JUDICIAL AFFIDAVIT
I, JOHN ALCANTARA, legal age, Filipino, single and a resident of Barangay
Mercedes, Zamboanga City, Philippines, after having been duly sworn to in
accordance with law, hereby depose and say:
1 That I am filing this Judicial Affidavit mainly to strengthen the accusations
lodged against the persons of Harjado Buenbrazo, Rap Rap Diutay and
KUYANASH DELACROS now pending before the Regional Trial Court of
Zamboanga City for Highway Robbery;
2 That the questions are being conducted by Prosecutor Myrfadzna C. Albar at
her office at Provincial Prosecutors Office, Zamboanga City.
QUESTION1: How did you know the person of one of herein
respondents, Rap Rap Diutay?
ANSWER: Aside from being neighbors, we work together as
baggers.
QUESTION2: Since when?
ANSWER: Since childhood.
QUESTION3: How proximate is your relationship?
ANSWER: We talk anything under the sun. He would even
consider me when he would find some easy money. When we
talk about things like that, I would always try to change the
conversation.

QUESTION4: Can you tell us an incident where he persuaded

you to join his easy money work?
ANSWER: Sometime in June 2015, Rap Rap presented
himself while I was eating in the carinderia and persuaded me
to join his new modus operandi with his friends.
QUESTION5: What did you respond?
ANSWER: I asked him in our dialect, cosa ya tamen se Rap?
QUESTION6: What did Rap Rap said?
ANSWER: Excitingly he leaned towards me and whispered
Sabe ya bo, bien facil el sen which is loosely translated as
You know some easy money.
QUESTION7: How did he persuade you to engage into it?
ANSWER: He even told me that it is the new trend at the
present and it will be my loss if I ignored it.
QUESTION8: How did you react to the offer?
ANSWER: While it seems convincing, I did not buy the idea.
for personal reasons aside from the fact that the same
includes deceit which is contrary to my personal morals.
QUESTION9: What happened after that incident?
ANSWER: In fact, he would bump into me telling me the same
tales but I blatantly ignored the same. However, whenever we
meet, he would boastfully flash his money telling Tiene tamen
era bo este which is loosely translated as You shouldve had
this too.
QUESTION10: What transpired on January 17, 2016 if you
recall?
ANSWER: At around 4:30 in the afternoon, Rap Rap bumped
into me. He was excited because there was a shipping vessel
from Malaysia disembarking.
QUESTION11: What caused his excitement?
ANSWER: He said to me, Its easy to deceive and intimidate
people not from here and laughed. He then proceeded to
approach the exit gate (near NBI) of the seaport.

QUESTION12: What happened when the vessel

disembarked?
ANSWER: When passengers started to come, we met them. I
saw two (2) female passengers walking hurriedly towards the
exit one in her advance age and the other young so I
started towards them.
QUESTION13: What happened when the two passengers
came out?
ANSWER: Rap Rap beat me to them. Disappointed by the
loss of possible customer, I watched Rap Rap talk to them and
lead them towards the tricycle of an acquaintance.
QUESTION14: What happened next, if any?
ANSWER: When the tricycle was leaving with the two (2)
female passengers with Rap Rap with them.
QUESTION15: What did you do then?
ANSWER: I got slightly bothered but I did not mind it much
because I have my own task to perform and customers to look.
4 That I am executing this Affidavit to attest to the truth of the foregoing
statement.
