal Service Fund.

Recommendation:
If City Council concurs, it should, by motion, Adopt Resolution No. 7846, A Resolution of

Grant Application for Quarry Lake Park.
Discussion:
In applying to the Outdoor Recreation Grant, the Parks and Recreation Department will
request funding to purchase two fishing piers and one pre-built shelter for Quarry Lake Park.
The plans for Quarry Lake include three total fishing piers around the lake, the city currently
has one pier that will be installed this spring. The plan also shows a small open air shelter. The
construction of this shelter is not included in any phase of the park at this time however with
funding assistance the shelter is highly desired prior to the large community building of Phase
III.
Grants are reimbursed up to 50 percent of the total eligible costs. The remaining 50 percent
"local share" can consist of cash or the value of materials, labor and equipment usage
provided by the local sponsor or by local donations or any combination thereof. The
maximum grant award is $150,000. The Minnesota Department of Natural Resources
requires an acknowledgement sign, supplied by grant program staff, be displayed at the main
entrance to the park.
Budget Impact:
The Parks and Recreation is requesting $70,000 in funding from the Outdoor Recreation
Grant. The City has the required 50% match ($70,000) from the Park Reserve Fund.

AUTHORIZING THE CITY TO SUBMIT AN OUTDOOR RECREATION GRANT PROGRAM
APPLICATION FOR THE QUARRY PARK PROJECT

WHEREAS, the City of Shakopee has completed Phase I of Quarry Park for reuse as a park,
recreation, and natural resource amenity; and,

WHEREAS, such a project will help improve the quality of life in the southwest metropolitan
area by providing a truly unique amenity; and,

WHEREAS, the City is seeking funding assistance to purchase two fishing piers and one pre-
built shelter to progress the vision set forth in this project.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF


SHAKOPEE, MINNESOTA, that the City of Shakopee (The City) will act as legal sponsor for the
project contained in the Outdoor Recreation grant application to be submitted on March 31, 2017 and
that appropriate City staff are hereby authorized to apply to the Department of Natural Resources for
funding of the Quarry Park Project on behalf of the City.

BE IT FURTHER RESOLVED that the City has the legal authority to apply for financial
assistance, and financial capability to meet the match requirement of 50% from the Park Reserve
Fund.

BE IT FURTHER RESOLVED that the City has not incurred any development costs related to
project work described in the grant application.

BE IT FURTHER RESOLVED that the City has acquired fee title over the land described in the
site plan included in the application.

BE IT FURTHER RESOLVED that upon approval of its application by the state, the City may
enter into an agreement with the State of Minnesota for the above-referenced project, and that the
City certifies that it will comply with all applicable laws and regulations as stated in the grant
agreement including dedicating the park property for uses consistent with the funding grant program
into perpetuity.

NOW, THEREFORE BE IT RESOLVED that appropriate city officials are hereby authorized to
execute such agreements as are necessary to implement the project on behalf of the applicant
following final approval from City Council.

Discussion:
D.R. Horton own property formerly known as 12466 Marystown Road (see attached legal
description and drawings), which is presently included in the proposed Windermere Plat
application. The roadway easement pertained to a driveway and utilities that led to a
residential structure. That structure no longer exists; therefore, that easement is no longer
necessary.

They are presently in to Preliminary Plat property that includes this easement, which requires
a vacation of that existing easement. Should this vacation be approved, they will provide
new public easements with their Windermere Final Plat, consistent with City and SPUC
recommendations.

City departments, Scott County and other outside agencies were given the opportunity to
review and provide comments regarding this application. Planning staff have received
comments that new easements will be required with the new Windermere Plat, consistent
with City Code requirements. Those conditions will be incorporated into the Windermere
First Addition Preliminary Plat Resolution.

The public hearing notice has been published for this March 21, 2017 City Council meeting.
Recommended conditions of approval from staff members and utilities have been

Policy/Action Requested:
Offer a motion to adopt Ordinance No. 959, an ordinance adding schools licensed by the MN
Department of Education serving students in grades Kindergarten - 12th Grade as a listed
Conditional Use in the B-1, Highway Business Zone.
Recommendation:
At the March 9th Planning Commission meeting, the Planning Commission recommended
approval of the proposed text amendment by a vote of 5-1.
Discussion:
Planning staff are proposing a zoning text amendment to allow schools licensed by the MN
Department of Education that serve students in grades Kindergarten 12th grade in the B-1,
Highway Business Zone as a conditional use.
Currently, the educational uses of childcare / pre-schools and colleges and universities are
permitted conditionally in the Highway Business zone. Other institutional uses, such
as clinics, churches, and public buildings are allowed in the B-1 zone. Staff believes schools
are a similar use to other listed institutional uses in the zone and is proposing a text
amendment. A copy of the B-1 zoning district regulations is attached.
Planning staff believes Highway Business properties are also an appropriate location for
schools, as sites are typically adjacent to collector and arterial roadways, which allows for
public transit to serve students at future schools that dont receive traditional bus service.
Many of the existing schools in residential zones have accesses to collector / arterial
roadways (East Junior High, West Junior High, Shakopee High School, Sweeney, Pearson,
Sun Path, and Jackson). Currently, schools for students in grades K-12 are permitted
conditional uses in the residential zones, except R-4, High Density Residential Zone.
A charter school has submitted a conditional use permit application for a site in Shakopee
Town Square; with the hope of this text amendment being approved. If the text amendment is
approved by the City Council, the charter schools conditional use permit would be reviewed
at the April 6th Board of Adjustment Meeting.

AN ORDINANCE OF THE CITY OF SHAKOPEE APPROVING AN AMENDMENT TO


CITY CODE SECTION 151.040 (HIGHWAY BUSINESS ZONE, B-1), SUBDIVISION C
(CONDITIONAL USES)

WHEREAS, The City of Shakopee has proposed amendment to the Zoning Ordinance
regarding the addition of schools licensed by the Minnesota Department of Education serving
students in grades kindergarten through 12th grade as a listed conditional use in the B-1,
Highway Business Zone; and

WHEREAS, notices were duly sent and posted, and a public hearing was held before the
Planning Commission on March 9, 2017 at which time all persons present were given an
opportunity to be heard; and

WHEREAS, the Planning Commission recommended that zoning ordinance be amended


to add schools licensed by the Minnesota Department of Education serving students in grades
kindergarten through 12th grade as a listed conditional use in the B-1, Highway Business Zone;
and

WHEREAS, the City Council heard the matter at its meeting on March 21, 2017; and

THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:

Section 1 That City Code Chapter 151 (Zoning) is amended to add the language as follows:

Department of Education serving students in grades kindergarten through 12th grade as a listed
conditional use in the B-1, Highway Business Zone.

Criteria #1 That the original zoning ordinance is in error;


Finding #1 The original zoning ordinance is not in error. Other institutional and educational
uses are allowed by conditional use permit in the B-1 Zone, such as daycare
centers and colleges and universities.
Criteria #2 That significant changes in community goals and policies have taken place;
Finding #2 Significant changes in community goals and policies have taken place. There is a
need for additional sites to be available for the development of educational uses
in the community. Highway Business zoned properties are appropriate because of
their proximity to collector and arterial roadways and public transit.
Criteria #3 That significant changes in City-wide or neighborhood development patterns have
occurred;
Finding #3 Significant changes in development patterns have not occurred. The proposed text
amendment allows for a similar use to other uses that are already allowed in this
zoning district.
Criteria #4 That the Comprehensive Plan requires a different provision;
Finding #4 The Comprehensive Plan does not require a different provision.

