Wente, badge #7640 - Review of video retrieved from Djam's phone CON: 16-322339 __On September 6thy, 2016 I was assigned this case for investigation, —_ (On September 8th, 2016 Sgt. Eric Faulconer and | conducted an interview of suspect, Cariton Chia Diam [EEE Room 124 of Minneapolis City Hall. Related to that interview, Djam gave oral and written consent for investigators to conduct @ forensic phone analysis on his cellular phone. Djam explained during the interview that while having sex with the Vietim, he had recorded a portion of the sexual contact with his phone's video camera. Djam accessed and then played the video for Sgt Faulconer and me. Matt Wente with the investigation ofthis case. We located a person related to the case that we needed to speak to who was identified as Carlton Djem, We were Informed through the course of the investigation that Carfton was engaged in sexual activity with the victim in his bedroom at the Radius Apartments on the night of the assault. We located Mr. Djam at the University of Minnesota and brought him back to Minneapolis City Hall where he agreed to speak with us voluntarily about what transpired on the evening of the reported assault. Mr. Djam told us that he was at the Radius apartments hanging out in the room of some of his teammates in room| en fe ‘met the victim. He stated that he was siting on a couch with the victim and another male who was identified as a Lee ee ~ the couch, fring as he described it and that the victim was talking about the fact guys" before. Mr. Djam stated that he didn't know well, only meeting that day before the game, but that they decided to go up to his room with her and that they all left room Bltogether. He told her that he had told other members of the football team that he had engaged in sexual activity with the victim and said that he was just making sure that she was ok, The following day, Friday, She again contacted him and a litle more confused about what happened the night before and he realized that she had no memory for parts of the evening. He informed her that they had sex. He showed us the video that he alluded fo and it depicted the sexual acts that he described and the victim was both conscious and engaged as a willing participant. Mr, Djam then Identified several other males that also took part in sexual activly wth the vitim after he and| were finished and stated that he was inthe living room during the actives that were taking place in his bedroom, He remalned steadiast in his assertions that he did not sexually assault the victim and did not believe that any other of his teammates who also ‘engaged in sexual activity wih the victim did elther. He identified the other members ofthe team that engaged in sexual activity, in ‘order as Tamarion Johnson, Ray Buford, Kiante Hardin and Dior Johnson. Mr. Djam provided us with consent fo forensically collect the video ofthe vitim as well as ancther video that depicted the victim siting on his bed talking with him and in support of her state of consciousness. Mr. Djam also stated that several members ofthe team, in addition o some female iiends ofthe victim were aware that he left with her and said that he witnessed the victim epeaking with her fiends prior to leaving, assuming that she was informing them of her intentions to leave with him and ‘Sgt. Wente and | provided a ride for Mr. Djam back to the University and once arrived, He gave me verbal consent to search his room. | noticed that his sheets on his bed were diferent than the ones depicted in the video that he provided and that they had been recently laundered. There was also no other evidence of condom wrappers or thelr contents or any other evidence of a ‘sexual nature. While at the apartment building, we also collected and reviewed video from the apartment's security videos and after review, found nothing of evidentiary value. (On Friday, we made contact the other individuals mentioned to us by Mr. Djam. We were informed that they were represented by ‘counsel and that they were wiling to speak with us with the presence of counsel, They all agreed to meet us at the office of their attomey, Lee Hutton, located at the Capella Towers in Minneapolis. | participated with the Interviews of all four individuals. | recorded the interviews for Kiante Hardin and Dior Johnson. (Mr, Hardin stated that he was at the Radius apartments on the night of the reported assault and that he ran into Ray Buford and Dior Johnson as they were headed upstairs to the apartment of Mr. Djam. Once they arrived, he was informed that there was a female in the room of Mr. Djam that was allowing sexual interactions and that several of his teammates had either had intercourse 6 oral sex from the victim. He entered the room and spoke with the victim, he stated that he remembered asking her if she was ok with what was about to happen and that she responded with an affirmative. ‘She performed consensual oral sex on him for several minutes until he ended the interaction, stating that he felt guilty because he was seeing another gist and didn't feel right about what he was doing. He was resolute in his denial that the victim was incapacitated and said that she was in control of her faculties related to their conversations and her agreement with engaging in the sexual act for him, He agreed to provide a sample of his DNA in the form of a buccal swab that was collected to test against the victim's SAE exam. He stated that whatever interaction that took place between him and the victim was consensual. Next | spoke to Dior Johnson. He stated that he went into the room of Mir. Djam after Mr. Harding and that the victim was awake and alert. He remembers that they spoke for a litle while and that she performed oral sex and had sexual intercourse with her. He also did not see any signs of incapacitation and stated that after the sexual activity, He messaged her for future contact and said that he recelved correspondence from the victim on this evening that indicated that she knew who he was. ‘She never appeared to be unengaged in the activity with him and he remained absolute with his denials that he sexually assauited the victim.
