COMPAINT-AFFIDAVIT

I, Antonio dela Cruz, Filipino citizen, of legal age, single, and a

resident of Naujan, Oriental Mindoro, after having been duly sworn in
accordance with law, hereby depose and say:

1. On October 15, 2005, I was consuming alcoholic beverages with my

friends, Daniel Castro, Michael Legaspi, and Yael Untalan at the
house of Daniel Castros parents in Naujan, Oriental Mindoro.
2. I admit that I have consumed excessive amount of alcohol. For this
reason, Daniel Castro assisted me to their guestroom where I laid
down to sleep for the night.

3. I woke up at around 5am on October 15, 2005 at a different room. I

went out to look for my friends only to find out that I am in a
strangers house.

4. I was able to glance at the mirror only to find out that I am wearing
different cloths and I have a huge cut in my forehead.

5. I also noticed that my cellphone and wallet are missing.

6. Out of confusion from the situation I found myself at, I ran out of the
house and went home.

7. The following day, October 16, 2005, I went back to the same house
to ask if they have my cellphone and wallet. They denied that they
acquired my properties but I saw Danielle Machiavelli using the same
iPhone model and case that I used to have the night I blacked out
because of alcohol.

COUNTER-AFFIDAVIT

I, Marietta Corsini, Filipino citizen, of legal age, married to Nichollo

Machiavelli, and a resident of Calapan City, Oriental Mindoro, after having
been duly sworn in accordance with law, hereby depose and say:

1. On October 15, 2005, around 10:00pm, my husband and I heard a

disturbing noise at the kitchen. Upon checking what was behind the
loud noise, we found out that Antonio dela Cruz forced himself inside
our house by destroying the doorknob and door lock at our back door.
2. Antonio dela Cruz, during that night, was uttering nonsense about his
personal problems. His movements and smell suggest that he is under
the influence of alcohol.

3. After asking him to peacefully leave the premises of our home, he

took a knife and threatened to kill us all.

4. In order to protect the lives of my husband, my three children, and

myself, I took reasonable action of throwing a frying pan at the
direction of Antonio dela Cruz. I hit him in the head. Seconds after,
the fainted.

5. Because my family is unaware of Antonio dela Cruz home address

and any person we could contact, we decided to let him occupy one of
our guest rooms in the second floor. My daughter, Dianne
Machiavelli, treated his head.

6. Again out of good will, my son, Daniel Machiavelli helped my

daughter change the clothes of Antonio dela Cruz because he is
soaked with alcohol, sweat, and mud.

7. I was monitoring my children and I could attest that there Antonio

dela Cruz do not possess any cellphone or wallet when we helped
him. We are not responsible for the loss of these items.