Section 3. Effective Date. This ordinance shall be in effect from and after the date of its
passage and publication.

Preliminary Plat and Planned Unit Development (PUD) of Ridge Creek
Policy/Action Requested:
Approve Resolution No. 7851, approving the Preliminary Plat and PUD of Ridge Creek, with
conditions, and move its adoption.
Recommendation:
On March 9th, the Planning Commission recommended that the City Council approve the
PUD and Preliminary Plat by a vote of 6-0. Staff also recommends that the Council approve
the Preliminary Plat and PUD.

Lennar Homes has applied for approval of the Preliminary Plat and PUD of Ridge Creek. The
property is located south of CSAH 21, North of CSAH 16 (Eagle Creek Blvd), east of Pike
Lake Road, and west of Riverside Bluffs (see attached map). The proposal involves the
development of 104 single-family residential lots and the dedication of 38 acres of open /
ponding space. The property is currently zoned R-1B, Urban Residential. All surrounding
development on the north side of Eagle Creek Blvd and south of CSAH 21 is zoned R-1B.
The PUD request involves the following adjustments to City Code:
Filling of a small amount of wetland for the extension of Crossings Boulevard
A small amount of grading in wetland buffers
Allowance of 7.5' side yard setbacks.
Reduction in street width from 37' to 34' for residential streets
Allowing grading within the 30' setback to the top of a bluff.

The applicant had originally proposed a variance to allow part of their building pads on a
small number of lots to encroach into the bluff impact zone setback, but has revised their plan
to not impact the bluff impact zone with building pads, but have a small amount of grading
within 30' of the top of the bluff. The subdivision meets all other design standards of the R-
1B zone and City Code.

As proposed, a 30.26 acre section of wetlands (Outlot A) in the subdivision south of


Crossings Boulevard that contains the Prior Lake Outlet Channel would be dedicated to the
city and part of the outlot would be used for stormwater ponding.

Multiple agencies, including the Prior Lake - Spring Lake Watershed District and Army Corps
of Engineers would be involved in the review of trail development and wetland enhancement.
Planning Staff believe the wetland area should be an amenity to this development and
surrounding area, rather than left in the current state. The Prior Lake - Spring Lake
Watershed District has expressed interest in improvements in the channel in this area, as the
channel currently has a ninety-degree turn on this site, which is undesirable for drainage. The
City would intend to pursue trail development and enhancement of the wetlands after taking
possession of the Outlot. It is the Planning Department's recommendation that the Park
Dedication fees collected from this development be used in conjunction with stormwater
funds to enhance the wetland areas and provide trails and possibly boardwalks to connect to
the existing trail network to the east and west of this development.

House Design:
Lennar is proposing to develop single-family houses (sample floorplans and elevations
attached), with the ability to build their NextGen product line. The style of houses are
ramblers, two-story, and 1.5 story houses. The NextGen houses are a single-family house with
an additional suite intended for a family member, such as an elderly parent. The Zoning
Administrator has determined that NextGen houses still qualify as a single-family residence if
there is not completely self-contained residential facilities in the suite, such as laundry and a
full kitchen, and that access to the unit from the rest of the house is not restricted by a
deadbolt lock, or access is only by a separate entrance. Lennar has stated that NextGen
houses represent less than 10% of their sales in this market.

The applicant is proposing a range of lots with a minimum width of 65'. The average area of
the lots is 11,980 square feet (0.27 acres). 55 of the lots are 70' or wider. As proposed with
7.5' sideyard setbacks, all building pads are at least 50' wide, allowing for 3-stall garages.

Street Design:
The proposed subdivision is located between Ridgeview Estates and Riverside Bluffs,
allowing for the completion of the planned street extensions of Oakridge Trail and Crossings
Boulevard. Lennar is also proposing two looped streets (Eagle Ridge Loop and Willow Way),
two cul-de-sacs (Red Oak Path, Ridge Creek Trail), and a connector street (Ridge Creek
Trail). Planned street width is 34' wide for new neighborhood streets. Oakridge Trail and
Crossings Boulevard are planned to be 37'. Staff believes the development of two cul-de-sacs
is acceptable because of the challenges to development of the site due to topography,
wetlands, and the adjacent county roads. This site is a challenging site to develop because of
the topography, woodlands, wetlands, and existing road alignments.

Active Living Design:


Lennar is planning to provide the following pedestrian / bicycle connections:
Complete the trail section along Eagle Creek Blvd, filling a key trail gap in eastern
Shakopee between CSAH 21 and Dakota Crossing.
Providing sidewalks on one side of Oakridge Trail, Willow Way, Ridge Creek Trail,
Eagle Ridge Path, and Red Oak Path.
Providing two connections to trail on CSAH 21 and one connection to trail along Eagle
Creek Blvd.
Construction of both trail and sidewalk along Crossings Boulevard
Staff is recommending that a sidewalk be added to the north side of Ridge Creek Trail, so the
sidewalk is continuous on this street.

Infrastructure:

At the time of development of Riverside Bluffs, Mattamy Homes approached the previous
property owner of this site about a cooperative grading project for the southeast portion of
the site. The previous owner was not interested in allowing Mattamy Homes to grade onto
their property, so the back yards on the west side of River Bluff Court have a significant
slope up to this site.

Lennar plans to work with residents to reduce the slope in their backyards. Creating a more
usable back yard and reducing the elevation difference of lots on Eagle Ridge Loop to lots on
River Bluff Court benefits the developer, current, and future residents. Staff supports the
applicant working with adjacent residents.

An 8" watermain connection is required across CSAH 21 into the Southbridge Development.
The applicant is working the impacted residents in Southbridge and Shakopee Public Utilities
on making this connection in a 22" casing.

Stormwater retention ponds are proposed on both Outlot A and Outlot B.


Stormwater pipes are proposed in the rear yards of some of the lots.

An existing Centerpoint Energy gas transmission line is located on the northeast part of the
site in a 66' easement, which would be in the rear yards of 7 lots. Planning staff recommends
that Lennar notify future owners of these lots about the gas easement and its location.

Natural Resources:
This development has an upper and lower area, which are not directly connected by streets
within this development. Lots on the north side of Oakridge Trail are on a wooded slope that
qualifies as a bluff in some areas. The developer has combined the two westernmost lots to
eliminate impacts to the bluff impact zone and comply with the bluff setback for structures.
The most dense woodland area is bluff area and the area on the southwest part of the site
south of the extension of Oakridge Trail. The bluff area will be preserved by a conservation
easement, many trees south of Oakridge Trail are proposed to be removed and will require
replacement.

The applicant is required to plant replacement trees based on the number of caliper inches
removed. The number of replacement trees required is 365, the applicant is proposing to plant
440 replacement trees. The trees will be planted throughout the development on the
residential lots and also along the adjacent highways as screening, as shown on L1-L3 in the
plans. The planting schedule for pond and prairie areas in the open space is shown on page
L3.

Review Comments Received:


This request was reviewed by other departments and outside agencies, memorandums from
Parks and Recreation, Engineering, Scott County, and Shakopee Public Utilities are attached
for reference.

