OIL AND NATURAL GAS BUSINESS AND/OR ACTIVITY

THE STATE MINISTER OF ENVIRONMENT,

Considering : a. that in the framework of conservation


of environment accommodating capacity,
it is necessary to make efforts of
controlling businesses and/or
activities causing environment
pollution;
b. that oil and natural gas business
and/or activity are potential to cause
environment pollution, therefore it is
necessary to control the emission
disposed into air;
c. that in consideration referred to in
letter a and letter b, and to
implement the provisions of Article 8
paragraph (1) of Government Regulation
Number 41 of 1999 on Air Pollution
Control, it is necessary to stipulate
Regulation of the State Minister of
Environment on Emission Quality

HAS DECIDED:

To lay down : REGULATION OF STATE MINISTER OF


ENVIRONMENT ON EMISSION QUALITY STANDARD
OF IMMOBILE SOURCES FOR OIL AND NATURAL
GAS BUSINESS AND/OR ACTIVITY.

Article 1

That which is meant in this Ministers Regulation by:

1. Crude oil is the result of natural process in the
form of hydrocarbon which, in the condition of
atmosphere compression and temperature in the form of
liquid or solid phase, including asphalt, mineral wax
or ozokerit and bitumen obtained from mining process,
but not including coal or other hydrocarbon deposit
in solid form obtained from activities not relating
to oil and natural gas business activity.

2. Natural gas is the result of natural process in the


form of hydrocarbon which, in the condition of
atmosphere compression and temperature is in the form
of gas phase obtained from the process of oil and
natural gas mining.

3. Exploration and production activities are activities


intended to obtain information on geological
condition in order to find and obtain the estimated
oil and natural gas reserve from the designated work
area and to produce oil and natural gas from the
designated work area, consisting of well drilling and
completion, development of transportation, storing
and processing facilities for separation and
purification of oil and natural gas in the field and
any other supporting activities.

4. Processing is an activity of refining, obtaining
parts, improving quality and increasing the value
added of crude oil and/or natural gas, but not
including field processing.

5. Liquefied Natural Gas (LNG) activity is an activity


of processing natural gas into liquid phase by
cooling process to the very low temperature at
atmosphere compression.

6. Oil and gas transport activities are activities of


transferring crude oil, natural gas and/or their
processed products from the work area or retaining
and processing place, including transportation of
natural gas by transmission and distribution pipe.

7. Oil and gas storing activities refer to activities of


receiving, collecting, retaining and release of crude
oil and/or natural gas.

8. Oil and gas commercial activities refer to activities


of purchase, sale, export, import of crude oil and/or
its processed products, including natural gas trade
by pipe.

9. Emission quality standard of oil and natural gas


business and or activity refers to the limit of

maximum content of oil and natural gas activity
emission allowed to enter or to be entered into
ambient air.

10. Key parameter is the parameter set as the quality


standard according to the characteristics of emission
source.

11. Factor of oxygen correction is the correction of


calculation made on the result of measuring into a
result of corrected emission calculation on the
corrected concentration of oxygen so prescribed.

12. Calculation method of emission load is calculating


the emission load based on the activity data obtained
by calculating the system and other additional
parameters obtained from laboratory measurement or
standard factors.

13. Measuring method of emission load is calculating the


emission load based on continuous measuring of
concentration and flow of gas from emission source.

14. Emission source of combustion process is an emission


source producing emission from exothermic reaction
between fuel and oxygen, except the gas is burnt for
sulfur processing.

15. Production process emission source is an emission
source producing emission other than from combustion
process resulting from intentional or unintentional
reactions between materials (compounds) or their
changes, including process of material decomposition
by thermal method and forming of materials used as
the raw materials of production process.

16. Fugitive emission source refers to emission


technically unable to go through stack, ventilation
or any other emission disposing system equal thereto.

17. Sulfur catching unit is a process unit for processing


gas pollutant containing sulfur converted into any
other products.

