AFFIDAVIT OF SERVICE

I, RHEA OLAIVAR, of legal age, Filipino, single, with

postal address at Cameros Law and Accounting Office,
Corner Magsaysay & Lapulapu Sts., Digos City, after having
been duly sworn to in accordance with law, do hereby
depose and say:

That I am the clerk of Cameros Law and Accounting

Office;

That on April 17, 2009, I served/filed copies of

respondent Aurea Alboferas
MEMORANDUM in the case entitled MARK ANTHONY
JOROLAN versus JUDGE MARIVIC DARAY, ET.AL., CA
G.R. SP No. 02309-MIN, pursuant to Section 7, 11 & 13,
Rule 13 of the Rules of Court as follows:

1. By personal service to the Honorable Presiding Judge

of RTC Branch 18 of RTC Digos City, Davao del Sur, by
serving two(2) copies of the said MEMORANDUM, proof of it
is the signature indicated on the last page of the said
MEMORANDUM;

2. By registered mail to ATTY. DANILO S. BALUCANAG

Sr., Suite 8, 2/F, Veterans Phil. Bldg., T. Monteverde St.,
Davao City, counsel for petitioner, due to impracticability of
personal service because of the distance between Digos City
and Davao City by depositing two (2) copies of the said
MEMORANDUM on April 17, 2009 at Digos City Post Office
in a sealed envelope as evidenced by Registry Receipt
No.122343 hereto indicated and with instructions to the
postmaster to return the mail to the sender after ten (10)
days if undelivered;

3. By registered mail to ATTY. AMADO L. CANTOS, Suite

8, 2/F, Veterans Phil. Bldg., T. Monteverde St.,, Davao City,
counsel for petitioner, due to impracticability of personal
service because of the distance between Digos City and
Davao City by depositing two (2) copies of the said
MEMORANDUM on April 17, 2009 at Digos City Post Office
in a sealed envelope as evidenced by Registry Receipt
No.122343 hereto indicated and with instructions to the
postmaster to return the mail to the sender after ten (10)
days if undelivered;

4. That seven (7) legible copies of the said

MEMORANDUM were filed to the Court of Appeals,
Mindanao Station, Cagayan de Oro City, Twenty-First (21 st)

through registered mail due to impracticability of personal

filing because of the distance between Digos City and

That Registry Receipt No. 12345 dated April 17, 2009 is

hereto indicated and attached evidencing my deposit of
seven (7) copies on said date at Digos City Post Office in a
sealed envelope addressed to the Court of Appeals,
Mindanao Station, Cagayan de Oro City, Twenty-First (21 st)
Division and with the instruction to the postmaster to return
the mail to the sender after ten (10) days if undelivered;