Planning Commission Recommendation:


At the March 9th Planning Commission meeting, the Commission reviewed this application
and recommended City Council approval of the preliminary plat and PUD by a vote of 6-0.
Budget Impact:
Once a final plat is approved and recorded, tax revenue from this site will increase.

The staff review indicates a request to review a Preliminary Plat and Planned Unit Development
(PUD) application for the Ridge Creek Addition, a single-family subdivision. Ridge Creek
Addition is located east of Pike Lake Road and south of County Road 21. This review should be
considered preliminary, as more comments will follow with additional submittals. However, the
public works department offers the following comments at this time to the applicant and to the
planning department:
Engineering:
The following items need to be addressed/completed prior to release of the Final Plat for
recording:

1. Execution of a Developers Agreement, which needs to include provisions for security


for public improvements within the subdivision and payment of the Street and Utility Fee
and the Watermain Fee.
2. Payment of all Storm Water Management Plan Review Fees need to be made, as required
by the most current City of Shakopee Fee Schedule.
3. Payment of the Trunk Sanitary Sewer Charge needs to be made, as required by the most
current City of Shakopee Fee Schedule.
4. Payment of the Trunk Storm Water Charge needs to be made, as required by the most
current City of Shakopee Fee Schedule.
5. Payment of the Sign Installation Fee needs to be made, as required by the most current
City of Shakopee Fee Schedule.
6. Payment of the Bituminous Sealcoat Fee needs to be made, as required by the most
current City of Shakopee Fee Schedule.
7. The applicant will submit a detailed contractors bid for all public improvements
associated with this subdivision.
8. The applicant will submit a detailed lot area drawing showing the total plat area, the total
drainage and utility easement area encompassing high water levels of wetlands/storm
water basins, the total area of right-of-way, the total area of conservation easements and
outlots, the total area of bituminous street and the total area of lots.
9. The applicant shall have an approved wetland replacement plan addressing the proposed
impacts.
10. The applicant will need final approval of the subdivisions storm water management
plan.
11. Outlots A and B need to be deeded to the City of Shakopee.
12. The applicant will provide adequate wetland buffers and associated easements/outlots as
set forth in Section 54.32 of our Code of Ordinances.

13. Easements will be shown on the Final Plat as approved by the City Engineer. They
include, but are not be limited to, the following:
The applicant will provide minimum widths of drainage and utility easements as set
forth in Section 10.1 (A-D) of the City of Shakopee Design Criteria.
Provide a minimum of 15 feet of drainage and utility easement adjacent to the County
Road 16, County Road 21 and Crossing Boulevard rights-of-way.
14. Provide electronic files (AutoCAD and Portable Document Format PDF) of the Final
Plat to be recorded with datum on the Scott County coordinate system.

The following items need to be addressed/completed prior to approval of a grading permit, a


street and utility plan and/or a building permit:

1. The applicant will need final approval of the subdivisions storm water management plan.
2. The applicant will grade the entire site, as proposed on the approved plans, in one phase
within one year from the date of approval of the grading permit application. Grading is
defined as bringing the site to the proposed finished grade with materials deemed
acceptable by the City of Shakopee engineering department, providing topsoil per City
requirements and applying seed, mulch and/or sod per City requirements and providing
an as-built record grading plan per Section 2.5 of the City of Shakopee Design Criteria.
3. Class IV fieldstone riprap and geotextile fabric will be placed at each flared end section.
The riprap and fabric will be installed to the bottom of the storm water basin.
4. The applicant will work with the City of Shakopee to eliminate lots with public utilities
on both side lot lines.
5. Storm manholes will need to be added in order to reduce flow velocities at flared end
sections to an acceptable rate. This rate will be determined by the engineering division.
6. The applicant will seed the disturbed storm water basin area with a native vegetation.
The seed mixture, application and maintenance requirements will be determined by the
City
7. The applicant will install trunk sanitary sewer to south property line as directed by the
engineering division.
8. The applicant will provide vertical street curves that comply with city requirements,
unless otherwise approved by the city engineer.
9. The applicant will submit detailed pavement design calculations.
10. The applicant will submit a landscaping plan in compliance with the most recent version
of the City of Shakopees Easement Fencing and Landscaping Policy. If the applicant
wishes to vary from these requirements, a detailed subdivision-wide utility service
corridor plan will need to be submitted for review.
11. Record plans need to be provided per the City of Shakopee Design Criteria, Section 2.5
and Section 11.2 (A-L). The record plans need to be submitted to the engineering
department.
12. Identify EOFs for all catch basins, wetlands and ponds. Rear yard catch basins,
wetlands and ponds should have an EOF route clearly marked on the plans.
13. Revise the grading between Lots 7 and 8, Block 1 to ensure slopes do not exceed 3:1.

1. The applicant needs to provide a detailed justification for not provided adequate buffer
widths adjacent to the existing wetland in Outlot B.
2. The applicant will need conditional approval of a wetland replacement plan addressing
the proposed impacts.
3. The applicant will need conditional approval of the subdivisions storm water
management plan.
4. The applicant shall provide soil borings to determine the allowable low floor elevations
adjacent to Outlot B.
Natural Resources
1. Crossings Boulevard shall have a minimum eight foot wide planting strip between the
back of curb and trail/sidewalk. A trail easement shall be given for any portion of the
trail which is outside of the city right-of-way, plus an additional two feet beyond the
trail.
2. Soil modification within the planting strips on Crossings Boulevard is required as
approved by the city engineer.
3. Tree planting/landscaping done within the city right-of-way or easements must be
approved by the city engineer. This includes but is not limited to species selection,
location, quantity, sizing, maintenance, installation schedule, and warranty.
4. Due to road alignment on the adjacent property, a 30 foot bluff impact zone is to be
used. The applicant is required to minimize and justify any impacts to the bluff
impact zone.
5. A joint trench is required for all underground wire utilities. The location of the joint
trench, utility coordination plan, and installation schedule is to be approved by the
city engineer before building permits are issued.
6. A right-of-way permit is required before installation of any utilities within city right-
of-way or easements.
7. In the case of restoration in lieu of replacement trees, any restoration done on or
adjacent to the bluff and bluff impact zone must equal the monetary and ecological
value of replacement trees not replanted onsite, per city code 151.113. A portion of
the landscaping/tree replacement financial security shall be held for a minimum of
three full years to ensure establishment. The portion held shall never be reduced to
less than 125% the amount to ensure the completion of the contract as shown on the
plan approved by the city engineer.
8. The applicant must meet all vegetation establishment requirements within stormwater
areas and city outlots, as approved by the city engineer.
9. Preliminary plat approval is contingent on the applicant providing a wetland
replacement plan meeting the requirements of approval by the city engineer.
10. The area identified as bluff, and bluff impact zone shall be dedicated to the city as a
conservation easement. Posts shall be installed by the applicant on each property
corner identifying the boundaries and attach signage provided by the city. Areas
within the bluff impact zone which are impacted shall not be included in the
easement.

following comments:

The County recommends a 15 foot minimum drainage and utility easements for the properties adjacent
to CSAH 21, especially for Lot #1 in Block #5.

The minimum right-of-way dedication for CSAH 16 is 75 feet of right-of-way from the center of
roadway.

A trail shall be developed along CSAH 16.

Noise issues may arise as traffic volumes increase on the County roadways over time. Noise
attenuation for the platted lots is the responsibility of the City and/or developer.

No ponding, berming, landscaping, or signage shall be permitted within the County right-of-way.