18. Boiler or steam generator or process heater or heat


treater is an equipment using liquid or gas fuel
having the function of producing hot water and/or
steam and/or for requirement of transferring other
energy.

19. Flaring is continuous or non-continuous combustion of


gasses produced by oil and gas operational activities
in stationary stack, either vertical or horizontal.

20. Venting is the release of hydrocarbon gasses


intentionally and continuously or non-continuously

produced from oil and gas operational activities,
namely from fluid separation process into open air
through stationary stack.

21. Gas turbine is a machine having liquid or gas fuel


using gas flow for propelling turbine strips
consisting of compressor, burner and power generating
turbine.

22. Internal Combustion Engine or flaring motor is a


machine having fluid or gas fuel that changes heat
energy into mechanical energy by using reciprocal
machine by spark ignition or compression ignition.

23. Sulfur Thermal Oxidizer or acid gas incinerator is a


process unit for processing gas pollutant containing
sulfur by heat oxidation or incineration.

24. Glycol Dehydrator Vent is a release system of


hydrocarbon and steam emitted into atmosphere from
fluid drying system to separate water from gas or
natural liquid gas.

25. Open Burning is intentional burning of liquid or


solid material containing hydrocarbon in open pit,
drum or container, not including associated liquid in
soil incinerator and flaring in order to train fire
unit.

26. Fluid Catalytic Cracking Unit is a process of oil
cracking by using fine catalytic grains flowing
continuously between reactor and regenerator by using
air, oil steam and water steam as propelling
material.

27. Fluid Catalytic Cracking Unit Catalyst Regenerator is


one or more regenerators constituting a part of fluid
catalytic cracking unit, in which regeneration
process of burn-off coke and catalyst or contact
material occurs, including regeneration of combustion
air blower.

28. Burn-off coke is charcoal separated from the surface


of Fluid Catalytic Cracking Unit by combustion
process in catalyst regenerator.

29. Claus Sulfur Recovery Plant is a process unit taking


back sulfur from hydrogen sulfide by a reaction of
steam phase catalyst from sulfur dioxide and hydrogen
sulfide.

30. Sweetening Unit is a process unit separating H2S


and/or CO2 from sour natural gas flow.

31. Boil off gas is emission of methane gas from LNG


caused by ambient air heat and change of barometric
compression.

32. Continuous Emission Measurement System, hereinafter
referred to as CEMS, is a system intended to
determine the quantity of content of an emission
parameter or flow rate by periodical measurement,
used in-site in stack or by extraction using a gauge
installed close to the stack therein excluding
measurement based on individual sampling from the
stack.

33. Normal condition refers to operational condition


according to operation design parameter.

34. Abnormal condition refers to operational condition


beyond normal operation parameter and still
controllable against the abnormal equipment system or
process so that the emission quality standard of oil
and natural gas activity is passed, covering the
condition at shutdown, start-up, upset or
malfunction.

35. Emergency is an occurrence or a series of occurrences


threatening and disturbing the life and living of
workers and or community caused by air pollution from
oil and natural gas activity and or business, which
could cause human mortality, environment damage, loss
of properties, and psychological impacts.

36. Emergency response is a series of activities
conducted immediately at the time of occurrence of
emergency of air pollution control to handle any
arising bad impacts, covering activities of saving
and evacuating victims, properties, fulfillment of
basic requirements, protection, management of
refugees, infrastructures securing and recovering.

37. Minister is the minister coordinating government


affairs in environment management.

Article 2

Emission quality standard of immobile sources for oil


and natural gas business and/or activity herein
regulated includes emission quality standard of immobile
sources for business and/or activity of:

a. exploration and production of oil and natural gas;


b. oil processing unit;
c. LNG refinery; and
d. transportation, storing and trading of oil and
natural gas.

