COMPLAINT AFFIDAVIT
I, MELVIN M. CARRIAGA, of legal age, married, Filipino, with address at
Barangay Tacbuyan, Estancia, Iloilo City, after having been sworn in accordance
with law, do hereby depose and say:
1. That, I am filing a criminal complaint for ANTI CARNAPPING ACT OF
1972 (R.A. 6539) against REGIE MAR FRANCISCO, of legal age, Filipino, and a
resident of Clement St., Estancia, Iloilo and a certain Alias Agaw of legal age,
Filipino, and a resident of Barangay Pa-on, Estancia, Iloilo (hereafter referred to as
the respondents);
2. That, on November 29, 2011, my tricycle with Plate Number WH 7951,
Engine Number KR 20004X00916E, Chasis Number KR 200-04Y-009126, was
stolen by the respondents while parked outside the house of David L. Mahusay at
Brgy. Botongon, Estancia Iloilo. Evidence of my ownership thereto is a Deed of
Sale and is herewith attached as Annex A. The Certificate of Registration and
Official Receipt issued by the Land Transportation Office are likewise attached in
this complaint-affidavit and are respectively marked as Annex B and Annex
C;
3. That, this incident was reported by my driver, David L. Mahusay, at
Estancia Municipal Police Station. A copy of the police blotter is attached as
Annex D;
4. That, on November 30, 2011, Edmark Manila approached me and he had
with him in his possession 1 set of telescopic, Ring, Aro and Hub. Since he was
aware that my tricycle was stolen, he took steps to determine whether these spare
parts sold to him by Danilo Deputado are mine. Upon seeing the items, I
immediately recognized that those were some of the parts of my tricycle. My driver
also confirmed it, so did my parents. Danilo Deputado sold these spare parts for
ONE THOUSAND SIX HUNDRED PESOS (PHP 1, 600.00);
5. That, I, together with my driver, parents and Edmark Manila, went to the
police station and brought with us a sack containing the spare parts. We informed

the police that these spare parts of my tricycle were from a certain Danilo
Deputado;
6. That, together with the police officers, we went to the place of Danilo
Deputado at Barangay Gogo, Estancia, Iloilo. He was then invited by the police
officers for questioning;
7. That, upon arriving at the police station, when Danilo Deputado saw a
sack containing spare parts of my tricycle, he said to me Didto sa Lotud-lotud gin
manihar ang tricycle;
8. That, the police officers further inquired from him if who are the persons
responsible for car napping the tricycle, he mentioned the names Regie Mar
Franciso and a certain Alias Agaw, the respondents;
9. That, the act of respondents in stealing the tricycle was with intent to gain
as in fact they dismantled it and gave some of the spare parts to Danilo Deputado;
10. That, I execute this complaint-affidavit to attest to the truthfulness of the
foregoing facts.