Any work within the County right-of-way shall require a County permit.

INTRODUCTION
The Parks and Recreation Advisory Board has reviewed the preliminary plat proposal
application for the Ridge Creek development on February 13, 2017. The PRAB
recommends to the Planning Commission and City Council the following conditions:

1. Park dedication fees in the amount required by the City Code and adopted City fee
schedule shall be paid at the time of recording of the final plat.
Preliminary park dedication calculations (to be confirmed at time of final plat) are as
follows:

$5,340/lot X 101 lots = $539,340

2. The applicant to provide a trail connection along County Road 16 to tie into the trail
to the east and west.

3. The applicant to provide a trail connection along the north side of Crossings
boulevard and a sidewalk along the south side of Crossings Boulevard.

4. The applicant to provide an eight-foot trail connecting Street C to trail along CR 21.

5. The applicant is required to install sidewalk on one side of all residential streets.

6. The applicant is required to construct maintenance trails along the ponds or drainage
ditch at the time the wetlands are restored or the drainage ditch is improved or
moved (if part of the development project).

7. All trails and sidewalks be constructed to meet ADA requirements or guidelines.

8. Wetland, ponding areas, drainageways, and utility easements accepted by the city
shall not be considered in the park land and/or cash contribution to the city.

9. The applicant shall provide and install open space, and trail boundary signage as
determined to be needed by the city. The city shall provide the signage for open
space and trail boundary, and the applicant provide the posts and installation of the
signage.

The preliminary plans for the Ridge Creek Development were reviewed for compliance with the City of
Shakopee Ordinances. The project was also reviewed for compliance with the Joint Powers Agreement
(JPA) with the Prior Lake Spring Lake Watershed District. The JPA regulates the flow to the Prior
Lake/Spring Lake Outlet Channel. The following documents were submitted for our review:

Based on our review of the submitted documents, at this time we have concluded the following:

o The proposed stormwater management for this project effectively demonstrates


conformance with City and JPA rate control standards.
o City and NPDES Construction Stormwater Permit water quality goals are met through the
construction of NURP basins as proposed.
o A variance was requested for City and NPDES Construction Stormwater Permit volume
reduction goals due to the presence of shallow groundwater and nearby wetlands. Our
recommendation is that the variance be granted.

The following comments are offered for your consideration:

Grading, Drainage, Easements, Utility and Erosion Control Comments:

1. General
a. The stormwater report should be signed by a licensed professional engineer. The
signature block for the report was left unsigned.
b. Section II.B of the Stormwater Management Report should be updated to include a
discussion of the large wetland complex in Outlots A and F, along with any modifications
to the stormsewer or drainage patterns. The Planset indicates that there are culverts to
be removed per EOR Memo. For completeness, this memo and any related modeling
should be included as an Appendix to the report.
c. The City of Shakopee allows orifices that are a minimum of 8 in diameter. The proposed
stormwater management for the site includes a 3 orifice at Basin 400, a 5 orifice at
Basin 300 and a 6 orifice at Basin 100. The Stormwater Management Report indicated
that the orifices were sized in order to meet the City rate criteria of 0.1 cfs per acre for a
100 year storm event. The City allows a variance for this standard if an 8 orifice is
designed such that the detention area draws down to within one foot of the normal run-
out elevation within 72 hours following the onset of a 100-year rainfall event. The model,

report and planset should demonstrate that this is achieved with the associated modeled
HWL and a minimum 8 orifice.
d. Because this site falls within the Blue Lake District upstream of Deans Lake, the City
requires that the improvements limit the peak discharge rate to 1/20 cfs per acre for a 10-
year TP40 storm event, unless it can be shown that it is not feasible. Currently, Basin 6
and basin 6P do not meet this standard. The other basins also do not meet this
standard, however, as mentioned previously, the outlets need to be redesigned with a
larger (8) orifice so achieving lower rates is unlikely.
e. Based on the observed groundwater level of 749 feet to 750 feet reported in the
Stormwater Management Plan, there is a concern of groundwater impacts around the
proposed stormwater basins. All of the basins have a dead pool volume that falls below
749 feet. It is recommended that the basins are lined in order to avoid adverse
groundwater impacts.
f. The proposed stormwater management for this project connects to an existing
stormsewer to the east (behind Lots 15 and 16 on Street B). The stormwater report and
design calculations should demonstrate that the existing system has adequate capacity
for the proposed runoff entering the system.
g. Page 8 of the Stormwater Management Plan inaccurately states, in bullet 3 under Section
2, that the basins water quality volume is calculated as inch of runoff from the new
impervious surfaces created by the project. This should read 1 inch of runoff.

2. Grading Plans
a. The ponds should have defined access/ maintenance roads consistent with City Design
criteria. Maintenance access to Basin 100 does not appear to be adequate. It does not
appear that there is adequate space for a maintenance equipment (i.e.backhoe) to
access the basin.
b. All pond outfalls should have riprap to the pond bottom.
c. The inlet and outlet locations of Basin 100 create short circuiting within the basin. This is
generally not ideal for the best water quality performance of the basin. It is
recommended that the inlet and outlet locations be reconsidered in order to allow for a
longer flow path and residence time within the basin.
d. EOF spot elevations at road low points and rear yard depressions are missing at several
locations within the plan set and need to be added. For example, Sheet 8 has several
backyard drainage areas that do not show an EOF.
e. The ponds should have an EOF route clearly labeled and designed to City requirements.
Basin 6/6A, Basin 100, Basin 300 and Basin 400 do not have an EOF identified and
labelled in the Planset. Demonstration that the EOFs are adequate to control the 100-
year Atlas 14 storm event is required.
f. The NWL for the large wetland area (in Outlots A and F) is not shown in the plans and
should be added.
g. The City prohibits work in areas having steep slopes (>12%). On Sheet 8 the backyards
of Lots 7 through 10 on Oak Ridge Trail indicates slopes greater than 12%. Updates to
the grading plans in this area are required for conformance.
h. Grading on Sheet 8 shows runoff directed toward Lot 9 on Oak Ridge Trail. It is
recommended that drainage between lots 8 and 9 be modified to avoid flood risk to Lot 9.
i. A secondary erosion control fence is recommended on Sheet 13 along the bluff line, due
to steep slopes.
j. Inlet protection is required at all culvert inlets. There are several control structures that
do not show inlet protection, for example at Basin 100 on Sheet 13.

3. Utility Plans
a. The City requires skimmer structures for all new pond outlet structures. The model,
report and planset should be updated to include skimmer structures.
b. Catch basins in non-paved areas must be placed on property corners and property lines
when possible.
c. Haul routes should be added to Sheets 13 and 14.

4. HydroCAD Model
a. The HydroCAD model should include the large wetland complex located within the overall
site drainage.
b. The HydroCAD model should include several of the backyard depression areas in order
to establish a HWL and confirm that there is adequate freeboard during a 100-year storm
event. For example, Sheet 8 includes a depression area with a control structure behind
Lots 9 and 10 of Street B.
c. The HydroCAD model should include a NWL for the wetland along with documentation of
how that was defined (i.e. per the wetland delineation report or other means).
d. The HWL for the wetland should be modeled and reflected in the HydroCAD model or
used as a beginning condition for the 100-year storm event model in order to incorporate
tailwater impacts to the upstream ponding areas (Basin 100 and Basin 300).
e. Emergency overflow from each of the ponds should be modeled as a secondary outlet.
f. It is unclear if the outlet control structures are modeled accurately because a standard
detail for the outlet control structures was not submitted.
g. The model should be updated to include an MSE3 rainfall distribution for the Atlas 14
storm events.
h. The full HydroCAD report should be exported and included in the stormwater report, with
error messages turned on.
i. The HydroCAD model should reflect the updated outlet control structures at each of the
basins, as previously mentioned. The Planset should show the updated NWL and HWL
at each of the basins.