Article 3

(1) Emission of oil and natural gas exploration and


production activities as referred to in Article 2
letter A is originating from:

a. combustion process covering emission from
internal combustion engine, gas turbine, boiler,
steam generator, process heater, heat treater,
and flare;

b. production process covering emission from


sweetening unit, sulfur catching unit, sulfur
thermal oxidation unit or acid gas incinerator,
and glycol dehydration release unit; and

c. fugitive covering emission caused by leakage of


valve, flange, pump, compressor, pressure release
instrument, drain / blowdown, leakage from
production process equipments and their
components, emission from storage tank and waste
water treatment installation, and casing head
test.

(2) Emission of oil processing unit as referred to in


Article 2 letter b is originating from:

a. combustion process covering emission sources from


internal combustion engine, gas turbine, boiler,
steam generator, process heater, and flare;

b. production process covering emission from fluid


catalytic cracking unit catalyst regenerator,

emission from decoking process, sulfur catching
activity, and claus sulfur recovery plant; and

c. fugitive covering emission caused by leakage of


valve, flange, pump, compressor, pressure release
instrument, leakage from production process
equipments and their components, and emission
from storage tank and waste water treatment
installation.

(3) Emission of LNG refinery business and / or activity


as referred to in Article 2 letter c is originating
from:

a. combustion process covering emission from


internal combustion engine, gas turbine, boiler,
steam generator, process heater and flare;

b. production process covering emission from boil


off gas and acid gas incinerator; and

c. fugitive covering emission caused by leakage of


valve, flange, pump, compressor, pressure release
instrument, leakage from production process
equipments and their components, and emission
from storage tank and waste water treatment
installation.

(4) Emission of transportation, storing and trading of
oil and gas as referred to in Article 2 letter d is
originating from:

a. combustion process from internal combustion


engine; and
b. fugitive covering emission caused by leakage of
valve, flange, pump, compressor, pressure release
instrument, leakage from production process
equipments and their components, and emission
from storage tank and waste water treatment
installation.

Article 4

(1) The quality standard of emission for oil and natural


gas business and / or activity regulated herein
covers:

a. the quality standard of emission originating from


combustion process as specified in Attachment I
constituting an integral and inseparable part of
this Ministers Regulation;

b. the quality standard of emission originating from


production process as specified in Attachment II
constituting an integral and inseparable part of
this Ministers Regulation;

c. the quality standard of emission originating from
the process of blending of more than one (1) type
of fuel as specified in Attachment III
constituting an integral and inseparable part of
this Ministers Regulation.

(2) The quality standard of emission from combustion


sources as referred to in paragraph (1) letter a
shall not apply to:

a. emission sources having the capacity below 100


hp;

b. emission sources operating cumulatively less than


1000 hours per annum;

c. emission sources used for purposes of emergency,


repair or maintenance activities that
accumulatively take place less than 200 hours per
annum; and/or

d. emission sources used to move a crane and welding


equipment as well as energy source for the
purpose of oil or gas drilling activities.

(3) For emission originating from combustion process at


the capacity < 25 MW or other equivalent units using
gas fuel:

a. the quality standard for sulfur dioxide parameter
as specified in Attachment I points 1.a to 1.c is
not applied, if the sulfur content in the fuel is
less than or equal to 0.5% weight; and

b. the quality standard for particulate total


parameter as specified in Attachment I points
1.a. to 1.c. is not applied.

(4) The quality standard of emission originating from


flaring unit combustion process as specified in
Attachment I point 1.d. shall not apply for pilot
flaring and flaring of activities of well drilling
and maintenance, gas casing and gas migration from
oil well and storage tank.

Article 5

(1) Persons in charge of businesses and / or activities


shall report any emission sources not included in the
emission sources as referred to in Article 3.

(2) The quality standard for emission sources as referred


to in paragraph (1) shall be stipulated by the
Minister based on the emission quality standards as
referred to in Article 4 by considering the
suitability of characteristics of emission sources.

