(Sec. 71.1, IPC). The importation of a patented product without the authorization of the

wearing a black polo shirt embroidered with the 2-inch Lacoste crocodile logo appeared on
the front page of every newspaper.
Lacoste International, the French firm that manufactures Lacoste apparel and owns the
Lacoste trademark, decided to cash in on the universal popularity of the boxing icon. It
reprinted the photographs, with the permission of the newspaper publishers, and went on
a world-wide blitz of print commercials in which Sonny is shown wearing a Lacoste shirt
alongside the phrase Sonny Bachao just loves Lacoste.
When Sonny sees the Lacoste advertisements, he hires you as lawyer and asks you to sue
Lacoste International before a Philippine court:

12. In 1999, Mocha Warm, an American musician, had a hit rap single called Warm Warm
Honey which he himself composed and performed. The single was produced by a California
record company, Galactic Records. Many noticed that some passages from Warm Warm
Honey sounded eerily similar to parts of Under Hassle, a 1978 hit song by the British rock
band Majesty. A copyright infringement suit was filed in the USA against Mocha Warm by
Majesty. It was later settled out of court, with Majesty receiving attribution as co-author
of Warm Warm Honey as well as a share in the royalties.
By 2002, Mocha Warm was nearing bankruptcy and he sold his economic rights over Warm
Warm Honey to Galactic Records for $10,000.

Mocha Warm, Majesty and Chef Jean are entitled to be credited as authors of the remixed
Warm Warm Honey because it is their joint work (Sec. 178.2 IPC). Mocha Warm
retained his moral right to be credited as an author of the remixed Warm Warm Honey
despite the sale of his economic rights to Galactic Records, because his moral rights exist
independently of his economic rights (Sec. 193 IPC). John Blake cannot be credited for the
use of his work because copyright extends only during the lifetime of the author and 50
years after his death.
b. Who are the particular parties or entities who exercise copyright over the remixed
Warm Warm Honey? Explain.
The copyright over the remixed Warm Warm Honey belongs to Galactic Records,
Majesty and Chef jean. The copyright of Mocha Warm belongs to Galactic Records,
because he assigned it to Galactic Records (Sec. 180 IPC). Majesty also has a copyright,
because it is a co-author (Sec. 178.2 IPC). The copyright of Chef Jean belongs to him even
if his work was commissioned by Planet Films, because the copyright remained with him
(Sec. 178.4 IPC).
13. Diana and Piolo are famous personalities in show business who kept their love affair secret.
They use a special instant messaging service which allows them to see one anothers typing
on their own screen as each letter key is pressed. When Greg, the controller of the service
facility, found out their identities, he kept a copy of all the messages Diana and Piolo sent
each other and published them. Is Greg liable for copyright infringement? Reason briefly.

Yes, Greg is liable for copyright infringement. Letters are among the works which are protected
from the moment of their creation (Sec. 172 IPC, Columbia Pictures v. CA). The publication of the
letters without the consent of the writers constitutes infringement of copyright.
Alternative Answer: No, Greg is not liable for copyright infringement. There is no copyright
protecting electronic documents. What are involved here are text messages, not letters in their
ordinary sense. Hence, the protection under the copyright law does not extend to text messages
(Sec. 172 IPC).
The messages that Diana and Piolo exchanged through the use of messaging service do not
constitute literary and artistic works under Sec. 172 IPC. They are not letters under Sec. 172(d).
For copyright to subsist in a message, it must qualify as a work (Sec. 172 IPC). Whether the
messages are entitled or not to copyright protection would have to be resolved in the light of the
provisions of the Intellectual Property Code.
14. Supposing Albert Einstein were alive today and he filed with the IPO an application for
patent for his theory of relativity expressed in the formula E=mc2. The IPO disapproved

Yes. The IPOs action is correct that the theory of relativity is not patentable. Under Sec. 22.1 of
the IPC, Discoveries, scientific theories and mathematical methods are non-patentable.