5. Volume Control
a. Infiltration in this area is not feasible due to high groundwater elevations and wetland
areas. As such, the proposed stormwater management report requests a variance from
the City for this criteria. It is worth noting that the proposed development includes several
backyard grassed drainage swales that may provide some volume reduction for the
project. In addition, the proposed stormwater management includes NURP basins to
meet water quality goals. Due to the local high groundwater, it is recommended that this
variance is granted.

6. Rate Control
a. Rate control conformance is achieved with utilizing the smallest allowable orifices at each
of the basins. Updates to the HydroCAD model, as mentioned above, are required in
order for consistency between the plans and model results.
b. More accurate modeling of EOF routes and drainage for the site is also required, as
previously outlined in these comments.

7. Water Quality
a. The proposed stormwater basins meet NURP criteria and City water quality standards
and are in conformance with NPDES requirements.
b. As part of the Minnesota River TMDL the City requires a reduction in its non-point source
phosphorus loading to the Minnesota River by a minimum of 30%. The stormwater report
should provide documentation, including a water quality model, of how this standard is
met.

8. Easements
a. Drainage and utility easements are required over all stormwater BMPs and
drainageways. A drainage easement covering the area encompassed by the 100-year
HWL is required around all stormwater detention areas. The updated HWL for each of
the basins, as described in this memo, should be used to define the easement boundary.
b. A drainage and utility easement is required for the large backyard depression, control
structure and stormsewer in Outlot E, Sheet 11.
c. There is a catch basin and backyard drainage swale shown on Sheet 8 that falls within
the 50 foot setback from the bluff. The City requires a 50 foot storm water pond setback
from the top of a bluff. This area is not designed as a pond, however, ponding during

large storm events will likely occur. Developer should demonstrate this area is in
conformance with the bluff setback ordinance.
d. The depression area in Outlot E, shown in Sheet 11, extends into the backyard areas of
Lots 4 and 5. This area is drained via a 15 RCP. The Engineer should document the
100-year HWL in this area is and modify the drainage and utility easement to encompass
it, if necessary.
e. The easement width for the pipe run from CBMH-103 to STM-101 should be verified to
meet the City of Shakopee Design Criteria. STMH-314 to CBMH-310 should also be
verified.

9. Wetlands
a. Wetlands are impacted as a result of this project. The City is the LGU for wetland
management and conformance with the Wetland Conservation Act. Please provide
documentation of the wetland delineation report, avoidance review, joint State/Federal
Application form and Wetland Replacement Plan. Any Notice of Decision documents
should also be included.
b. The MnRAM wetland classification and category should be noted in the plan set. This
should correspond with the wetland buffer setbacks and widths are defined in the plans.
c. Wetland monumentation at the lot corners or very 200 feet, whichever is shorter, is
required and needs to be shown in the plan set. Sec. 16.12 Subd.3.C defines the
wetland marker requirements for the City.
d. Basin 6A includes grading in the wetland buffer area. To be in conformance with City
code, this area is required to follow Sec. 16.12 Subd.3.B, which defines the vegetation
requirements. This includes the erosion protection, re-vegetation criteria and long term
maintenance.
e. Sheet 6 shows the wetland buffer area crossing into structures on Lots 2 through 7. This
is not allowed per City code.
f. Sheet 11 shows the wetland buffer area within the backyard areas of Lots 2 through 7
and a portion of 10 on Street D. These lots will be subject to restricted covenants in
accordance with City wetland buffer management as defined in Sec.16.12.

10. Outstanding Submittals


a. SWPPP.
b. A complete erosion control plan showing all erosion control measures, including inlet
protection, silt fencing, bio-roll erosion checks and limits of land disturbance. Refer to
Chapter 16 of the City Code for a complete list of requirements. This is particularly
important for this project as there are steep slopes and wetland areas within the project
boundary.
c. Cross section detail for NURP basins.
d. Outlet control structure detail for each of the four basins.
e. Operation and maintenance plan for all proposed stormwater BMPs.
f. Documentation of Wetland Conservation Act (WCA) permits and State/Federal notice of
decision.
g. Wetland delineation report and wetland replacement plan.

We request that the Engineer address these comments and provide the outstanding submittals for our

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA,
APPROVING A PLANNED UNIT
DEVELOPMENT, THE PRELIMINARY PLAT OF RIDGE CREEK

WHEREAS, Joe Jablonski of Lennar Corporation, applicant, and Western Bank,


property owner, has made application for the Planned Unit Development and Preliminary Plat of
Ridge Creek; and

WHEREAS, the property upon which the request is being made is legally described as:
See Attached Exhibit; and
WHEREAS, the Planning Commission of the City of Shakopee did review the Planned
Unit Development on March 9, 2017, and

WHEREAS, all required public notices regarding the public hearing for the Planned
Unit Development were duly sent and posted and all persons appearing at the hearing have been
given an opportunity to be heard thereon; and

WHEREAS, the City Council of the City of Shakopee did review the Planned Unit
Development on March 21, 2017 and adopted the following findings:

Criteria No. 1: Whether the proposed development is consistent in all respect with the
comprehensive plan and with this section.

Finding No.1: The comprehensive plan guides the area single family residential
development, which is what the applicant is proposing.

Criteria No. 2: Whether the proposed development, including deviations from design
standards of the underlying zones, is compatible with surrounding land uses.
Finding No. 2: The proposed deviations relating to setback, grading near the top of a bluff,
and filling of wetlands, and reduction in street width are in keeping with the character of the
surrounding land uses. The adjacent development to the west has also impacted the bluff
setback area. Without impacting the bluff setback area, multiple residential lots would not be
buildable on the north side of Oakridge Trail because the street alignment was set by
Ridgeview Estates, which was developed under different regulations.
Criteria No. 3: Whether the proposed development, including deviations from
development standards of the underlying zone, provides adequate open space,
circulation, parking, recreation, screening, and landscaping.
Finding No. 3: No changes are proposed in regard to landscaping, open space, or screening.
Only minor deviations from development standards relating to wetlands, bluff setback areas,
street widths, and side-yard setbacks are proposed as part of this development.

Criteria No. 4: Whether the primary function of the PUD is to encourage development
which will preserve and enhance the worthwhile, natural terrain characteristics and not
force intense development to utilize all portions of a given site in order to arrive at the
maximum density allowed. In evaluating each individual proposal, the recognition of
this objective will be a basic consideration in granting approval or denial.
Finding No. 4: The proposed development dedicates approximately 38 acres of open space.
The City of Shakopee intends to develop the open space with park dedication funds paid by
this development. Approval of the PUD allows for development of a challenging site, where
nearly of the area will be dedicated as open space to the city.

Criteria No. 5: Whether there exists an overall compatibility of land uses and overall
appearance and compatibility of individual buildings to other site elements or to
surrounding development. However, the architectural style of buildings shall not solely
be a basis for denial or approval of a plan.
Finding No. 5: The ultimate development of the PUD will provide for overall compatibility of
land uses, buildings, and other site elements to the surrounding development. All surrounding
land uses are single family residential developments. The applicant is proposing to build
homes similar in character and design to the adjacent developments.

