On orabout Febuary 28,2014, there was am incident taking place neu he drive through window at Chacho's. Officer Encina was advised of the incident and headed ouside see what was going on, I was walking closely behind Officer nena and followed him ouside, | observed Officer Encina talking tothe driver of the car that Marquise Jones was passenger. ‘The driver of the vehicle appeared to be young and had long hair. 1 saw Officer Eneina detain the diver by placing his body aginst the drive's ody. While doing so, Officer Encina reached inside ofthe ear to take the keys out ofthe ignition. 4. Thala clear view of OfticerEncina, the diver ofthe veel and Marquise Jones, Marquise Jones was siting in the car as Officer Encina dealt with the diver ofthe ea, Marquise appeared tobe nervous by what was taking place, observed Marquise Jones open the door and savy him take ofT running in the opposite dtetion of Officer Encina. I had a clear view of Marquise Jones and know without a doubt that he did ‘not have a gun in his hand. From where I was standing, I would have easily been able to see ithe had a gun because nothing was blocking my view. Further, he did make any movements that | was not fearfil for my life nor did I observe anyone in danger situation as Marquise took off running. As Marquise rn away I heard the sound of gunshots. Marquise was shot in the back by Officer Encina as he was running towards Perrin Beite. Officer Bncina shot ‘Marquise without warning him or advising him to stop. Marquise was not attempting to harm anyone, had not committed a crime and was simply running in the opposite direction from us ‘when Officer Eneina shot him, Isaw Marguse's body onthe ground and wondered why he was Jef onthe ground so ong. Twas at work uni 8:45 am. 6 —_Asamemployee of Chaco, Iam fanilir with Officer Encina. Officer Encinas familie with the employees who were working at Chacho's onthe day Marquise was shot. 7. Despite witnessing the entire incident, none ofthe detectives took my statements. {had not been contacted by anyone regarding the incident an felt I needed to come forwar io explain what I witnessed because Marquise Jones did not do anything that justified Officer cine shooting him, 1 am giving my statements voluntarily and on my own will, Ihave not been promised anything from anyone for doing so, Ido ot have a persona relationship with the family of Marquise Jones and/or the attorneys representing the family 8 Wisand mains my belief hat Marquise Jones was murdered.