Article 6

Any person in charge of oil and natural gas business and


/ or activity as referred to in Article 2 shall conduct:

a. emission inventorying;
b. emission management;
c. emission monitoring;
d. reporting of the result of emission monitoring; and
e. handling of air pollution emergency.

Article 7

(1) Emission inventorying as referred to in Article 6


letter a covers the activities of:

a. identification of emission source and the process


causing the emission to occur, including the name
or code used for identification of emission
source, coordinate point and parameter of main
emission produced from emission source;

b. calculation of emission load of key parameter and


CO2 from all emission sources available in the
authorized area of activity;

c. description of the method applied for calculating


the emission load;

d. recording and description of the data of
activity, emission factor, oxidation factor and
conversion of each emission source, of which the
emission load is calculated;

e. documentation of proofs that can show the


correctness of activity data calculation used to
support the calculation of emission load; and

f. description of the approach used for taking


sample or analyzing to determine the net
calorific value, carbon content, emission factor,
oxidation and conversion factors for each
emission source.

(2) The calculation of emission load as referred to in


Article 7 paragraph (1) letter b shall be conducted
by using:

a. the method of emission load calculation; or

b. the method of emission load measuring.

(3) The method of emission load calculation as referred


to in paragraph (2) shall obtain the Ministers
approval.

Article 8

(1) The management of emission as referred to in Article


6 letter b shall consist of:

a. designation of persons in charge of activities of


emission inventorying, management, monitoring and
reporting of emission source and handling of air
pollution emergency;

b. providing, operation, maintenance and repair of


the facilities and infrastructures covering
prevention, treatment and ensuring that all
systems are well-operating so that the emission
disposed in normal condition meets the quality
standard;

c. providing, recording and filing of records or log


books relating to activities of operation,
maintenance and repair of facilities and
infrastructures of air pollution control; and

d. management of sources potential as fugitive


emission sources by inventorying and calculation
of pollution load from fugitive emission sources
and checking, maintenance and repair of
equipments regularly to prevent and reduce
emission of fugitive sources.

(2) In performing emission management as referred to in
paragraph (1), the person in charge of business and /
or activity shall be prohibited from:

a. conducting open combustion of hydrocarbon fluid


or solid materials intentionally in open pit,
drum or container, not including associated
hydrocarbon fluid in soil flare and combustion
for training of fire fighting in the area of fire
training ground; and

b. disposing associated gas directly by venting,


except at the Ministers permission.

(3) The prohibition as referred to in paragraph (2)


letter b shall not apply to venting from gas casing,
gas migration from oil and gas well, production
storage tank, gas-driven pneumatic device, gas driven
injection pumps, compressor ancillary system,
compressor seal system, pig launcher / receiver, well
completion / treatment / stimulation / work over /
testing / offloading, breather valves, and pressure
relief valves.

(4) Any person in charge of oil and natural gas business


and / or activity shall be required to completely
document the reasons for conducting venting based on
risk analysis and system integrity.

Article 9

The emission monitoring as referred to in Article 6


letter c shall be conducted by:

a. CEMS; or
b. manual.

Article 10

(1) Any oil and gas business and / or activity that:

a. is already in operation or in construction phase


upon stipulation of this Ministers Regulation,
shall install and operate CEMS in one of the
stacks with the highest pollution load
originating from emission source of combustion
process at the capacity over 25 MW, which is
calculated based on the emission load in the
initial phase of installing plan;

b. will be built after this Ministers Regulation


has been stipulated shall install and operate
CEMS in the emission source stack by:
1. combustion process with fossil fuel operating
continuously at the capacity over 25 MW;

2. combustion process with fossil fuel at the
capacity over 25 MW or less than 25 MW with
sulfur content in the fuel over 2% and
operating continuously;
3. fluid catalytic cracking unit catalyst
regenerator, sulfur recovery plant, and
carbon absorber in waste water treatment
system for activity of oil processing unit
and LNG Refinery; and
4. sweetening unit in the activity of onshore
natural gas processing.