Criteria No. 6: Whether the proposed PUD plan would afford a greater general public
benefit than would be realized under the underlying zoning district and/or general
zoning provisions.
Finding No. 6: The proposed PUD allows for the flexibility to develop a creative site plan for
a site with significant development challenges related to topography, wetlands, woodlands,
and required street connections. The proposed PUD also allows for adequate pedestrian
circulation to connect to the adjacent residential and park areas.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF


SHAKOPEE, MINNESOTA, AS FOLLOWS:
That the Planned Unit Development Ridge Creek is hereby approved to allow the development
in the following manner:

1. 7.5' side-yard setbacks are approved. The 7.5' setback applies to both the dwelling part
of the unit and garage. In the case of a corner lot, the street-side setback is 20.
2. The applicant is permitted to grade within the 30 setback to the top of the bluff. The
applicant must minimize the disturbance in this area to the extent possible and reduce
drainage down the bluff to the extent possible, as approved by the City Engineer.
3. The applicant is permitted to grade within the wetland buffer adjacent to Crossings
Boulevard, with the approval by the City Engineer.
4. The applicant must notify future owners of lots in Block 4 about the location of the
gas pipeline and easement.
5. "NextGen" units must not be separated from the rest of the house by a deadbolt lock,
or separate entrance. The units must not contain both separate laundry and full kitchen
facilities. The applicant must provide information to owners about zoning
requirements.
6. The three trail connections to trails along both CSAH 21 and CSAH 16 shall be as
proposed on the revised plans.
7. If the applicant constructs a monument sign for this subdivision, the sign must meet
City Code standards for design and location and receive a sign permit. All signage is
required to be located within a dedicated sign easement.
8. Park dedication funds received from this development shall be programmed for
development of the trails and open space within this development. Any funds collected
that are not used for development of the open space in Ridge Creek shall be dedicated
to the park reserve fund.
9. A utility coordination plan is required and must receive approval from the City of
Shakopee. Right-of-way permits will not be granted without an approved coordination
plan.
10. Locations of trees planted by the applicant must be marked by the applicant and
approved by the city prior to planting.
11. Required landscaping and replacement trees planted on residential lots must be planted
at least 8' from side lot lines.
12. Maintenance of landscaping and trees on private property is the responsibility of
private property owners, or a homeowner's association.
13. The area identified as bluff, and bluff impact zone shall be dedicated to the city as a
conservation easement. Posts shall be installed by the applicant on each property
corner identifying the boundaries and attach signage provided by the city. Areas
within the bluff impact zone which are impacted shall not be included in the easement.
The applicant must also provide and install open space and trail boundary signage as
determined to be needed by the City.
14. Crossings Boulevard shall have a minimum eight-foot-wide planting strip between the
back of curb and trail/sidewalk. A trail easement shall be given for any portion of the
trail which is outside of the city right-of-way, plus an additional two feet beyond the
trail.
15. Soil modification within the planting strips on Crossings Boulevard is required as
approved by the city engineer.
16. Tree planting/landscaping done within the city right-of-way or easements must be
approved by the city engineer. This includes but is not limited to species selection,
location, quantity, sizing, maintenance, installation schedule, and warranty.
17. Due to road alignment on the adjacent property, a 30-foot bluff impact zone is to be
used. The applicant is required to minimize and justify any impacts to the bluff impact
zone.
18. A joint trench is required for all underground wire utilities. The location of the joint

23. The applicant must comply with the memorandum from WSB and Associates dated 2-
23-17, except a portion of condition #1E in the memorandum. The lining of
stormwater ponds is not required.
24. The applicant must comply with the Shakopee Public Utilities Memo dated 2/14/17.
The following relates to the proposed Preliminary Plat of Ridge Creek

WHEREAS, the Planning Commission of the City of Shakopee reviewed the preliminary plat
on March 9, 2017 and recommended that the City Council approve the preliminary plat of
Ridge Creek; and

WHEREAS, the City Council reviewed the preliminary plat on March 21, 2017.

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of


Shakopee, Minnesota that the preliminary plat of Ridge Creek is hereby approved subject to
the following conditions:

I) The following procedural actions must be completed prior to the recording of a Final
Plat:

1. Execution of a Developers Agreement, which needs to include provisions for security


for public improvements within the subdivision and payment of the Street and Utility
Fee and the Watermain Fee.
2. Payment of all Storm Water Management Plan Review Fees need to be made, as
required by the most current City of Shakopee Fee Schedule.
3. Payment of the Trunk Sanitary Sewer Charge needs to be made, as required by the
most current City of Shakopee Fee Schedule.
4. Payment of the Trunk Storm Water Charge needs to be made, as required by the most
current City of Shakopee Fee Schedule.
5. Payment of the Sign Installation Fee needs to be made, as required by the most current
City of Shakopee Fee Schedule.
6. Payment of the Bituminous Sealcoat Fee needs to be made, as required by the most
current City of Shakopee Fee Schedule.
7. The applicant will submit a detailed contractors bid for all public improvements
associated with this subdivision.
8. The applicant will submit a detailed lot area drawing showing the total plat area, the
total drainage and utility easement area encompassing high water levels of
wetlands/storm water basins, the total area of right-of-way, the total area of
conservation easements and outlots, the total area of bituminous street and the total
area of lots.
9. The applicant shall have an approved wetland replacement plan addressing the
proposed impacts. Final approval must be granted prior to any
grading in wetland areas.
10. The easement on the site known as Document No. 201406 must be vacated by both
the City of Shakopee and Prior Lake Spring Lake Watershed district prior to the
dedication of the right-of-way of Crossings Boulevard on a final plat.
11. The applicant must have final approval of the subdivisions storm water management
plan.
12. Outlots A and B must be deeded to the City of Shakopee.
13. The applicant will provide adequate wetland buffers and associated easements/outlots
as set forth in Section 54.32 of our Code of Ordinances.
14. The applicant must work with the City Engineer and Prior Lake Spring Lake
Watershed District to develop a plan for removal of existing culverts in Outlot A and
the placement of any necessary rip rap for the ninety-degree bend in the channel.
15. Easements will be shown on the Final Plat as approved by the City Engineer. They
include, but are not be limited to, the following:
The applicant will provide minimum widths of drainage and utility easements as
set forth in Section 10.1 (A-D) of the City of Shakopee Design Criteria.
Provide a minimum of 15 feet of drainage and utility easement adjacent to the
County Road 16, County Road 21 and Crossing Boulevard rights-of-way.
16. Provide electronic files (AutoCAD and Portable Document Format PDF) of the
Final Plat to be recorded with datum on the Scott County coordinate system.
17. In areas where a sidewalk or trail is provided on private property, a sidewalk / trail
easement shall be provided.
18. A sidewalk shall be added to the north side of all parts of Ridge Creek Trail.
19. Street names on a future final plat are to be reviewed and approved by the city.
20. In the case of restoration in lieu of replacement trees, any restoration done on or
adjacent to the bluff and bluff impact zone must equal the monetary and ecological
value of replacement trees not replanted onsite, per city code 151.113. A portion of the
landscaping/tree replacement financial security shall be held for a minimum of three
full years to ensure establishment. The portion held shall never be reduced to less than
125% the amount to ensure the completion of the contract as shown on the plan
approved by the city engineer.
21. The applicant must meet all vegetation establishment requirements within stormwater
areas and city outlots, as approved by the city engineer.
22. The applicant must comply with the Shakopee Public Utilities Memorandum dated
2/14/17.
23. Park dedication fees must be paid in the amount required by City Code and the
adopted fee schedule at the time of recording of a final plat.
24. The minimum right-of-way dedication for CSAH 16 is 75-feet of right-of-way from
the center of the roadway.
25. A trail must be built along CSAH 16 and connect to the existing trail along CSAH 16.
26. Noise issues may arise as traffic volumes increase on the County roadways over time.
Noise attenuation for the platted lots is the responsibility of the City and/or developer.
27. No ponding, berming, landscaping, or signage shall be permitted within the County
right-of-way.
28. Any work within the County right-of-way shall require a County permit.

