AMENDMENT TO DOCKYARD TEMPORARY
MEMORANDUM NO. A-50/2008 DATED 05 MAY 2008
1.
Following amendments are made in Dockyard Temporary Memorandum
No.A-50/2008 dated 05 May 08, with immediate effect:(a)
Para 8 of Dockyard Temporary Memorandum No.A-50/2008 dated 05
May 2008, be amended to read as follows:Powers of Punishment:
Under mentioned officers are to exercise disciplinary powers for
initiation of charge sheet and imposition of Minor penalties and initiation of
charge sheet for imposition of Major penalties in respect of Group C and D

Para 13 of Dockyard Temporary Memorandum No.A-50/2008 dated 05
May 2008, be amended to read as follows:The Manager concerned, is to raise, Misconduct Report for issuance of
Minor charge sheet and submit the same along with the relevant documents
to Personnel Manager. Personnel Manager, on receipt of the said Misconduct
Report, is to put up a draft Minor Charge sheet to Judge Advocate, for
perusal. After the same is perused by Judge Advocate / Manager (Legal),
Naval Dockyard, Mumbai, a fair Minor Charge Sheet be signed by Personnel
Manager, be forwarded to respective Centre Manager, for handing over to the
Delinquent Government Servant. Copy of fair Memorandum be forwarded to
Judge Advocate, for record. Acknowledgement of the same be forwarded to
Personnel Manager, by Centre Manager. The representation / submission
received from the Delinquent Government Servant, if any, or after 10 days of
receipt of charge sheet, whichever is earlier, a draft Punishment Order be put
up to Judge Advocate, for perusal and after the same is perused by Judge
Advocate, the Punishment Order duly signed by Personnel Manager be
forwarded to the respective Centre Manager for handing over to Delinquent
Government Servant. Acknowledgement of Punishment Order be forwarded
to Personnel Manager by Centre Manager. Copy of Punishment Order be
forwarded to Judge Advocate for record. After the acknowledgment of the
said Punishment Order, a SMS be sent to Judge Advocate, for publishing the
DCE List.
Personnel Manager is to keep the files pertaining to minor
penalties in safe custody and ensure easy accessibility as and when so
required. JA, would not maintain any file on cases of minor penalties except a
matter record, which is to be maintained by him. As far as initiation of charge
sheet for imposition of Major penalties in respect of Group `C and `D
employees are concerned, their respective Centre Managers are to forward
Misconduct Report to Judge Advocate, for issuance of Major Charge Sheet.