(2) Any persons in charge of businesses and / or


activities conducting emission monitoring as referred
to in Article 9 letter a shall:

a. install an instrument in CEMS that can monitor


and measure the parameters of:
1. SO2, NOx, Opacity, O2, CO and flow rate and
calculating CO2 and Total Particulate for
emission source of combustion process;
2. SO2, NOx, Opacity, O2, CO and flow rate and
calculating CO2 and Total Particulate for
emission source of fluid catalytic cracking
unit catalyst regenerator;
3. SO2 and flow rate for emission source of claus
sulfur recovery plant;

4. hydrocarbon and flow rate for emission source
of absorber carbon process in waste water
treatment system for activities of oil
processing unit and LNG refinery; or
5. flow rate for emission source and sweetening
unit in the activity of onshore natural gas
processing.

b. provide and operate monitoring facilities and /


or sampling by considering the aspects of
convenience in data taking, representation of
samples taken, data validity and work safety;

c. prepare and keep document / manual of quality


control and quality assurance to guarantee the
CEMS data quality produced as specified in
Attachment IV constituting an integral and
inseparable part of this Ministers Regulation;

d. calculate the average result of monitoring in the


average hours with the unit adjusted to the unit
of quality standard for SO2, NOx, O 2, CO
parameters and Flow Rate;

e. calculate the average result of monitoring in the


average hours with the unit adjusted to the
quality standard unit for opacity and temperature
parameters in the average per minute;

f. keep and document the original record relating to
activities of calibration, repair and
maintenance, and adjustment conducted, including
digital record and / or chart record;

g. document abnormal condition by explaining the


date of commencement of event, the field name,
facility / unit, cause of event, complaints of
public and handling effort no longer than three
(3) work days after the abnormal condition has
occurred; and

h. keep the data as referred to in letter f and


letter g at the shortest for five (5) years.

Article 11

(1) The data of CEMS monitoring result shall be


considered valid if:

a. CEMS is operated according to the specification


of performance as written in the manual;

b. CEMS is operated according to the criteria of


quality assurance written in the manual;

c. there is no part of CEMS not functioning;

d. calibration or zero drift of the gauge does not
exceed 2x calibration drift performance
specification;

e. calibration or zero drift check of the monitoring


instrument is conducted according to the schedule
written in the manual;

f. the emission source is operating or producing the


pollutant according to the parameter monitored;

g. the average data are calculated based on valid


data;

h. the average data per one (1) minute consist of at


least 75 percent of the result of valid data
reading;

i. the average data per one (1) hour consist of at


least 75 percent of the result of valid data
reading; and

j. the average daily data consist of at least 18


valid data in the average per hour.

(2) The data of CEMS monitoring result meet the quality


standard if 95% or more of the data of result of
daily average measure for 3 months meet the quality
standard.

Article 12

(1) The emission monitoring as referred to in Article 9


letter b shall apply for emission originating from:

a. combustion process by the design capacity:


1. smaller or equal to 570 KW or any other unit
equivalent thereto, conducted at least once
(1) in three (3) years;
2. 570 KW up to 3 MW or any other unit
equivalent thereto, conducted at least once a
(1) year;
3. greater than 3 MW or other equivalent unit,
conducted at least once (1) in six (6)
months;

b. production process, conducted at least once in


six (6) months.

(2) Any persons in charge of businesses and / or


activities conducting monitoring as referred to in
paragraph (1) shall be required to:

a. record and document the data of activity /


condition of facility operation or emission
source such as the quantity of fuel used per time
unit, total electric power produced per time unit

if relating to combustion process for producing
electricity, sulfur content of fuel (% weight),
net calorific value of fuel, operational time,
and heat input, if the emission source is
relating to combustion process;

b. measure the sulfur content in fossil fuel once


every six (6) months for emission sources not
using SO2 emission quality standard, but using
Sulfur content parameter in fuel as quality
standard;

c. document any abnormal condition by explaining the


date of commencement of event, field name,
facility / unit, cause of incident, public
complaints and management effort for maximum
three (3) work days after the abnormal condition
occurs;

d. provide and operate the facilities of monitoring


and / or sampling by considering the aspect of
convenience in data taking, representation of the
samples taken, data validity and work safety;

e. document the date of sampling, laboratory


conducting the sampling, name of person in charge
of sampling or analysis; and

f. keep the result of laboratory analysis and
document of sampling method and / or method used
by laboratory for sample analyzing.

