The article Immigration Law-Right To Counsel-California District Court Finds Due


Process May Include Right of Access To Counsel For Detained Noncitizens, discusses how
noncitizens are not being given the sixth amendment, The rights to counsel is the sixth
amendment and that is what is being violated as well as the fifth amendment which is the right to
a full and fair hearing. Mainly the sixth amendment is not given to non citizens and judges even
say how they do not have that certain right. Criminals are being given more rights rather than
non citizens which is a total confusion for everyone since criminals have more protection.
Noncitizens have many restrictions and the judges know they are violating their rights but
believe there is nothing wrong with that.
Harvard Law Review is bias against the violation of rights for noncitizens. They show
both sides of the judges as well as the noncitizens. This article is useful because it shows how the
rights of noncitizens whom are in jail or other things related to that are not being given the same
right as others. Which comes to show how rights are being violated and how immigrants are
already said to not be able to have the same rights. The court is supposed to be fair to everyone
but only towards immigrants it is not fair. I believe this article is useful because it just shows and
supports my claim that immigrants are not treated the same as everyone else. They are in a way
being taken advantage of since their rights are being violated and that is not fair. Immigrants
know their rights but many believe that they do not know them which is why they are taken
advantage of.

The article discussed a major issue of whether or not a foreign born child should be
considered a citizen. While the parents were out of the country the mother had the child in a
different country which is not the U.S. therefore the child was seen to be a citizen of the country
where the parents had the child. The issue with this is that many think those people just come to

the U.S. to be able to have protection and be able to get their residency. The court also stated
how at least one of the parents need to be a citizen in order to have their child be a U.S. citizen.
If there is no proof or sign of one parent being a citizen then the child is not able to become a
U.S. citizen. The reason being is because the court does not want any aliens to be bringing
children into the U.S. since that is considered to be illegal as well as considered being
immigrants. The other conflict is said to be how individuals born abroad have to be automatically
denied citizenship since they are not born in the United States. Once leaving the country and
born somewhere else they are considered to be citizens of the country born in rather than citizens
of where their parents have been residents/citizens of.
I will not being using this article since there is not any useful information for my
discussion question based off immigration. The article discusses more about the issues being
faced when the parents leave the country and have a child whom they are trying to make a U.S.
citizen. I realized that no information is being given to be about the difficulties that immigrants
face. This article focuses on different problems rather than the one I am researching. It does talk
about immigration but not into the extent as to what I was looking for. I do not have any
questions based off this article because I believe the article focuses on different issues and does
not connect in any way with my research.

The article The Neglect of the Immigration Child: Making the Case for a
Child-Centered Approach to United States Immigration Policy, Ivon Padilla discusses how
there was an executive action being passed for immigrant children but was blocked. She then
goes on to discuss how many say that the U.S. is a nation that welcomes foreigners yet are
neglected. Immigrant children are only used to work and that is the only reason as to why they
may be welcomed. Young children are affected the most since their parents are getting deported
so they are left on their own to make a living. Although this is illegal people still hire children to
work and treat them as adults when they are not. Immigrant children are not allowed to have a
saying with their parents since they are not present.
I will be using this article because it shows how there are grants for immigrants but many
do not want those grants to be passed. This is a controversial topic because it says how
immigrants are welcomed yet are not treated the same. I will also be using this article because it
helps me prove my argument that immigrants are taken advantage of. This article discusses how
the rights of immigrants are violated as well as the rights of kids. By using this article it helps me
a lot since data is given to show how many people have migrated and the amount that work in
the U.S. Another reason as to why I will use this article is because it discusses the reasons as to
why people migrate which is a major key component. Overall the article discusses all the

violations made towards children who are immigrants and I feel as if this will help to show how
they are being discriminated.

The article Effects of Mexican Immigrant Parents Daily Workplace Discrimination on


Child Behavior and Family Functioning discusses that Mexicans are the rapid growing
immigration groups. Mexicans either bring or have children here in the United States and affects
children's development due to all the discrimination they go through. Ana Gassman Pines go on
to say how the mental health of children is being affected because of the parents rather than of
others. Due to people discriminating the child's parents it causes the parents to become depressed
or stressed . Then the parents take it out on the children and make them feel bad as well as show
them the difficulties they go through on a daily bases.She also states how marriage is being
affected because of the stress being put on the parents. Due to all the discrimination going on
immigrants are forced to stay in the shadows and do not speak up since they are scared of losing
their job. There were even surveys conducted that proved to show how family members were all
affected because of the discrimination going on.
Anna Gassman-Pines is bias towards discrimination in the world because the experiment
conducted showed how many families are affected. She showed how everyone's mental health
was affected especially the kids and proved how discrimination affects many people. I will not
be using this article since I believe that the information I was looking for was not included.
Although the experiment that was conducted does seem to help with my research I feel as if there
needs to be more information rather than just how the families felt. For example what actions
were done towards the workers to make them feel sad or depressed? Was discrimination only
occurring to immigrants or was it to all the workers? Since the article mainly focused on how the
families felt I do not believe some of the information provided will help me with most of my
research based on immigration.

The article Crime And Immigration New Forms Of Exclusion And Discrimination
focuses on stating different types of forms of discrimination amongst immigrants. Society is
separating immigrants from their daily life routine and are also discriminating many based off
their looks. The police has now been able to stop people based off their looks and that is a major
discrimination point. This allows them to be able to ask any person for their documentation

information and if they are immigrants then they are allowed to deport the person. Immigration
has said to be increasing rapidly over the years because of conflicts occurring in their homeland.
The U.S. has put more money into border reinforcement to stop immigrants from passing but
doing so made no change at all. Instead this influenced immigrants to pass through different parts
of the border and settle into the United States. Another way of discrimination being shown is
through education and the place where many immigrants live. Education is not the same for
immigrants in certain areas and the same opportunities are not being given to them. Then some
immigrants live in poverty and are secluded from society due to their way of living. This has
caused for racial discrimination to increase world wide since immigrants are being portrayed as
bad people due to their conditions of living.
Mary C. Waters is bias against the immigration laws due to her stating how the laws are
unfair and cause discrimination to increase. I will be using this article because there are great
examples of how immigrants live in fear now due to the law where police officers can now stop
anyone based off their looks. This article is useful since it shows how immigrants are now living
in fear everyday hoping to not get stopped by a police officer. Their way of living has now
changed and proves how racial discrimination has increased. A question I have is why are police
officers allowed to stop anyone whom they suspect to be suspicious? Are there certain looks that
police officers are in the lookout for? Do immigrants have a right to not show their identification
as well as not say where they are from? Are there any protection services for immigrants once
taken in? I am asking these questions because in the article no rights are being stated and it
seems as if some rights of immigrants are being violated.
