Decisions, awards or orders of the Labor arbiter are final and executory UNLESS
appealed to the Commission by any or both parties within (10) CALENDAR DAYS from
receipt of such decision:
Such appeal may only be entertained:
1. prima facie evidence of abuse of discretion on the part of Labor Arbiter
2. decision was secured through fraud or coercion
3.if made purely on question of law
4. If serious errors in the findings of facts are raised which would cause grave or
irreparable damage or injury
*In case of a judgement involving a monetary award, an appeal by the employer may be
perfected only upon the posting of a cash or surety bond in the amount equivalent in the
judgement appealed from
*In a decision of a dismissed or separated employee, insofar as the reinstatement is
concerned, shall immediately, be executory, even pending appeal.
*To discourage frivolous or dilatory appeals, reasonable penalty, including fines or
censures is imposed upon erring parties
*In all cases, the appellant shall furnish a copy of memorandum of appeal to the other
party who shall file an appeal not later than (10) calendar days from receipt
*The Commission shall decide all cases within (20) calendar days from receipt of the
answer of appellee. The decision shall be final and executory
The NLRC shall not assume jurisdiction over issues except in case of noncompliance thereof or if there is prima facie evidence that the settlement was
jurisdiction either at the request of any interested parties or at its own initiative.
The SLEM may appoint, in addition to present personnel, such numbers of
LABOR ORGANIZATIONS
Any applicant shall acquire legal personality and shall be entitled to the rights and
privileges granted by law to legitimate labor organization upon issuance of COR based
on the ff. requirement:
The Bureau shall act on all application for registration within 30 days from filing
The decision of Labor Relation Division denying registration may be appealed to the
Bureau within 10 days from receipt of notice
If applicant is federation or national union, it shall, in addition, submit the ff:
a. Proof of affiliation of at least 10 local or chapters
b. the names and address of the companies where the locals/ chapters operate
Grounds for cancellation:
a. Misrepresentation, false statement or fraud in connection:
-with the adoption or ratification of the constitution and by-laws
-election of officers, minutes of election, list of voters or failure to submit list of
newly-elected officers and postal addresses within 30 days from election
b. Failure to submit :
-the documents within 30 days from adoption or ratification
-the annual financial report to the bureau within 30 days after closing of fiscal
year
