DECISION
on the Commission for Coordination of
Certain Activities related to the Migration Process

In order to improve the coordination and monitoring mechanism of the central public
administration authorities activities with attributions in the management of migration processes,
under Article 22 of Law No. 64-XII of 31 May 1990 on Government (Official Gazette of the
Republic of Moldova, 2002 , 131, 133, art.1018), as amended and supplemented, the Government
DECIDES:
1. To approve:
The nominal composition of the Commission for Coordination of Activities related to the
Migration Process, in accordance with Annex 1;
Regulation concerning the activity for the Coordination of Activities related to the Migration
Process, according to Annex 2.
2. It states that, in case of release from duty of the members of the Commission, their powers
will be exercised by newly-appointed persons, without issuing a new decision by the Government.
3. To repeal certain decision of the Government, in accordance with Annex No. 3.

THE REGULATION
regarding the activity of the Commission for Coordination of
Certain Activities related to the Migration Process
Chapter I
GENERAL PROVISIONS
1. The Regulation regarding the activity for coordination of certain activities related to the
migration process (hereinafter - Regulation) establishes the responsibilities and the way of
organizing the activity of the Commission for coordination of certain activities related to the
migration process (hereinafter Commission).
2. The Commission is a permanent advisory body of monitoring and coordination within the
Government.
3. The Commission is established in order to coordinate and monitor activities in the field of
migration and ensure the interaction of central public and local administration authorities with
attributions in the field.
4. The Commission operates in accordance with the Constitution of the Republic of Moldova,
conventions and international treaties to which Moldova is a party, with national legislation, other
legislations and regulations in force, and with this Regulation.
Chapter II
THE MAIN ATTRIBUTIONS OF THE COMMISION
5. The Commission is entrusted with the following attributions:
1) participates in the development and the implementation of state policies and strategies in
the management of migration processes, prevention and combating of illegal migration, and the
advancement of reform solutions for the recovery of the migrational situation in the Republic of
Moldova, in accordance with international standards;
2) contributes to the cooperation between governmental and non-governmental institutions,
and international agencies /organizations with attributions in the management of migration, for the
application of international and national Law concerning the migration processes regulation and
immigrants protection.

3) monitors the activity plans in the various projects implemented in the Republic of Moldova
in the field of migration, analyzes the essential reports developed within the projects and formulates
recommendations for improving these activities;
4) identifies the uncovered priority areas and formulates recommendations for funds allocation
in order to optimize the migration management system;
5) contributes to the coordination of the competent public administrative authorities activities
in the management and monitoring of migration processes;
6) develops recommendations for improving the legislation in the management of migration
processes, prevention and combating of illegal migration;
7) arranges to have control over the execution by competent public authorities of regulations
in force on the entry, stay and exit of foreigners and stateless persons, particularly those originating
from the countries with a high migrational potential;
8) monitors the implementation of actions set out in policy documents on migration and
asylum;
9) systematically informs the Government about its activity.
Chapter III
THE COMMISSION RIGHTS
6. In order to achieve its tasks, the commission has the following rights:
1) to request form the competent local and central public administration authorities the
necessary information for the Commission activity;
2) to submit to the Government proposals, recommendations on issues related to coordination
and promotion of state policy in the field of migration, based on the decisions adopted by the
Commission;
3) to involve representatives of local and central public administration authorities in
examining and solving problems within the competence of the Commission;
4) to be informed, in accordance with the current legislation, about the development and
content of draft documents related to the state position in the field of migration;
5) to request from local and central public administration authorities the endorsement of draft
documents related to the activity of the Commission.
Chapter IV
STRUCTURE AND ORGANIZATION OF COMMISSION ACTIVITY
7. The Commission shall consist of the President, members and secretary of the Commission.
8. In the temporary absence or impossibility to exercise the duties of the President of the
Commission, his activity is taken over by the person appointed by the President of the Commission.
9. the Commission activity is managed by the President, Minister of Internal Affairs.
10. The President of the Commission performs the following functions:
1) represents the Commission in its relations with the public authorities in the country, and
international relations;
2) ensures the fulfillment of Commission functions;
3) convenes and chairs meetings of the Commission, and if necessary, convenes extraordinary
meetings;
4) establishes and approves the agenda and the meeting schedule;
5) signs the Commission decisions.
11. The organizational activity of the Commission is ensured by its secretary.

12. The secretary of the Commission performs the following functions:


1) prepares proposals for the agenda and the meeting schedule of the Commission;
2) organizes and ensures the smooth progress of Commission meetings, performs secretarial
work;
3) ensures the implementation of decisions adopted by the Commission;
4) draws up minutes of the meetings;
13. The Commission forms, if necessary, permanent or temporary groups to examine problems
and develop solutions related to specific fields of its activity. The composition of the mentioned
groups includes experts in the corresponding fields from ministries and other central administrative
authorities, and, as appropriate, representatives of international organizations and NGOs operating in
the relevant field.
14. The Commission is convened when necessary or at least once per quarter.
15. The Commission meetings are deliberative if 2 thirds of the total number of members is
present.
16. The agenda of Commission meetings shall be drawn up and submitted by the Secretary for
approval to the President of the Commission.
17. The agenda shall be notified to the Commission members and, if appropriate, to invited
persons at least three days before the meeting is planned to take place.
18. The minutes of the Commission meeting shall be drawn up no later than 2 days from the
date of the meeting, the members of the Commission being consulted.
19. The minutes of the Commission meeting, signed by the President and secretary, shall be
sent to the Commission members.
20. The Commission adopts decisions for the purpose of fulfilling its functions.
21. The Commission decisions are adopted by simple majority of votes of the members
present, according to the procedure established by the Commission.
22. The Commission decisions are signed by its President.
23. The Commission decisions are binding to the Commission members.
24. The information-analytical materials on the results of decision implementation, adopted by
the Commission are regularly reviewed during its meetings.
