Innovative Roadway Sign Review Program


A Memorandum of Agreement between the New York Department of
Transportation and the New York Division Federal Highway Administration
As a means to continue to foster a robust partnership between agencies it is with mutual interest
the New York State Department of Transportation and the New York Federal Highway
Administration agree to participate in this cooperative agreement that will outline how
innovative roadway sign programs are developed and potentially installed on the National
Highway System (NHS).

I. Purpose of the Agreement


This Memorandum of Agreement (MOA) sets out the terms by which the New York State
Department of Transportation (NYSDOT) and the New York Division Federal Highway
Administration (NYDIV-FHWA) will work together to implement a developmental or
innovative sign review program that reduces the opportunity for installation of roadway signs
that may not meet the intent of the MUTCD.
Through this agreement, both agencies agree to work together to qualify State-led new signing
initiatives while maintaining the intent and directives of the MUTCD.

II. Roles and Responsibilities


Responsibilities of the New York State Department of Transportation
1. NYSDOT will work collaboratively and proactively with the NYDIV FHWA on any new
initiatives that are considered innovative or non-traditional applications of roadway signs
that have the potential to be installed on the NHS.
2. NYSDOT will coordinate and provide the related signing information to the NYDIV
FHWA within a timely manner and when appropriate include NYDIV FHWA at any
related meeting.
3. NYSDOT will include in its timeline to completion opportunities for the NYDIV to
provide comments and, if appropriate, seek FHWA Headquarters guidance and/or
consensus.
4. NYSDOT will be amenable to input and/or guidance from the NYDIV-FHWA
Responsibilities of the New York Division Federal Highway Administration
1. NYDIV FHWA will collaborate with NYDSOT and provide comments on the Innovative
Roadway Signing Program issues in a timely manner.

2. NYDIV FHWA will be amenable to all proposed innovative sign programs or initiatives
and be fully cooperative in working with the State to ensure, where possible, the interest
of all parties is served.
3. NYDIV FHWA when requested and where applicable will provide technical guidance
and assist the State in an MUTCD request for experimentation.
Joint Responsibilities for Both Agencies
In return for cooperatively working together both agencies stand to succeed in the common goal
of improving the safety of the NHS.
1. NYSDOT and NYDIV FHWA will be proactive in communicating any relevant new sign
program information or related information that would support the intent of this MOA
and provide further opportunities to collaborate.
2. NYSDOT and NYDIV FHWA agree to implement this MOA and abide by its covenants
therein to the best of their ability.
3. NYSDOT and NYDIV FHWA agree to continue to evaluate their individual processes
for the purposes of understanding how they can meet the combined needs of both parties.

III. Duration of the Agreement


This agreement will be in effect from the date of signing and remain in effect until termination is
mutually agreed upon by both agencies.
The NYSDOT Director of the Office of Traffic Safety and Mobility , and the NYDIV-FHWA
Operations Team Leader will be the key contacts for this initiative. These individuals are
responsible for ensuring the conduct of the activities listed above.

IV. Signatures of Parties Principals


As a demonstration of a mutual commitment to this agreement and the terms of the MOA, the
names and signatures of NYSDOT and FHWA senior leadership authorizing and thereby
approving this agreement are listed below.
