To develop Sri Kanaka Durga Nagar so that plot owners can construct their
houses.

To arrange to provide for the amenities to the members of the Association.

To provide harmonious co-existence among residents.

To cultivate and encourage co-operation and friendly relationship among


members.

To provide for Educational, Social, Cultural and Recreational facilities to the


members.

To take up all necessary steps which are conducive for the development of the
Colony.

Any other activities which are incidental and necessary for the well being of
members

RULES AND REGULATIONS


1. NAME : Sri Kanaka Durga Nagar Colony Welfare Association

4. TERMINOLOGY

a) In these rules and regulations unless there is some thing inconsistent there with
Association means Sri Kanaka Durga Nagar Colony Welfare Association,
Vijayawada 520 008.

b) Colony means the area of Sri Kanaka Durga Nagar, Vijayawada 520 008.

c) Office means the office for the time being D. No. 48-17-2, Nagarjuna Nagar, Ring
Road, Vijayawada 520 008.

d) In writing or Written includes writing, printing, lithography, type writing,


cyclostyling, electronic publishing or any mode of representing words in visible
form.

e) Executive Meeting means the office bearers elected by the General Body to
manage the affairs of the Association.

f) Member means the owner of a plot in Sri Kanaka Durga Nagar, Vijayawada 8.

g) Objects means the objects specified in the Memorandum of Association of the Sri
Kanaka Durga Nagar Colony Welfare Association, Vijayawada 520 008.

h) To become a member of the Federation of Associations of Colony Associations for


achieving common objectives of interest to the colony owners/residents.

5. APPLICATION OF THE RULES AND REGULATIONS:

All plot owners/ tenants in Sri Kanaka Durga Nagar and any other persons who
might use the facilities of this colony are subject to these rules and regulations. The
mere acquisition or mere act of occupancy of any plot, whether he/she is a
member of the association or not will signify that these rules and regulations are
deemed to have been read, accepted, rectified and will be complied with.

6. MEMBERSHIP:

a) For the purpose of registration, the number of members of the Association is


declared to be limited to the number of plots in Sri Kanaka Durga Nagar,
Vijayawada 8.

b) All plot owners in Sri Kanaka Durga Nagar shall be automatically eligible to be the
members of Association.

c) The membership will continue as long as he/she is the owner of a plot in the
Colony.

d) In the case of joint ownership by two or more members only one of them can be
enrolled as the member of the Association, even though all of them can jointly
enjoy the common facilities of the Association.

e) In case a person is having more than one plot in the same name, only one
membership shall be given irrespective of number of plots owning.

f) In the event of death of a member, the membership will be transferred to the legal
heir of the deceased members family. In case of more than on legal heir, such
legal heir to whose share the plot in the colony falls becomes eligible to be member
of the association.

g) In the event of sale of a plot or transfer or gift to any new person, the new owner
shall automatically become the member of the Association by paying the requisite
admission fee.

h) Every member shall pay an amount of Rs. 500/- as membership fees at the time of
admission and each member shall pay Rs. 600/- per plot as annual subscription at
the beginning of every calendar year. If the annual subscription is not paid before
March of the calendar year, such member shall be suspended from the
membership till payment of dues.

7. ENROLLMENT OF MEMBERS

a) All the owners of the plots in the colony shall hold membership in the association
and shall constitute the general body. Tenants will be allowed to join the
association as a member provided they produce a letter of authorization from
his/her land lord/lady.

b) Owner of each plot can appoint in writing, addressed to the President of the
Association, any person from his family / friend / tenant to represent him/her in
the matters relating to Association and such person shall be known as APPOINTED
MEMBERS.

c) Each member / appointed member shall have only one vote. A member /
appointed member who is in default of payment of Annual Subscription shall have
no right to participate / vote in any meeting.

8. ADVISORS:

The Governing Body may nominate one or more advisors for getting the advices for
proper and smooth functioning of the association. The advisor need not be a
member of the association and he shall not carry any voting rights excepting the
vote if otherwise as an ordinary member.

9. OBJECTS:

The objects of the Association shall be to take over and maintain all the common
facilities in the Colony and as set out in the objects clause of the Memorandum of
Association of Sri Kanaka Durga Nagar Colony Welfare Association. The General
Body of the Association by simple majority vote shall amend and chalk out the
policies and courses of action from time to time for the programmes and financial
standing of the association.

10. DISCIPLINE:

Any member/occupant of the plot who is guilty of conduct by his acts of omissions
detrimental to the interest of the association members shall be liable for penal
action, such as disconnection of water supply etc., taken by the executive
committee of the association.

