CRIM CASE: QUALIFIED THEFT


INFORMATION
That on or about the 14th day of January, 2008 at Kawit Oriental, Kauswagan, Lanao Del Norte,
Philippines and within the jurisdiction of this Honorable court, the above named accused, conspiring,
confederating and mutually helping one another, did then and there wilfully, unlawfully and feloniously,
with intent to gain and without the consent of the owner thereof, harvest, take, steal and carry away
coconut fruits from within the coconut plantation owned by BORROMEO GORRE, valued at
P15,000.00, to the damage And prejudice of the said owner in the aforesaid sum of P15,000.00 Philippine
Currency.
RESOLUTION
Before this office for resolution is a complaint for qualified theft filed by Borrome Gorres of
poblacion Kauswagan Lanao Del Norte against the respondent for having allegedly harvested his coconut
plantation situated at Kawit Oriental, Kauswagan Lanao Del Norte without his knowledge and permission
with a total value of P15,000.00.
Finding a probable cause for investigation, the respondents were directed to submit to this office
their respective counter-affidavirs, which they complied with, hence, the case becomes due for resolution.
The complainant alleged in his sworn statement that his coconut plantation situated at Kawit
Orienta;, Kauswagan Lanao Del Norte was harvested by the respondents without his permission and
consent on January 14, 2008 at about 3:00 oclock in the afternoon as per information given to him by his
brother-in-law, Joselito Baliqueg who saw the incident.
Joselito Baliqueg witness for complainant stated in his sworn statement that on January 14, 2008
at about 3pm in the afternoon he was at the cocoland owned by his brother in law, the private complainant
in this case, located at Oriental, kauswagan Lanao Del Norte that while there he noticed and saw
respondent Ardiano Credo, Roselier Credo,
