12 YEAR ENDING JUNE 30, 2011; AND FOR OTHER

18 FISH COMMISSION APPROPRIATION FOR THE
19 2010-2011 FISCAL YEAR.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. REGULAR SALARIES - OPERATIONS. There is hereby established for
25 the Arkansas State Game and Fish Commission for the 2010-2011 fiscal year,
26 the following maximum number of regular employees whose salaries shall be
27 governed by the provisions of the Uniform Classification and Compensation Act
28 (Arkansas Code 21-5-201 et seq.), or its successor, and all laws amendatory
29 thereto. Provided, however, that any position to which a specific maximum
30 annual salary is set out herein in dollars, shall be exempt from the
31 provisions of said Uniform Classification and Compensation Act. All persons
32 occupying positions authorized herein are hereby governed by the provisions
33 of the Regular Salaries Procedures and Restrictions Act (Arkansas Code 21-5-
34 101), or its successor.

36 Maximum Annual
1 HELP RESTRICTION. No employee of the Arkansas Game and Fish Commission who is
2 employed as extra help may receive an amount to exceed eighty-five percent
3 (85%) of the maximum annual salary for a comparable position as authorized
4 under 21-5-201 et seq. during any fiscal year, nor shall such an employee
5 be employed for a period of time to exceed one thousand eight hundred (1,800)
6 hours in any single fiscal year.

8 SECTION 7. SPECIAL LANGUAGE. Arkansas Code Title 15, Chapter 41,
9 Subchapter 1 is amended to add an additional section to read as follows:
10 15-41-118. Agreements to hold and save United States free from
11 damages.
12 (a)(1) Except as provided in subdivision (a)(2) of this section, the
13 Arkansas State Game and Fish Commission is authorized to agree to hold and
14 save the United States free from damages due to the design, construction,
15 operation, maintenance, repair, replacement, or rehabilitation of:
16 (A) Projects for water resource development, wildlife
17 conservation, or other purposes; and
18 (B) Any state-sponsored or locally sponsored project-related
19 betterments.
20 (2) Subdivision (a)(1) of this section shall not apply to damages
21 due to the fault or negligence of the United States or its contractors.
22 (b) Subsection (a) of this section does not:
23 (1) Obligate the General Assembly to provide future
24 appropriations; or
25 (2) Abrogate the provisions of Arkansas Constitution
26 Article 5, 29."

28 SECTION 8. LEGISLATIVE INTENT. It is the intent of the General Assembly
29 that any funds disbursed under the authority of the appropriations contained
30 in this act shall be in compliance with the stated reasons for which this act
31 was adopted, as evidenced by the Agency Requests, Executive Recommendations
32 and Legislative Recommendations contained in the budget manuals prepared by
33 the Department of Finance and Administration, letters, or summarized oral
34 testimony in the official minutes of the Arkansas Legislative Council or
35 Joint Budget Committee which relate to its passage and adoption.
