Former National Security Adviser Michael Flynn recently confirmed this information in a retroactive filing with the Justice Department’s Foreign Agent Registration Unit. ln light ofthis development, I wanted to inquire whether Mr. Flyan would be subject to your Executive Order on Ethics Commitments by Executive Branch Appointes from January 28, 2017, The exeoutive order clearly states Every appointee in every executive agency appointed on or after January 20, 2017, shall sign, and upon signing shall be contractually committed o, the following pledge upon becoming an appointee: ‘Asa condition, and in consideration, of my employment in the United States Government ‘in an appointee position invested withthe public trust, I commit myself tothe following obligations, which I understand are binding on me and are enforceable under law: 4.1 will not, at any time after the termination of my employment inthe United States ‘Government, engage in any activity on behalf of any foreign goverament or foreign politcal party which, were it undertaken on January 20, 2017, would require me to register under the Foreign Agents Registration Act of 1938, as amended!
