A BILL TO BE ENTITLED

1 AN ACT

2 relating to the ability of property owners to protest the adoption

3 of municipal zoning regulations and boundaries.

4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

5 SECTIONA1.AASection 211.006(d), Local Government Code, is

6 amended to read as follows:

7 (d)AAFollowing a protest, [If] a proposed initial regulation

8 or boundary or change to an existing regulation or boundary may

9 [change to a regulation or boundary is protested in accordance with

10 this subsection, the proposed change must receive, in order to]

11 take effect only on[,] the affirmative vote of at least

12 three-fourths of all members of the governing body if the[. The]

13 protest is [must be] written and signed by the owners of at least 20

14 percent of either:

15 (1)AAthe area of the lots or land covered by the

16 proposed regulation or boundary [change]; or

17 (2)AAthe area of the lots or land immediately adjoining

18 the area covered by the proposed regulation or boundary [change]

19 and extending 200 feet from that area.

20 SECTIONA2.AAThis Act takes effect September 1, 2017.