The following items need to be addressed / completed prior to approval of a grading


permit and/or a building permit:
1. The applicant will need final approval of the subdivisions storm water management
plan.
2. The applicant will grade the entire site, as proposed on the approved plans, in one
phase within one year from the date of approval of the grading permit application.
Grading is defined as bringing the site to the proposed finished grade with materials
deemed acceptable by the City of Shakopee engineering department, providing topsoil
per City requirements and applying seed, mulch and/or sod per City requirements and
providing an as-built record grading plan per Section 2.5 of the City of Shakopee
Design Criteria.
3. Class IV fieldstone riprap and geotextile fabric will be placed at each flared end
section. The riprap and fabric will be installed to the bottom of the storm water basin.
4. The applicant will work with the City of Shakopee to eliminate lots with public
utilities on both side lot lines.
5. Storm manholes will need to be added in order to reduce flow velocities at flared end
sections to an acceptable rate. This rate will be determined by the engineering
division.
6. The applicant will seed the disturbed storm water basin area with a native vegetation.
The seed mixture, application and maintenance requirements will be determined by
the City
7. The applicant will install trunk sanitary sewer to south property line as directed by the
engineering division.
8. The applicant will provide vertical street curves that comply with city requirements,
unless otherwise approved by the city engineer.
9. The applicant will submit detailed pavement design calculations.
10. The applicant will submit a landscaping plan in compliance with the most recent
version of the City of Shakopees Easement Fencing and Landscaping Policy. If the
applicant wishes to vary from these requirements, a detailed subdivision-wide utility
service corridor plan will need to be submitted for review.
11. Record plans need to be provided per the City of Shakopee Design Criteria, Section
2.5 and Section 11.2 (A-L). The record plans need to be submitted to the engineering
department.
12. Identify EOFs for all catch basins, wetlands and ponds. Rear yard catch basins,
wetlands and ponds should have an EOF route clearly marked on the plans.
13. Revise the grading between Lots 7 and 8, Block 1 to ensure slopes do not exceed 3:1.
14. A right-of-way permit is required before installation of any utilities within city right-
of-way or easements.
15. Grading permit approval for grading within wetland areas is contingent on the
applicant providing a wetland replacement plan meeting the requirements of approval
by the City Engineer.

Discussion:
Dennis Cornelius, Amcon Construction, submitted an application for PUD Concept Review
for a proposed 130-unit market rate apartment building on the residential site of the West
Vierling Acres PUD (Hy-Vee). Amcon Construction is proposing to build an apartment
building for Kami, Inc., a company based in Woodbury that owns and manages residential
and commercial properties in MN and surrounding states.

The West Vierling Acres PUD included a site for an apartment building east of the Hy-Vee
grocery store, zoned R-3, Multiple Family Residential for a maximum 100-unit apartment
building. The City Council approved a PUD and conditional use permit for an over-height
structure to allow a 41 tall apartment building on this site (maximum height in R-3 = 35').
Building elevations and site plan for the current and previous proposals are attached.
The City Council allowed Hy-Vee to defer the extension of Harvest Lane to Vierling Drive
until the apartment site develops. Amcon Construction is aware of this requirement and is not
proposing any changes to the alignment / design.
The R-3, Multiple-Family Residential Zone allows up to 14 units / acre (100 units) on this
site. In order to construct 130 units, the property must be re-zoned to R-4, High Density
Residential. The density for a 130-unit building is 18.4 units / acre. The maximum density
allowed in the R-4 zone is 28 units / acre. For reference, until the year 2001, the maximum
density in the R-3 zone, was 18 units / acre. All of the apartment buildings constructed after
2001 in Shakopee, including the Addison, were approved and built at 18 units / acre. The
density of the Sand Companies apartments approved adjacent to the Southbridge Transit
Station is 24.1 units / acre.
The City Council may limit the number of units permitted to a specific number in a PUD if
they are not comfortable with a development at the maximum density.
The proposed unit mix of units in the building is:
Studio: 14 units (11%)
1 Bedroom: 57 units (44%)
2 Bedroom: 56 units (43%)
3 Bedroom: 3 units (2%)
Building Design:
The proposed exterior materials are brick, two colors of decorative concrete block, two
colors of fiber cement siding, and aluminum balconies / railings for individual units, and glass
railings for the rooftop patio.
The proposed building meets City Code standards for building materials and appearance. The
building varies in elevation from 4 stories in the center part of the building to 3 stories on the
ends and has varying parapet heights.
The apartment building elevations approved by the City Council in 2016 contemplated a
building with a pitched roof. Building height by City Code is measured to the mid-point on
pitched roofs and the highest wall/ parapet on a flat roof. The applicant is proposing a flat
roof design that is 46, which is 1 above the maximum height standard in the R-4 zone. The
submitted drawings approved by the City Council in 2016 contemplated a building with a
pitched roof, that would actually be taller than 46 at the peak of the roof. The applicant has
submitted a shadow study (attached) showing that shadows are not cast onto adjacent
residential properties. The amount of shadow cast is less than the approved plan, as the
building is slightly shorter. The proposed building is also located further away from the
existing residential units.
Parking:
The applicant is proposing 115 indoor parking spaces and 151 outdoor spaces, a total of 266
total spaces (2.05 spaces / unit). With 1 space per unit of covered parking, 15 units would not
have access to an underground parking space. Staff is comfortable with a reduction in the
parking standard from 2.25 spaces / unit, based on 55% of the units being 1 bedroom or
studio units. Staff believes the amount of surface parking could be reduced to allow for more
open space.
Traffic:
As part of the Hy-Vee development, a Traffic Impact Study was prepared for the entire
development by Hy-Vee's consultant, including a 200-unit apartment building. The City of
Shakopee engaged a separate consultant to review the results of the study and provide
comments. A change requested by the City's engineering consultant resulted in an
access driveway being shifted 50' east to allow for additional vehicle queuing for turning
movements at the intersection of Adams Street and Vierling Drive. The consultant did not
find that future traffic level of service projections were problematic with the current roadway
facilities.
Further Discussion:
Since the applicant first met with planning staff on developing a plan for the site, they
have revised their plans. The changes made thus far are:
Reduction of the height of the ends of the building to 3 stories to have less building
mass, reducing the unit count 140 to 130.
Re-configuring the layout of the building to better fit the site
Reduce parking to increase green space and landscaping
Provided two pedestrian connections to the Hy-Vee store
Additional brick to the building elevations
Addition of landscape / pedestrian connections to the parking lot
Addition of rooftop patio / outdoor amenity area
Addition of pedestrian connection from outdoor amenity area to grocery store to Hy-
Vee. The connection should be relocated to an improved area for pedestrians crossing
the store parking area.
Planning staff believes that the proposed project is an improvement over the initial proposal,
based on an improved site plan, amount of resident amenities, higher quality exterior
materials, and improved pedestrian access to the grocery store.
The applicant is currently constructing similar market rate apartments in Blaine for Kami Inc.
at 9436 Ulysses St NE, called "The Parkway Off Central" www.theparkwayoffcentral.com .
The Parkway Off Central has a similar building elevation to this proposal. The website lists
rents for the building in Blaine of:
$950 for a studio
$1,250-$1,400 for a 1-Bedroom
$1,675-$1,925 for a 2-Bedroom
$1,925 - $1,995 for a 3-Bedroom.
Site Development:
Access to the site would be via Harvest Lane from Vierling Drive. The site is directly
between the Hy-Vee store and existing single-family residential development. The proposed
building would buffer the single family development from the grocery store. The applicant is
proposing a large landscaped area that is 58' in width on the north side, with a small area that
is 40' in width to landscape and screen the adjacent existing residential properties. Reducing
or re-configuring the parking on the south side could maintain the 58' width.
The setbacks of the R-4 zone differ from the R-3 zone. The setback to an arterial roadway in
the R-4 zone is 50'. The building would need to be shifted north 20' to comply with
the setback, or the applicant may request a reduction as part of the PUD.
The applicant is constructing a separate garage at their project in Blaine to have covered
parking for residents. Currently there is not a covered parking space for each unit. The City
Council may discuss whether an additional garage would be required for this site, as it may
be desirable as a supplement to the landscaped buffer for the existing residential properties.
During the Hy-Vee review, there was significant discussion about the landscaping between
the apartment building and the grocery store, as the delivery area of the grocery store is near
the apartment building. A single landscaped berm is required to be located between the Hy-
Vee driveway and the apartment site as screening for the apartment units. The applicant will
need to review their plan to make sure that the building does not conflict with this
requirement and coordinate with Hy-Vee.
The applicant has mailed notices to surrounding property owners and held a neighborhood
meeting on March 2nd. None of the neighboring property owners provided comments at the
Planning Commission meeting on March 9th.
The applications required to develop the site based on this proposal are:
1. Re-zoning to R-4, High Density Residential
2. PUD Amendment, due to a change in the development plan and to allow reduced
parking standards / reduced building setback.
3. Conditional Use Permit for over-height structure
4. Final Plat, since the site is currently an outlot.
All of the applications can be filed and reviewed concurrently. Both the Planning
Commission and City Council would review all the applications, with the exception of the
Final Plat only being reviewed by the City Council.
If the applicant is comfortable with feedback and comments received from the Planning
Commission and City Council, the applicant has stated they will draft the required plans and
submit formal applications for review and public hearings. If approved, the applicant has
stated they intend to begin construction immediately following the city approval process.
Budget Impact:
N/A. The application is a concept review. If the applicant receives positive feedback they
may decide to submit formal plans for development in the future.