11. FUNDS:

a) To carry out the objects of association, funds will be raised by membership fee,
annual subscriptions, donations, gifts and other offerings as may be determined by
Executive Committee.

b) The funds of the association shall be spent for the attainment of the objectives of
association and no portion thereof shall be paid or transferred directly or indirectly
to any of its members through any means. Funds of the society shall be deposited
in a scheduled bank in the name of the society.

12. MANAGEMENT:

The activities of the association shall be governed by the Executive Committee of


the association comprising of:

a) One President
b) Two Vice Presidents
c) One General Secretary
d) Two Joint Secretaries
e) One Treasurer
f) Four Executive Members

These members of the Executive Committee are purely to serve as Honorary


Members with no remuneration for the services rendered by them.

All the members of Executive Committee shall be elected by the General Body of
the association. Appointed members are also eligible for election to the Executive
Committee of the Association. The term of the Executive Committee is for a period
of Two Years. All the members are eligible for reelection.

If a member of the executive committee wishes to resign he/she shall inform the
same in writing to the President or Secretary 15 days in advance. He/She shall
however be held responsible until the charge is properly handed over to the next
incumbent.

In the event of any vacancy in the executive committee the remaining members of
the executive committee shall have the right to either hold election to the vacancy
or nominate another member of the committee to take charge till the General
Body of next meeting.

If the executive committee member absents himself from three consecutive


meetings without leave of absence from the committee, he/she shall cease to be a
member of the same unless a majority of the remaining committee members
decide otherwise. There shall be at least one meeting of the executive committee
once in every three months.

Members of the Executive committee shall cease to continue in office, if a no-


confidence motion is passed against the members of the executive committee, in
an extra ordinary General Body meeting convened for the purpose, and attended
by not less than 50 percent of the total members.

The following matters shall be dealt with by the General Body, the meeting of
which is to be held once in every 12 months or earlier as per the necessity:

a) Election and removal of the members of the executive committee.

b) Consideration of Audit Report and annual report, review of the financial position of
the association, and rectifying the expenditure incurred by a simple majority.

c) Consideration of Budget proposals for the coming year and approval of the same.

d) Amendment to Rules and Regulations.

e) Appointment of Auditors, if necessary and remuneration to be paid.

f) Any other matter relating to the common interests of the association.

13. FUNCTIONS OF THE EXECUTIVE COMMITTEE:

a) To authorize the General Secretary/Treasurer to open a bank account in the name


of the association with a scheduled and commercial bank which shall be operated
by the President/Secretary jointly with treasurer.

b) To scrutinize the expenditure incurred and rectify the same.

c) To arrange to maintain such accounts and registers as are necessary.

d) To institute, conduct, defend, comprise or abandon legal proceeding by or against


the Association after getting the approval of members at a specially convened
extra-ordinary General Body meeting.

e) To transact all business relating to the association.

f) To scrutinize and to put up the annual budget to the General Body.

g) To submit to the general body the annual report and statement of accounts.

14. FUNCTIONS OF THE OFFICE BEARERS

PRESIDENT:

The President shall preside over the executive Committee meetings and also the
General Body meeting. He shall be over all in-charge and call for the meetings as
per the rules and regulations and also whenever special meetings re necessitated.
He shall ensure that proper care is being exercised on the custody of the cash and
expenditure and also the general conduct of the affairs of the Association.

VICE-PRESIDENT:

Vice President shall function as President in the absence of the President and also
perform such functions as the President may delegate to him from time to time.

GENERAL SECRETARY:

General Secretary is the Chief Executive of the Association. He shall be responsible


for the executive administration of the association, subject to the control of the
committee headed by the President.

He shall administer the day to day affairs of the Association. The Secretary shall
have the powers to appoint or remove any staff or servants of the association
subject to the approval of the Executive Committee. The Secretary can take action
against members who violate the rules and regulations of the Association with the
approval of Executive Committee.

He shall authorize payment of bills, salaries and wages, repairs and maintenance
etc., in the ordinary course of activities of the association which will be paid by the
treasurer.

He shall maintain all the records of Association. He shall call for the meetings of the
Executive Committee and General Body and shall be authority to represent the
Association in all legal matters.

A minutes book to record the proceedings of the meeting of the executive


committee and General Body shall be maintained by the Secretary.

Secretary is not responsible personally for any of his actions done on behalf of the
Association in compliance with the rules and regulations of the Association.

JOINT SECRETARY

The Joint Secretary shall assist in all functions and perform such duties as the
General Secretary, which may delegate to him from time to time as per the
occasion demands. He shall also perform such duties that the President or the
Executive Committee may assign to him from time to time.

TREASURER

The treasurer shall be responsible to maintain full and accurate accounts of all
receipts and disbursements in proper books belonging to the Association.

He is required to pay all passed vouchers by the Secretary from the funds of the
association. He should issue receipts for all the funds received by Association. He
shall deposit all moneys received in the bank or banks duly approved by the
Executive Committee by way of a Resolution recorded in the minutes-book. He
shall operate the Bank Account/s jointly with President/General Secretary of the
Association.

