AFFIDAVIT OF CONSOLIDATION OF OWNERSIP
KNOW ALL MEN BY THESE PRESENTS:
I, ISABEL ABASOLO, of legal age, Filipino, married and a resident of Catotal
Subd., Toril, Davao City, Philippines, in my capacity as the duly appointed GENERAL
MANAGER of the RURAL BANK OF DIGOS INC., a corporation duly organized and
existing under the laws of the Philippines, after having been duly sworn to in
accordance with law, do hereby depose and say:
That on JUNE 23, 2005, an extra-judicial foreclosure was made and a Special
Power of Attorney inserted in a Deed of Mortgage affecting the real estate covered by
Transfer Certificate of Title No. T-65970, identified as Lot No. 588-B, Csd-000253-D,
situated at Ginatilan, Kidapawan City, with an area of Thirty Seven Thousand Seven
Hundred Fifty Six (37,756) square meters. Said real estate was sold to the RURAL
BANK OF DIGOS, INC., as the highest bidder for the sum of TWO HUNDRED FIFTY
THOUSAND PESOS (P 250,000.00) ONLY, Philippine Currency;
That the ONE (1) YEAR from and after the registration of the SALE expired on
MARCH 01, 2007 and the mortgagor or any of his successors in interest or any person
having a lien on the aforesaid real estate subsequent to the mortgage in favor of the
RURAL BANK OF DIGOS, INC., under which said property was sold, has failed to
exercise the RIGHT OF REDEMPTION IN CONNECTION THEREWITH IN
ACCORDANCE WITH THE PROVISIONS OF Act No. 3135, as amended;
That as a consequence thereof, there has been a consolidation in favor of the
RURAL BANK OF DIGOS, INC., as the exclusive and absolute owner of the real
property aforestated;
That on the basis of the foregoing, I hereby request the REGISTRY OF DEEDS
OF DAVAO DEL SUR to affect the corresponding Consolidation of Ownership in
accordance with law in favor of the RURAL BANK OF DIGOS, INC., by cancelling the
afore-mentioned Transfer Certificate of Title No. T-65970 and issue in lieu thereof a
new certificate of title in the name of RURAL BANK OF DIGOS, INC., whose business
address and corporate existence is stated above;
