AN ACT ESTABLISHING AN INSTITUTIONAL MECHANISM TO ENSURE THE IMPLEMENTATION OF
PROGRAMS AND SERVICES FOR PERSONS WITH DISABILITIES IN EVERY PROVINCE, CITY AND
MUNICIPALITY,AMENDINGREPUBLICACTNO.7277,OTHERWISEKNOWNASTHE"MAGNACARTAFOR
DISABLEDPERSONS",ASAMENDED,ANDFOROTHERPURPOSES
BeitenactedbytheSenateandHouseofRepresentativesofthePhilippinesinCongressassembled:
Section1.Section40ofRepublicActNo.7277,asamended,isherebyfurtheramendedtoreadasfollows:
"Section 40. Role of National Agencies and Local Government Units. (a) Local government units shall
promotetheestablishmentoforganizationsofpersonswithdisabilities(PWDs)intheirrespectiveterritorial
jurisdictions.Nationalagenciesandlocalgovernmentunitsmayenterintojointventureswithorganizations
orassociationsofPWDstoexplorelivelihoodopportunitiesandotherundertakingsthatshallenhancethe
health,physicalfitnessandtheeconomicandsocialwellbeingofPWDs.
"(b)Localgovernmentunitsshallorganizeandestablishthefollowing:
"(1)PersonswithDisabilityAffairsOffice(PDAO)
"A PDAO shall be created in every province, city and municipality. The local chief executive shall
appointaPWDaffairsofficerwhoshallmanageandoverseetheoperationsoftheoffice,pursuantto
itsmandateunderthisAct.PriorityshallbegiventoqualifiedPWDstoheadandmanthesaidoffice
incarryingoutthefollowingfunctions:
"(i)Formulateandimplementpolicies,plansandprogramsforthepromotionofthewelfareof
PWDsincoordinationwithconcernednationalandlocalgovernmentagencies
"(ii) Coordinate the implementation of the provisions of this Act, Batas Pambansa Big. 344,
otherwiseknownastheAccessibilityLaw,andotherrelevantlawsatthelocallevel
"(iii)RepresentPWDsinmeetingsoflocaldevelopmentcouncilsandotherspecialbodies
"(iv) Recommend and enjoin the participation of nongovernment organizations (NGOs) and
people'sorganizations(POs)intheimplementationofalldisabilityrelatedlawsandpolicies
"(v)GatherandcompilerelevantdataonPWDsintheirlocalities"(vi)Disseminateinformation
including, but not limited to, programs and activities for PWDs, statistics on PWDs, including
childrenwithdisability,andtrainingandemploymentopportunitiesforPWDs
"(vii)Submitreportstotheofficeofthelocalchiefexecutiveontheimplementationofprograms
andservicesforthepromotionofthewelfareofPWDsintheirrespectiveareasofjurisdiction
"(viii) Ensure that the policies, plans and programs for the promotion of the welfare of PWDs
arefundedbyboththenationalandlocalgovernment
"(ix)MonitorfundraisingactivitiesbeingconductedforthebenefitofPWDs
"(x)Seekdonationsincashorinkindfromlocalorforeigndonorstoimplementanapproved
workplanforPWDs,inaccordancewithexistinglawsandregulationsand
"(xi)Performsuchotherfunctionsasmaybenecessaryforthepromotionandprotectionofthe
welfareofthePWDs.

"Inconsiderationofbudgetrestraints,localchiefexecutivesoffourth(4th),fifth(5th)andsixth
(6th)classmunicipalitiesmay,inlieuofthecreationofaPDAO,designateafocalpersonwho
shallperformthefunctionsofthePDAO.PriorityinappointmentshouldbegiventoaPWDwith
experienceinprovidingservicestoPWDs.
"The establishment of a PDAO or the appointment of a focal person, as the case may be,
shouldbedoneinconsultationandcoordinationwiththeNationalCouncilonDisabilityAffairs
(NCDA),NGOsandPOa."
Section2.Referencestotheterm"DisabledPersons"onthetitleandothersectionsofthesameActarehereby
amendedtoreadas"PersonswithDisabilities(PWDs)."
Section3.Withinthree(3)yearsaftertheeffectivityofthisAct,appropriateagencies,headedbytheDepartment
of Social Welfare and Development (DSWD), in consultation with the NCDA and relevant NGOs and POs, shall
review its implementation and recommend to Congress the need to mandate the establishment of a PDAO in
fourth(4th),fifth(5th)andsixth(6th)classmunicipalities.
Section4. In order to effectively carry out the objectives of Republic Act No. 7277, the National Government,
throughtheDSWD,shallensurethattheannualbudgetincludesprovisionstofundprogramsandprovidesupport
forPWDs.
Local government units shall likewise ensure that the necessary fund from any available local revenues is
allocatedfortheimplementationofthisActforthebenefitofPWDsintheirjurisdictions.
Section 5. Repealing Clause. All laws, presidential decrees, executive orders, and rules and regulations
inconsistentwiththeprovisionsofthisActareherebyrepealedormodifiedaccordingly.
Section6.SeparabilityClause.IfanyprovisionofthisActisdeclaredunconstitutional,thesameshallnotaffect
thevalidityandeffectivityoftheotherprovisionshereof.
Section7.Effectivity. This Act shall take effect fifteen (15) days after its publication in two (2) newspapers of
generalcirculationorintheOfficialGazette,whichevercomesfirst.

This Act which is a consolidation of Senate Bill No. 3560 and House Bill No. 1387 was finally passed by the
SenateandtheHouseofRepresentativesonJanuary18,2010andJanuary26,2010,respectively.