Article 13

(1) The reporting of emission monitoring result as


referred to in Article 6 letter d includes the
reports of:

a. result of emission inventorying as referred to in


Article 7 paragraph (1) letter a, letter b,
letter c, letter d and letter f;

b. result of CEMS monitoring according to the


reporting format as specified in Attachment V.b.,
covering:
1. the report of result of daily average
monitoring;
2. the report of period and amount of parameter
content resulting from measure in excess of
the quality standard;
3. the report of grounds of measure result in
excess of the quality standard;
4. the report of period of non-operating CEMS;
5. the report of summary of abnormal condition
as referred to in Article 10 paragraph (2)
letter g.

c. result of manual monitoring and summary of
abnormal condition according to the reporting
format as specified in Attachment V.a.

(2) The persons in charge of business and / or activity


shall report the result of monitoring as referred to
in paragraph (1) to the Minister with the copy to the
governor, regent / mayor and agency assigned in oil
and natural gas sector at least:

a. annually for the result of emission inventorying


as referred to in paragraph (1) letter a;

b. quarterly for the result of CEMS monitoring as


referred to in paragraph (1) letter b; and

c. six (6) monthly for the result of manual


monitoring and the summary of abnormal condition
as referred to in paragraph (1) letter c.

Article 14

The handling of air pollution emergency as referred to


in Article 6 letter e includes:

a. description on the organization responsible for


handling of emergency, including organizational
structure, role and responsibility and mechanism of
decision making;

b. procedure for analyzing the risk and response to
emergency;

c. description on the plan and procedure of emergency


response, including detailed description of the
equipments and location, procedure, training, warning
procedure and communication system;

d. procedure for conducting test, evaluation and


modification of emergency plan;

e. performing emergency handling according to the


prescribed procedure, including activities of saving
and evacuating the victims, properties, fulfillment
of basic requirements, protection, management of
refugees, saving, and recovery of infrastructures and
facilities; and

f. notification to the Minister with copy to the


governor, regent / mayor and agency assigned in oil
and natural gas sector, in case of emergency no
longer than 1x24 hours and the written report no
longer than 7x24 hours after the incident according
to Attachment V.c hereto.

Article 15

If the result of study on Environment Impacts Analysis


(AMDAL) for oil and natural gas business and / or

activity requires any stricter quality standard of
emission from immobile sources than the quality standard
of emission of immobile sources as referred to in the
Attachment hereto, the quality standard of emission of
immobile sources required by AMDAL shall apply.

Article 16

This Ministers Regulation coming into effect, Decree of


the State Minister of Environment Number 129/2003 on
Quality Standard of Emission of Oil and Natural Gas
Business and / or Activity shall be revoked and declared
null and void.

Article 17

This Ministers Regulation shall come into effect one


(1) year commencing as of the date of stipulation.

BME(x,m) = Emission quality standard for parameter x, if


fuel blending is conducted.
BME(x,f1) = Emission quality standard of parameter x, for

Q(f1) = Actual heat of fuel f1 supplied to the system.
BME(x,f2) = Emission quality standard of parameter x, for
f2 fuel.
Q(f2) = Actual heat of fuel f2 supplied to the system
Qt = Total energy requirement.

Calculation example:

Oil refinery activity for boiler unit at the capacity


less than 25 MW, using mix fuel between gas (fuel 1= f1)
and oil (fuel 2= f2) with the composition as follows:
