The testimony of the witness Alyssa Grace S. Lim is being offered to

prove the:
 1. Innocence of the herein respondent;
2. All other related matters, facts and circumstances relevant
and material to this case.

III. JUDICIAL AFFIDAVIT PROPER.

I, ALYSSA GRACE S. LIM, 24 years old, Filipino, and residing at

Hontanosas Extn., Tagbilaran City, under oath, depose:

Q: Please state your name, age, residence, and occupation as the

witness.
A: I am ALYSSA GRACE S. LIM, 24 years old, residing at
Hontanosas Extn., Tagbilaran City and a CEO of BigHit Company.

Q: Why are you here now?

A: To give a sworn statement by way of a judicial affidavit, the same
to constitute as my direct testimony, in the above-captioned civil case.

Q: For the record, please state the name and address of the lawyer
who is now conducting or supervising your examination and the
place where the examination is being held.
A: The legal counsel for the plaintiff, Atty. Rey B. Binag, is conducting
or supervising my examination at his law office (Binag and Organiza
Law Office and Associates) located at: 2nd floor, Pamugas Building,
Tagbilaran City.

Q: In what language do you want your examination to be conducted?

A: This judicial affidavit is prepared in English so I prefer that my
cross examination be conducted in English.

Q: Do you undertake to answer the questions to be asked of you, fully

conscious that you will do so under oath and that you may face
criminal liability for false testimony or perjury?
A: Yes.

Q: Let us now proceed to the Complaint. Do you know the petitioner

in this case Agnes M. Tejano-Lim?
A: Yes. She is the wife of my brother.

Q: Do you know the respondent in this case John Jeric S. Lim?

A: Yes. He is my brother.

Q: Why are you testifying in this case?

A: I am testifying in this case as a witness for the respondent John
Jeric S. Lim for the case of declaration of nullity of marriage.

Q: How long have they been together?

A: More than 5 years.
Q: How did you know the petitioner?
A: I first knew her as a law classmate of my brother then eventually
my brother introduced her to us as his girlfriend.

Q: Did the respondent introduce other girls as his girlfriend?

A: No.

Q: What was their relationship like?

A: Their relationship, at first, was all sweet and loving but eventually it
turned sour and full of fights.

Q: When did it turn sour?

A: When my brother found out that his girlfriend got pregnant.

Q: Why did it turn sour when he knew that petitioner got pregnant?
A: My brother was so worried of how petitioners parents would react
considering that they were still new lawyers at that time. He was not
able to sleep and eat well. He did not know what to do but because
he loved her, he planned on asking her hand in marriage.

Q: Did the respondent propose?

A: Yes.

Q: Did the marriage eventually happen?

A: Yes.

Q: Can you remember on what date it was?

A: February 14, 2013.

Q: Were you there when the marriage was celebrated?

A: Yes.

Q: What was their relationship after the marriage?

A: It got violent. My brother never really liked living with her because
every time they fight, she would throw things at him. She would curse
him of every curse word she knows. She would punch him and kick
him. If her demands were not met, she would always want the full
attention of my brother to the point wherein slight inclinations would
be dealt with by her severely.

Q: How did you know all of these?

A: My brother told me and I witnessed it firsthand when I went to visit
their house.

Q: When was that visit?

A: Sometime in October of 2014.
Q: What would your brother do every time this happens?
A: He would come home at our house and wallow in misery.

Q: Is it true that your brother goes out clubbing?

A: Sometimes when he is really stressed out from work and from life
but only to unwind and nothing else.

Q: What did you do when petitioner gave birth?

A: I visited her at the hospital but she got angry at me because my
brother was not there.

Q: Why was your brother not there?

A: He went to Paris for work.

Q: Not for vacation?

A: No. He went there for work.

Q: How long did he stay in Paris?

A: About 6 months.

Q: What happened after she gave birth?

A: My brother returned home from Paris and we visited her at her
parents house but she refused to see us because she was still so
angry.

Q: What did your brother do?

A: My brother tried to reconcile with her and save their marriage. He
gave her and their baby gifts. He would care for the baby even when
he is tired from work. He wanted to go back to when they were all
loving and sweet so he did everything he could to make it happen.
However, the ungrateful wife made up frivolous stories and always
made it a point that every argument would be attributable to my
brother.

Q: Is it true that your brother has a paramour?

A: No. My brother does not have the heart to cheat and be a cheater.
Such allegation is an obvious fabrication to stain his reputation and to
dissolve their marriage.
