hereby makes the following rules further to amend the All
India Services (Death-cum-Retirement Benefits) Rules, 9. 687 6-7-74

1. (1) These rules may be called the All India S e ~ c e s 11. 946
(Deathcum-RetirementBenefits) Amendment Rules,2004. 12. 2 7 0
(2) They shall come into force from the date of their 13. 724
publication in the Official Gazette.

2. In the All India Senices (Death-cum-Retirement
Benefts) Rules, 1958 (hereinafter referred to as the said 15. 2635
rules), to sub-rule (2) of rule 16,the following proviso shall 16. 2030 21112-75

"Provided further that the State Government 18. 1%
concerned on a request made by the member of the service
may, if satisfied and for reasons to be recorded in writing, 19. 316

3. In the said rules, in rule 26, for the provisos to 21. 758
sub-rule (I), the following provisos shall be substituted, 22. 757

"Provided that the previous sanction may be granted
by the State Government concerned on whose cadre 24. 1765
the member of the service is borne and who is not 25. 579
holding a post higher than a post in the pay scale of 26. 830
Rs. 22400-24500and has not worked under the Central
Government during the preceding five years prior to ' 27. 831
his retirement from the service : 28. 1598
Provided further that no such order shall be made
without giving the pensioner concerned a n
opportunity of showing cause against such
declaration :
Provided also that a pensioner who has been
permitted by the Central Government to take up a
particular commercial employment during leave
preparatory to retirement shall not be required to
obtain subsequent permission for his continuance
in such employment after retirement."