He shall be authorized to keep an imprest cash not exceeding Rs. 1000/- (Rupees
one thousand only) at any point of time to meet the exigencies of the Association.

Expenditure incurred shall be placed before the Governing Body in the ensuing EC
meeting for approval.

He is responsible for preparation of statement of accounts 10 days before the


General Body and submits to the EC Committee and on approval place before the
General Body for rectification.

EXECUTIVE MEMBER

He shall assist the office bearers in all the activities of the Association and in
collecting annual subscriptions.

15. ACCOUNTS AND AUDITING

a) Proper books of accounts shall be maintained by Secretary and Treasurer.

b) Each year the General Body shall appoint an auditor, if necessary, to scrutinize the
accounts and to submit audited final statements of accounts to the General Body.

c) Auditors remuneration also to be fixed by the General Body.

d) The official year of the Association shall be from 1 st April to 31st March of next year
both days inclusive.

16. MONETARY POWERS

The Secretary can authorize payments of routine nature like monthly payments of
salaries to the staff, electricity and water bills, replacement of electric bulbs,
stationery and other petty repairs. However, the appointment of staff and their
remuneration per month shall be got approved by the executive committee in the
first instance.

The Secretary can authorize non-routine and non-recurring expenditure of not


more than Rs. 1,000/- for each item. However, this expenditure should be
presented at the subsequent Executive Committee meeting for rectifying.

17. MEETINGS

Meetings of the Executive Committee shall be convened by the Secretary at least


once in three months or often, if necessary, for conducting the business of the
Association.
President may call for the special meeting of the Executive Committee as early as
possible but not later than a week after receipt of the requisition by at least THREE
of the members of Executive Committee.

Quorum of the Executive Committee meetings shall be 2/3rd of the strength of the
committee. All questions before the committee shall be decided by a majority of
votes. Should there be any equality of votes, the President or the Presiding
member shall have a casting vote.

The General Body meeting shall be normally held once in a year. Extra-ordinary
General Body meeting may be held on the resolution of the executive committee to
transact any special business, or upon the written request of a group of members
representing at least 1/3rd of the total members of the association.

Notice of the General Body meeting shall be issued by the secretary by hand
delivery / post / courier / e-mail / notification in the official web-site furnishing the
agenda of the meeting and time and place of the meeting at least 7 days in
advance.

Quorum of the General Body meeting is 1/3rd of the total members. If the required
quorum is not available, the meting shall be adjourned by at least SEVEN days with
the same agenda. If in the adjourned meeting also the required quorum is not
available, the members present in the meting are treated as quorum and the
business is transacted. However, any amendments of rules and regulations shall
not be taken up in such adjourned meetings, excepting the original required
quorum is available.

18. ALTERATIONS OF MEMORANDUM & RULES AND REGULATIONS

Any alteration or amendment of the memorandum or rules and regulations of the


association shall be effected by the votes of 2/3rd of the members present in
person at the general body meeting of the association for which notice has been
given to the members specifying the proposed alteration or amendment subject to
the provisions of the Andhra Pradesh Societies Registration Act 35 of 2001.

20. COPIES OF BY-LAWS

Copy of by-law will be published in the official web-site of the association and will
also be mailed to the members email id available on records.

21. OBLIGATIIONS OF MEMBERS / RESIDENTS

The member/resident shall be responsible for any damage suffered by other


members or damage to common facilities due to the misconduct of any member of
the family or visitors of the member/resident. The monetary value of the damage
shall be assessed by the Executive Committee and the concerned member/resident
shall pay the amount within 30 days of receipt of written intimation from the
Secretary.

Any member who is disposing off his/her plot/house by sale or transfer or gift shall
intimate the Association the name of the new owner and his address. The member
shall also clear all the dues outstanding in his name and obtain a No Due
Certificate before disposing off the plot/house in favour of the new owner.

Every member/resident shall comply with these rules and regulations. Failure to
comply will be a ground for action to recover the sums due or damages or other
relief by the Executive Committee.

22. INDEMNITY

Every member of the Association, any office bearer, servants of the Association
shall be indemnified by the association and it shall be the duty of the association to
pay out of its funds, all costs, losses and expenses which any such member, office
bearer or servant of the association may incur or may become liable by reason of
any act or things done by him/her there in any way in honest and bonafide
discharge of his/her duties in compliance with these rules and regulations.

23. WINDING UP:

In case the Association has to be wounded up the property and funds of the
association shall be transferred or paid to some other institution with similar aims
and objectives as the association. Such resolution shall be authorized in a General
Body, convened for such purpose, with the approval of at least 3/5 th of the total
members of the association.