Discussion:
We would like to update the Council on the preliminary planning process that has been outlined by sta. Most notably, the
plan includes a shi in the substance, form and role of the comprehensive plan. This includes a major shi in accessibility of
the plan through easier-to-read language and an easier-to-use organiza on of the document. The 2040 plan will highlight
the shared vision for the future of the community and will be organized around shared community values. The plan will be
ac on-oriented to ensure its u lity and impact on the day-to-day opera ons of the city. Addi onally, sta is proposing an
annual progress review and report of the comp plans goals to assure accountability and transparency. To strengthen the
planning process and build community support for the plan, sta is proposing an extensive customer service-oriented
community engagement process. Sta would like to u lize several community engagement techniques to reach the
maximum number of stakeholders and create an inclusive process.

To help facilitate the planning process and to provide technical exper se, the city will hire a
planning consultant. An RFP was released at the beginning of the month seeking planning
services. The RFP closes April 3 at which point a team of sta will review proposals. Stas
ideal meline is for a contract to be signed and work to begin in mid-May.
Budget Impact:
The total budget for the project is $217,000. This includes $125,000 in grant funds from Sco County to evaluate future
transporta on, land use and economic development needs for Jackson Township along the corridor of highways 169 and
69; $32,000 in grant funds from the Metropolitan Council; and $60,000 from the citys general fund. The city has already
allocated $12,000 in funds to a partnership with all of the other ci es and Sco County to conduct automobile
transporta on planning. The funding available for the remainder of the project is $205,000. Sta is seeking approval from
Council to apply for $10,000 in funding from the Center for Preven on at Blue Cross Blue Shield of Minnesota to
supplement and support community engagement eorts.

Discussion:
The Center for Preven on, a department of Blue Cross Blue Shield of Minnesota focused
on public health ini a ves, has an open RFP for its "Ac ve Place Demonstra on Project"
(APDP). The ini a ve funds temporary, low-cost projects that help community members
inuence long-term community changes. Projects must contribute to a long-term goal of
making a community more accessible to any type of physical ac vity, including walking and
biking. The ini a ve allows for two dis nct types of Ac ve Places projects community
engagement projects and demonstra on projects. Sta proposes an applica on for a
community engagement project related to the comprehensive plan to supplement and
expand engagement plans.
As the long-term visioning document, the comp plan is a fantas c opportunity for residents
and businesses to inuence long-term community changes. The city has already heard from
stakeholders that access to facili es that promote ac ve living trails, sidewalks,
connec ons to the river, connec ons to Huber Park, and conserva on of nature and open
space - are important. Blue Cross also considers crea ng interes ng, vibrant and safe
spaces to be cri cal to the encouragement of ac ve living. This could include many of the
discussions to improve vibrancy in the downtown.
Stas proposal includes funding of a variety of engagement ac vi es. This includes:
- Workshop series: using maps and arts and cra s materials, sta would work with
small groups to discuss opportuni es for improvement and iden fy community
assets. People could also be encouraged to design their vision for the city. The
workshop is an invi ng and fun ac vity that encourages discussion in a hands-on
manner.
- Public presence at community events: sta proposes a mee ng in a box in
which a public open house is brought to where people are gathering, whether it be a
community mee ng, a community event or fes val, a retail loca on, parks or
community center, or following a faith service.
- Photovoice: this is an engagement tool that u lizes photography as a means for
people to share their feedback. For example, par cipants could be encouraged to
take photographs of what they like about the community, what they dont like, and
where they see opportuni es. Photographs can then be displayed, a dialogue hosted,
and issues analyzed and included in the comp plan. This project could be a great way
to engage youth.
- Community chalkboards: community feedback would be sought via publicly
displayed chalkboards asking ques ons such as What is your vision for Shakopee?
This provides another opportunity to engage people where they are gathering but in
a manner that does not require constant stang.
- Food: o en cri cal to increasing engagement and par cipa on is oering food
- Partner s pends: the funding opportunity encourages mul -partner collabora on
and the use of partner s pends. The funding would provide a small amount to a
group of community organiza ons to compensate for their involvement. Partners
would be asked to help facilitate events and to help spread the word to their
members/clients. This is also a great way to build authen c rela onships with
community partners.
Budget Impact:
The poten al award of $10,000 would supplement the citys exis ng funds for community engagement.
